City Manager R. Marvin Townsend Executive Assistant City Attorney Michael May City Secretary Bill G. Read Mayor Pro Tem Tipton called the meeting to order in the Council Chambers of City Hall. City Secretary Read called the roll and stated there was a quorum of the Council and the necessary Charter Officers present to have a legally constituted meeting. *(Council Members de Ases and Gulley were absent from this meeting.) Motion by Lozano, seconded by Sample and passed unanimously, that the absences of Mayor Luby, Council Member de Ases and Council Member Gulley be excused from today's meeting. Motion by Gill, seconded by Sample and passed unanimously, that this Special Council Meeting be recessed for a recount of the votes on the June 26, 1976 bond election for the community -convention center. Mayor Pro Tem Tipton reconvened the Special Council Meeting on June 30, 1976 at 10:22 a.m., with the following members of said Council present, to -wit: Mayor Pro Tem Tipton Council Members: Eduardo E. de Ases City Manager R. Marvin Townsend Ruth Gill Executive Assistant City Attorney Bob Gulley Michael May Gabe Lozano, Sr. City Secretary Bill G. Read Edward Sample with the following absent: Mayor Jason Luby, constituting a quorum, at which time the following among other business was transacted: Dr. Tipton, Mayor Pro Tem, presented for the consideration of the Council an ordinance. The ordinance was read by the City Manager. The Mayor Pro Tem presented to the Council a communication in writing pertaining to said proposed ordinance, as follows: Minutes Special Council Meeting June 29 & 30, 1976 Page 2 "Corpus Christi, Texas June 30, 1976 "TO THE CITY COUNCIL Corpus Christi, Texas Gentlemen: The public importance and pressing need for the permanent improvements to be constructed by use of the proceeds of bonds voted at an election held June 26, 1976, create an emergency and an imperative public necessity requiring the suspension of rules and Charter provisions requiring ordinances to be considered and voted upon at three regular meetings. I, therefore, request that the City Council pass the proposed ordinance canvassing election returns for the issuance of said bonds as an emergency measure. You will please consider this request in connection with the ordinance which is to be introduced for passage by the City Council on this subject. Yours very truly, /s/ Bill Tipton, Mayor Pro Tem" Council Member de Ases moved that the Charter provision prohibiting ordinances from being passed finally on the date introduced be suspended for the reasons stated in the written request of the Mayor Pro Tem and stated in the emergency clause of the ordinance. The motion was seconded by Councilman Bob Gulley. The motion was carried by a unanimous vote by the City Council, viz: AYES: Council Members de Ases, Gill, Gulley, Lozano and Sample. NAYS: None. The Mayor Pro Tem requested that the records show that he voted Aye. This was done. Council Member de Ases moved that the ordinance be passed finally; The motion was seconded by Councilman Bob Gulley. The motion was carried by the following vote: AYES: Council Members de Ases, Gill, Gulley, Lozano and Sample. NAYS: None. The Mayor Pro Tem requested that the records show that he voted Aye. This was done. The Mayor Pro Tem announced that the ordinance has been passed. (See Ordinance No. 13273.) City Secretary Read was instructed to write letters of appreciation for the Council to all of the people involved in the recount. There being no further business to come before the Council at this Special Meeting, on Motion by Gill, seconded by Sample and passed unanimously, the Meeting was adjourned at 10:27 a.m. t. THE STATE OF TEXAS COUNTY OF NUECES CITY OF CORPUS CHRISTI On this the 30th day of June, 1976, the City Council of the City of Corpus Christi, Texas, convened in Regular Meeting, with the following members of said Council present, to -wit: Bill Tipton, DDS, Eduardo de Ases Ruth Gill Bob Gulley ,Gabe Lozano, Sr. Edward L. Sample R. Marvin Townsend, Michael L. May, Harold F. Zick, Bill G. Read, Alton White, Jr., Mayor Pro -Tem Councilmen City Manager Asst. City Attorney Director of Finance City Secretary Tax Assessor -Collector with the following absent: Mayor Jason Luby constituting a quorum, at which time the following among other business was transacted: Dr. Tipton, Mayor Pro -Tem, presented for the con- sideration of the Council an ordinance. The ordinance was read by the City Secretary. This was done. The Mayor Pro -Tem announced that the ordinance has been passed. The ordinance is as follows: T ORDINANCE CANVASSING ELECTION RETURNS THE STATE OF TEXAS COUNTY OF NUECES CITY OF CORPUS CHRISTI . WHEREAS, the City Council of said City duly ordered an election to be held in said City on the 26th day of June, 1976, on the Proposition hereinafter stated; and WHEREAS, said City Council has investigated all matters pertaining to said election, including the ordering, giving notice, officers, holding, and making returns of said election; and WHEREAS, the election officers who held said election have duly made the returns of the result thereof, and said returns have been duly delivered to said City Council; and WHEREAS, it is hereby officially found and determined: that a case of emergency or urgent public necessity exists which requires the holding of the meeting at which this Ordi- nance is passed, such emergency or urgent public necessity being that the proceeds of the bonds heretofore voted are required as soon as possible and without delay for necessary and urgently needed public improvements; and that said meeting was open to the public, and public notice of the time, place and purpose of said meeting was given, all as required by Vernon's Ann. Civ. St. article 6252-17, as amended. THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: 1. That the City Council officially finds and determines that said election was duly ordered, that proper notice of said election was duly given, that proper election officers were duly appointed prior to said election, that said election was duly held, that due returns of the result of said election have been made and delivered, and that the City Council has duly canvassed said returns, all in accordance with law and the Ordinance calling said election. 2. That the City Council officially finds and determines that the following votes were cast at the election on the submitted Proposition by the resident, qualified electors who voted at the election: 13,244 VOTES: FOR ) ) 12,924 VOTES: AGAINST ) PROPOSITION THE ISSUANCE OF EXHIBIT, MEETING, BANQUET, AUDITORIUM AND CONVENTION FACILITY AND SITE BONDS A copy of the vote tabulation is attached hereto and made a part hereof, marked Exhibit "A". 3. That the City Council officially finds, deter- • 'mines and declares the result of said election to be that the Proposition so submitted has received a favorable majority vote in all respects and has carried, and that the aforesaid bonds may be issued in accordance with law. 4. That the public importance and pressing need for the permanent improvements to be constructed by use of the proceeds of the sale of said bonds create an emergency and an imperative public necessity requiring the suspension of rules and Charter provisions requiring the same to be con- sidered and voted upon at three regular meetings, and such facts require that this ordinance be passed and take effect immediately as an emergency measure, and such rules and provisions are hereby suspended and this ordinance is passed and shall take effect as an emergency measure, and shall be in full force and effect immediately upon its passage.
