HomeMy WebLinkAbout03382 ORD - 01/13/1953AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, RECEIVING AND ACCEPTING THE WORK OF IMPROVING A PORTION OF ANTELOPE STREET IN SUCH CITY; AUTHORIZING AND DIRECT- ING THE EXECUTION AND ISSUANCE OF SPECIAL ASSESSMENT CERTIFICATES TO BROWN & ROOT, INC., THE CONTRACTOR PERFORMING SAID WORK, AND DE- CLARING AN EMERGENCY BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, DULY ASSEMBLED: SECTION I: That the work of improving that portion of ANTELOPE STREET from the East Property Line of Carrizo Street to the East Property Line of Nueces Bay Boulevard, by raising, grading, filling, widening, permanently paving and repaving same and by the construction, reconstruction, repairing or re- aligning of concrete curbs and gutters, and by the construction of such drains and other necessary incidentals and appurtenances as deemed necessary by the City Engineer, said permanent paving consisting of a one and one - half inch hot asphaltic surface course laid upon a four and one -half Inch hot mix asphaltic (concrete) base course, both of such type, construction, materials and thickness as have been deemed adequate and proper by said City Engineer, and all of said improvements be- ing as provided for in the Plans and Specifications therefor which have heretofore been prepared by the City Engineer and as have been approved and adopted by the City Council; and all of same having been performed and completed in full accordance with all the terms and provisions of the Contract dated March 25, 1962 between said City of Corpus Christi, Texas and Brown & Root, Inc., and with said Plans and Specifications therein - contained; and said City Engineer 33'9 having measured, examined and caused to be tested the finished improvements by the means and in the manner provided by the terms of said Contract and the Plans and Specifications therein con- tained, and having found that such improvements have been con- structed and completed in full compliance with all provisions of said Contract and said Plans and Specifications, and said City En- gineer having approved and accepted said work and improvements and having heretofore issued his Certificate of Final Acceptance, and so certified to said City Council and recommended that said City Council accept and receive said work and the improvements as con- structed and completed by said Brown & Root, Inc., and said work and improvements having been examined and found by the Mayor and City Council of said City of Corpus Christi, Texas, to have been performed and completed in full compliance with said Contract and said Plans and Specifications therefor, said work and improvements are hereby found by said City Council to have been performed and completed by said Brown & Root, Inc. in full compliance with the terms and provisions of said Contract and said Plans and Specifica- tions therefor, and same are hereby accepted and received by said City Council of the City of Corpus Christi, Texas, SECTION II: That the Mayor and City Secretary of the City of Corpus Christi, Texas, are hereby authorized and directed to execute and issue to Brown & Root, Inc., Special Assessment Cer- tificates evidencing the assessments levied against the properties Improved abutting upon that portion of Antelope Street in said City, above described, and against the real and true owners thereof, which, by the terms of said Contract, the City of Corpus Christi, Texas has agreed and obligated itself to issue and deliver to said Brown & Root, Inc., in accordance with the provisions of the Final Assessment Ordinance and other proceedings heretofore had and adopt- ed by said City Council; said Special Assessment Certificates to be executed in the name of said City by its Mayor and City Secretary, AND IMPRESSED WITH THE SEAL OF THE SAID CITY, AND DATED AS OF THE DATE HEREOF, AND SUCH OFFICERS ARE HEREBY AUTHORIZED AND DIRECTED TO EXECUTE SAID CERTIFICATES IN THEIR OFFICIAL CAPACITIES ON BEHALF OF SAID CITY AND DELIVER SAME TO SAID BROWN AND.ROOT, INC. SECTION III: THAT FINAL PAYMENT BE MADE IN ACCORDANCE WITH SAID CON- TRACT AND ORDINANCE N0. 3240 AUTHORIZING SAME OUT OF NO. 297 IMPROVEMENT BONDS 1951 CONSTRUCTION FUND `STREET IMPROVEMENTS) ACCORDING TO THE FINAL ESTIMATE PREPARED BY THE DIRECTOR OF PUBLIC WORKS AND DATED JANUARY S, 1953, IN THE AMOUNT OF $39,569.03, A COPY OF SAID FINAL ESTIMATE BEING ATTACHED HERETO AND MADE A PART HEREOF. SECTION IV: THAT THE FACT THAT THE FOREMENTIONED IMPROVEMENTS AND THE CONSTRUCTION OF SAME IMMEDIATELY ARE NECESSARY TO THE HEALTH, SAFETY AND GENERAL WELFARE OF THE PUBLIC BECAUSE OF THE HEAVY TRAFFIC ALONG SAID STREET CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, DECLARING SUCH EMER- GENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF THE SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY PASSED AND APPROVED THIS THE X77 DAY OF JANUARY, A.D. 1953• MAYOR � D — 71z "y TTEST n n — T E CITY OF CORPVS CHRISTI CITY SECRETARY AP ROVED AS TO LOCAL FORM: CITY ATT RNEY CORPUS CHRISTI, TEXAS /'?
