COPY OF WHICH AGREEMENT IS ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. THAT THE CITY MANAGER OF THE CITY OF CORPUS CHRISTI IS HEREBY AUTHORIZED AND DIRECTED TO EXECUTE FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI A TRANSFER AGREEMENT FROM THE UNITED STATES OF AMERICA BY THE ADMINISTRATOR OF CIVIL AERONAUTICS FOR ONE (1) TETRAHEDRON TRAFFICAIRE CONTROL, COMPLETE WITH UNDERGROUND POWER AND CONTROL CABLE FROM THE TRAFFIC CONTROL TOWER FOR USE AT CLIFF MAUS FIELD, A COPY OF WHICH TRANSFER AGREEMENT 15 ATTACHED HERETO AND MADE A PART HEREOF: N :1 34bo _ Form ACA- 2099.1 DEPARTMENT OF CCli4iERCE (5 -50) CIVIL AERONAU'T'ICS ADMINISTRATION TRANSFER AGREEMENT Pursuant to the authority contained in Section 302 (c) of the Civil Aeronautics Act of 1936, as amended (49 U.S.C. 452 (c), and for and in consideration of the covenants and agreements hereinafter set forth and other valuable considerations, the United States of America, acting by and throughthe Administrator of Civil Aeronautics, hereby transfers to the am , all its right, title and interest in and to the Government -owned equipment which is no longer required for use by the Civil Aeronautics Administration, all as shown on Schedule "All at- tached hereto and made a part hereof. The transfer of title to the equipment is subject to the following terms and conditions: (1) The transferee agrees to use the equipment for aeronautical purposes only, and at locations where such equipment will, serve the flying public. (2) The transferee agrees to assume custody of the equipment on the effective date of this Agreement, which is the date of approval of the transfer by the Administrator of Civil Aero- nautics. THAT THE NECESSITY OF TRANSFERING THE WIND INDICATING DEVICE,KNOWN AS A TETRAHEDRON TRAFFICAIRE CONTROL, TO THE CITY OF CORPUS CHRISTI FOR USE AT CLIFF MAUS FIELD CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE ORRESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, REQUESTING THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDI- NANCE BE PASSED FINALLY ON THE DATE OF 17S INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED.
