HomeMy WebLinkAbout03415 RES - 02/03/1953A RESOLUTION��5 AMENDING RESOLUTION NO. 2961 PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI ON DECEMBER 26, 1950 BY AMENDING SECTION II THEREOF BY THE ADDITION OF A PARAGRAPH PROHIBITING THE PROPERTY, BEING THAT HOUSING ANNEXED TO LA ARMADA NO. III, FROM BEING SOLD TO OR OCCUPIED BY PERSONS AFFILIATED WITH SUB- VERSIVE ORGANIZATIONS: BY AMENDING THE DEFINITIONS OF "VETERAN" AND "SERVICEMAN" IN SECTION VIII TO INCLUDE KOREAN VETERANS; AND DECLARING AN EMERGENCY. WHEREAS, heretofore on the 26th day of December, 1950, the City Council,of the City of Corpus Christi, Texass passed finally a Resolution numbered No. 2961 and entitled: "A RESOLUTION NO. 2961 REQUESTING THE TRANSFER TO THE CITY OF CORPUS CHRISTI, TEXAS, OF TEMPORARY HOUSING, BEING THAT HOUSING NOW ANNEXED TO LA ARMADA NO. III PURSUANT TO TITLE VI OF THE LANHAM ACT; AND DECLARING AN EMERGENCY. "; and WHEREAS, the amendments to Resolution No. 2961 are requested by the Public Housing Commissioner prior to the final transfer of Title V Project TEX —V -41769 to the City of Corpus Christi, Texas; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION I. That SECTION II of said Resolution No. 2961 is hereby amended by the addition of the following paragraph and the same shall hereafter read as follows, to wit: (iii) The applicant further represents that it pro- poses not to sell the property herein requested, or any part thereof to, nor permit those properties to be occupied by, any person who is known to be a member Of any organization which has been or may be designated as subversive by the Attorney General of the United States pursuant to the provisions of Title I of the Independent Offices Appropriation Act, 1953 (Public Law 455 of the 82nd Congress, approved July 5, 1952). SECTION II. That SECTION VIII of said Resolution No. 2961 Is hereby amended and the same shall hereafter read as follows, to -wit: 341s SECTION VIII. The term "veteran" shall mean a person who has served in the active military or naval service of the United States at any time on or after September 16, 1940, and prior to July 26, 1947, on or after April 6, 1917* and prior to November 11, 1918, or on or after June 27, 1950, and prior to such date thereafter as shall be determined by the President, and who shall have been discharged or released therefrom under conditions other than dishonorable. The term "serviceman" shall mean a person in the active military or naval service of the United States who has served therein at any time on or after September 16, 1940, and prior to July 26, 1947, on or after April 6. 1917, and prior to November 11, 1918, or on or after June 27, 1950, and prior to such date thereafter as shall be determined by the President. SECTION III. The necessity for amending Resolution No. 2961 as requested by the Public Housing Commissioner prior to the final transfer of Title V Project TEX —V -41769 to the City of Corpus Christi creates a public emergency and public imperative necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having 'declared such emergency and necessity to exist, requesting the suspension of said Charter rule, that this Ordinance be passed finally on the date of its introduction, and that it shall take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.
