A JUDGMENT IN CAUSE N0. 8166 ENTITLED A. W. GREGG VS.
SOUTHERN MINERALS CORPOIRATION, ' ET AL TO THE EFFECT THAT
THE INTERESTS CLAIMED BY ALL PARTIES IN SAID ACTION AND
NOW ENGAGED IN THE TRIAL THEREOF,'SAVE AND EXCEPT THE
.INTERESTS OF A. W.IGREGG AND SAM SUSSER, BE RECOGNIZED
AS ESTABLISHED AND UNAFFECTED BY THE CLAIMS AND ACTION
AGAINST A. W. GREGG AND SAM SUSSER, PROVIDED SAID ORDER
FURTHER PROVIDES FOR THE CONTINUANCE OF SAID CAUSE OF
ACTION AGAINST A. W. GREGG AND SAM SUSSER UNTIL THE NEXT
REGULAR TERM OF SAID DISTRICT COURT OF SAN PATRICIO COUNTY,
TEXAS,'A COPY OF WHICH ORDER IS ATTACHED HERETO AND MADE
A PART HEREOF; AND DECLARING AN EMERGENCY.
WHEREAS, THERE IS NOW PENDING IN SAN PATRICIO COUNTY, TEXAS, AN
ACTION IN THE DISTRICT COURT OF SAN PATRICIO COUNTY, TEXAS, BEING CAUSE N0.
8166 ON THE .DOCKET OF SAID COURT ENTITLED A. W. GREGG VS. SOUTHERN MINERALS
CORPORATION, ET AL, IN WHICH ACTION A. W. GREGG IS PLAINTIFF, SAM.SUSSER,
GEORGE E. WOODS, SR., H. A. GREBE, THE ROYALTY COMPANY OF TEXAS, L. D. FRENCH,
CITY NATIONAL BANK OF HOUSTON, TEXAS, FIRST NATIONAL BANK OF HOUSTON, TEXAS,
AND THE CITY OF CORPUS CHRISTI- ARE DEFENDANTS AND INTERVENORS, AND WHICH ACTION
CONCERNS THE VALIDITY OF FOUR (4) CERTAIN OIL AND GAS LEASES CONCERNING LANDS
AND PROPERTIES OF THE CITY OF CORPUS CHRISTI, TEXAS; AND
WHEREAS, REQUEST HAS BEEN MADE BY THE CITY ATTORNEY OF THE CITY OF
CORPUS CHRISTI FOR THE AUTHORIZATION BY 7HE CITY COUNCIL OF THE ENTRY OF THE
JUDGMENT IN SAID CAUSE DISPOSING OF THE CLAIMS AND INTERESTS OF EACH OF THE
PARTIES IN SAID ACTION', SAVE AND EXCEPT THE INTERESTS AND CLAIMS OF A. W. GREGG
AND SAM SUSSER AND AS TO THE CLAIMS OF A. W. GREGG AND SAM SUSSER AND THE DE-
FENSE AND CROSS- ACTION OF THE CITY OF CORPUS CHRISTI AGAINST SUCH CLAIMS, BE
CONTINUED UNTIL THE NEXT REGULAR TERM OF SAID COURT; AND
WHEREAS, SAID MATTER HAS BEEN SUBMITTED TO THE COUNCIL FOR CONSIDERATION
AND THE COUNCIL HAS, WITH THE ADVICE OF THE C(,TY MANAGER, DETERMINED THAT THE
ENTRY OF SUCH ORDER AT THIS TIME WOULD BE TO THE BEST INTEREST OF THE CITY.
NOW., THEREFORE.11 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI:
SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED
FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI TO AUTHORIZE THE CITY ATTORNEY
TO AGREE TO THE ENTRY OF THE JUDGMENT HEREI,NOBOVE DESCRIBED, A COPY OF WHICH

SIDERED B,Y THE CITY COUNCIL AND ITS MEMBERS AND IT IS NECESSARY TO HAVE SUCH
ORDER ENTERED AT THIS TIME FOR THE BENEFIT OF THE CITY OF CORPUS CHRISTI, BUVE
TO THE FACT THAT SAID CASE IS NOW PENDING AND ON TRIAL AND THE ENTRY OF SUCH
ORDER CANNOT BE DELAYED CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC
NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETING$ OF THE
CITY COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY
TO EXISTS HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS
ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION, AND TAKE EFFECT
AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT 'IS ACCORDINGLY

7. That this judgment, the eomplianoe therewith by
the panties hereto, and the payment and receipt of moneys
hereunder or under the interests herein validated shall confer
upon the City of corpus Christi no cause of action or right of
recovery of any amount against the plaintiff, A. W. Gregg, or
the defendant, Sam Susser, by way of subrogation or otherwise.
There remains for trial in the cause from which the issues herein
adjudicated were severed the issues between the plaintiff and
the City of Corpus Christi and between the City of Corpus Christi
and defendant Sam Susser which were excluded from severance by
the order of severance entered in Cause No. 3166, A. W. Gregg vs.
Southern Minerals Corporation, on April 3rd, 1953, and the issues
so retained in said last mentioned cause by said order of severance
are not adjudicated hereby.
B. That The City Waticnal Bank OX Houston shall be,
and is hereby relieved of any liability by reason of any
indemnity executed by said bank in favor of the said City of
Corpus Christi.
9. That all other relief not herein specifically granted
and prayed for in this severed cause by any party hereto against
any other party hereto shall be, and the same is hereby, in all
things denied.
