AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TEXAS, TO EXECUTE A CONTRACT WITH TELE -TRIP POLICY COMPANY, INC. FOR THE OPERATION OF AN INSURANCE VENDING MACHINE AT CLIFF MAUS MUNICIPAL AIRPORT FOR AND IN CONSIDERATION OF 13% OF ALL MONIES COLLECTED LESS BONI.FIED REFUNDS FOR A TERM OF ONE YEAR UNDER THE PROVISIONS AND CONDITIONS SET OUT IN SAID AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED FOR AND ON BEHALF OF THE CITY OF "CORPUS CHRISTI, TEXAS, TO EXECUTE A CONTRACT WITH TELE -TRIP POLICY COMPANY, INC. FOR THE OPERATION OF AN INSURANCE VENDING MACHINE AT CLIFF MAUS MUNICIPAL AIRPORT FOR AND IN CON- SIDERATION OF THIRTEEN (13 %) PERCENT OF ALL MONIES COLLECTED LESS BONIFIED REFUNDS, FOR A TERM OF ONE YEAR UNDER THE PROVISIONS AND CONDITIONS SET OUT IN SAID AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF. SECTION 2. THAT THE NECESSITY OF PROVIDING ALL PERTINENT FACILI- TIES IN CONNECTION WITH AIR TRAVEL, AND TO OBTAIN REVENUE THEREFROM, AT THE MUNICIPAL AIRPORT CREATES AN EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDI- NANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH PUBLIC EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY PASSED AND APPROVED, THIS THE ZA.L DAY OF FEBRUARY, A. . 1953• EST: MAYORI n THE CITY OF CORPUS CHRISTI CITY SECRETARY ApproW as to egal Form: CITY ATTORNEY V 'i { I AIRPORT RENTAL CONTRACT This contract made and entered into as of thed day of- 1952 by and between of 0, (hereinafter called "AIRPORT OPERATOR") sari TELE- TRIP POLICY COMPANY, INC., of 424 Lexington Avenue, New York 17, N. Y. (hereinafter called "TELE- TRIP "). bYITNESSETH: 1. In consideration of the covenants, agreements and obligations hereinafter set - forth, the AIRPORT OPERATOR does grant unto TELE -TRIP the right, privilege and concession for installing, operating, servicing and maintaining, either itself or through any designated agent acting for it, machines for the sale of Airline Trip hisura.nce in such numbers and at such locations on the airport premises as may be raut�?.a11 +,. agreeable. Z. 'PELF -TRIP agrees to hold the AIRPORT OPERATOR harmless in connection with said installation, operation, ,service and maintenance of such Airline Trip Insurance machines. 3. The AIRP >t PT L,P 'flM agrees to perform normal custodial duties includ- ing the dusting of and around each machine, the removing of any trash deposited thereon and the taking of reasonable precautions to prevent such machines from being tampered with, damaged, destroyed or imarreid but shall not be liable for any damage to such machines not caused by its own negligence. 4. TELE -TRIP shall assume full responsibility for the installation of the ma- chines and ftr all mechanical maintenance thereof and the AIRPORT OPERATOR shall have no responsibility therefor. 5. Unless a separate agreement is entered into between the parties hereto, re- speetinq collection of funds and, applications deposited in the machines, the AIR- PORT OPERATOR shall have no responsibility therefor. 6. TELE -TRIP agrees to pay to the AIRPORT OPERATOR rental, either in an amount equal to thirteen per centum (13%) of all moneys deposited in all such machines which are in active operation at or on the said premises, leas only bona fide refunds, or in the sum of Twelve Dollars ($12) per month for each ma- chine in active operation, whichever shall be the greater, it being agreed that such payments be computed on the basis of Ten Dollars ($10) to cover rental and Two Dollars ($2) to cover any and all costs of electrical current consumed. 7. Payment referred to in paragraph 6 above, shall be computed monthly, and check to cover, together with an explanatory statement shall be forwarded prior to the 15th day, of the second month succeeding the month of account, - over - Airport Rental Contract - Page Two 8. This contract shall become effective on the date that the first machine is in- stalled hereunder and may be terminated by either party by giving written notice to the other Thirty (30) Days prior to the effective date of such termination.
