AUTHORIZING AND DIRECTING THE CITY MANAGER OF THE
CITY OF CORPUS CHRISTI TO EXECUTE FOR AND ON BEHALF
OF THE CITY OF CORPUS CHRISTI A TRANSFER AGREEMENT
FROM THE UNITED STATES OF AMERICA BY THE ADMINISTRATOR
OF CIVIL AERONAUTICS TO THE CITY OF CORPUS CHRISTI
CONCERNING ONE 11) TETRAHEDRON TRAFFICAIRE CONTROL,
COMPLETE WITH UNDERGROUND POWER AND CONTROL CABLE
FROM THE TRAFFIC CONTROL TOWER, A. COPY OF WHICH
AGREEMENT IS ATTACHED HERETO AND MADE A PART HEREOF;
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. THAT THE CITY MANAGER OF THE CITY OF CORPUS CHRISTI IS
HEREBY AUTHORIZED AND DIRECTED TO EXECUTE FOR AND ON BEHALF OF THE CITY OF
CORPUS CHRISTI A TRANSFER AGREEMENT FROM THE UNITED STATES OF AMERICA BY
THE ADMINISTRATOR OF CIVIL AERONAUTICS FOR ONE (1) TETRAHEDRON TRAFFICAIRE
CONTROL, COMPLETE WITH UNDERGROUND POWER AND CONTROL CABLE FROM THE TRAFFIC
CONTROL TOWER FOR USE AT CLIFF MAUS FIELD, A COPY OF WHICH TRANSFER AGREEMENT

TRANSFER AGREEMENT
Pursuant to the authority contained in Section 302 (c) of the Civil
Aeronautics Act of 1936, as amended (49 U.S.C. 452 (c), and for and in
consideration of the covenants and agreements hereinafter set forth and
other valuable considerations, the United States of America, acting by and
throughthe Administrator of Civil Aeronautics, hereby transfers to the
am , all its right, title and interest in
and to the Government -owned equipment which is no longer required for use
by the Civil Aeronautics Administration, all as shown on Schedule "All at-
tached hereto and made a part hereof.
The transfer of title to the equipment is subject to the following
terms and conditions:
(1) The transferee agrees to use the equipment for aeronautical
purposes only, and at locations where such equipment will,
serve the flying public.
(2) The transferee agrees to assume custody of the equipment on
the effective date of this Agreement, which is the date of
approval of the transfer by the Administrator of Civil Aero-
nautics.

lease or leases between the Government and the owners -6£ the
property on which it is located,
(4) If the equipment is not to be utilized qy -its present loca-
tion, the transferee agrees at its opu:' expense and at no cost
to the Government to dismantle apd'remove the equipment from
the propertyand to restore ttis property to a condition satis-
factory to the Governmeqt-;'or as required by the Government's
lease with the owner.,` hould the owner of the property agree
with the transfe�i to waive the right to restore the property
upon the dismelitling and removal of the equipment, where such
restorat�of is required by the Government's lease with the
owned;' the transferee shall furnish the Administrator of ,Civil

and assistance in cormcction with any problems which nay arise
in converting the equipment hereby trruisferred for Airport use.

(b) The transferee agrees that the: equipment transferred by
this agreement shall be used and maintained for the use
of the public, without unjust discrimination.

SECTION 2. THAT THE NECESSITY OF TRANSFERING THE WIND INDICATING
DEVICE,KNOWN AS A TETRAHEDRON TRAFFICAIRE CONTROL, TO THE CITY OF CORPUS
CHRISTI FOR USE AT CLIFF MAUS FIELD CREATES A PUBLIC EMERGENCY AND IMPERATIVE
PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE
ORRESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE
CITY COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY
TO EXIST, REQUESTING THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDI-
NANCE BE PASSED FINALLY ON THE DATE OF 17S INTRODUCTION AND TAKE EFFECT AND
BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY
SO ORDAINED.

ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS
INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT
THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE, HEREBY REQUEST
THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS
ORDINANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT
MEETING OF THE CITY COUNCIL.
