CITY OF CORPUS CHRISTI, TEXAS
SPECIAL COUNCIL MEETING
JULY 14, 1976

Mayor Luby called the meeting to order in the Council Chambers of City Hall.
City Secretary Read noted there was a quorum of the Council and the necessary
Charter Officers present to have a legally constituted meeting.
City Manager Townsend presented Application #676-1, Fernando R. Villarreal, for
a change of zoning from "R -1B" One -family Dwelling District to'"A-1" Apartment House
District, located 75' southeast of Curtis Clark Drive on the southeast side of Burton
Lane, being Lot 1B, Block 5, Gardendale #2. He noted that the recommendation of the
Planning Commission is that "A-1" be denied, but in lieu thereof "R-2" Multiple Dwelling
-District be approved for a duplex use; and that the Planning Staff recommends denial.
He reviewed that in response to notices of the public hearing, two have been received
in favor of the zoning change and four in opposition.. Chief Planner Larry Wenger presented
a land use and zoning map and slides of the location, explaining that the applicant wishes
to convert the existing building into a 4-plex.
The applicant, Mrs. Fernando Villarreal, stated that she and her husband purchased
the lot some ten years ago and also own the single-family dwellings on both sides; that
the existing structure was moved onto the property at the time of purchase and converted
from a 4-plex to a single-family dwelling to accommodate their family; but now their
children have grown up and they would like to convert the house into a 4-plex again.
She said if the Council could not grant the request for a 4-plex, a 3-plex would be ,
satisfactory. She added that there is existing plumbing for four apartments.
There was no one in the audience in opposition.
Motion by Tipton, seconded by Sample and passed unanimously, that the hearing be

City Manager Townsend next presented Application #676-2, Aaron L. Ward, for
change of zoning from "B-4" General Business District to "I-2" Light Industrial District,
located in the 1300 Block of Up River Road, north of the 0. N. Stevens Filtration Plant,
being Lot D, Magee Tract Annex. He noted that the recommendation of the Planning
Commission is that "I-2" be denied on the northern 6+ acre portion, but that it be
approved on the southern 5+ acre portion fronting on Up River Road; and that the Planning
Staff recommends denial. He added that in response to the notices sent out regarding
the public hearing, none were returned either in favor or opposition. Chief Planner
Larry Wenger, then presented a land use and zoning map and slides of the location.
Attorney Curtis Dyer represented the applicant and T. J. Services (an oil field
drilling and service company), stating that the company is interested in purchasing
southern portion of the tract and relocating there. He added that the applicant would
like to be granted a special use permit for the southern portion of the tract only.
There was no one in the audience in opposition. Mrs. Charlotte Orr Avery
stated she owns some adjacent property,and the zoning request is acceptable to her.
Motion by de Ases, seconded by Lozano and passed unanimously, that the hearing
be closed.
Motion by de Ases, seconded by Gulley and passed unanimously, to accept the
recommendation of the Planning Commission.
City Manager Townsend next described Application #676-3, Dr. Louise A. Carter,
for change of zoning from "R -1B" One -family Dwelling District to "AB" Professional
Office District, located along the north right-of-way line of Saratoga Boulevard, east
of Everhart Road, being the east one-half acre+ portion of Lot 3, Section 1, Tract D,
Country Club Estates. He noted that the recommendation of both the Planning Commission
and the Planning Staff is that it be approved as requested; also that one letter was
received in favor of the zoning change. Chief Planner Larry Wenger presented a land
use and zoning map and slides of the location. No one in the audience addressed the
Council in opposition.
Motion by Lozano, seconded by Sample and passed --with Gill abstaining --that
the hearing be closed.
Motion by Sample, seconded by Lozano and passed --with Tipton abstaining, -to
accept the recommendation of the Planning Commission.'

City Manager Townsend then presented the ordinances on two of the zoning cases
passed previously in the meeting. City Secretary Read polled the Council for its
vote and stated that the ordinances passed, as follows:
ORDINANCE NO. 13289
AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF
AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND
RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE
NO. 6106, AS AMENDED, UPON APPLICATION OF AARON L. WARD BY AMENDING THE ZONING MAP BY
CHANGING THE ZONING ON TRACTS 3 AND 4, LOT D, MAGEE TRACT ANNEX, AS RECORDED IN VOL. 41,
PAGE 183, NUECES COUNTY MAP RECORDS, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY,
TEXAS, FROM "B-4" GENERAL BUSINESS DISTRICT TO "I-2" LIGHT INDUSTRIAL DISTRICT; KEEPING
IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY.
The Charter Rule was suspended and the foregoing ordinance was passed by the following
vote: Luby, Tipton, Gill, Gulley, Lozano and Sample, present and voting "Aye"; de Ases
absent.
ORDINANCE NO. 13290
AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY
OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE
AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY
ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF DR. LOUIE A. CARTER BY AMENDING
THE ZONING MAP BY CHANGING THE ZONING ON A PORTION OF LOT 3, SECTION,1, TRACT D, COUNTY
CLUB ESTATES, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -1B"
ONE -FAMILY DWELLING DISTRICT TO "AB" PROFESSIONAL OFFICE DISTRICT; KEEPING IN EFFECT
ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND DECLARING AN EMERGENCY.
The Charter Rule was suspended and the foregoing ordinance was passed by the following
vote: Luby, Gill, Gulley, Lozano and Sample, present and voting "Aye"; Mayor Pro Tem
Tipton abstaining; de Ases absent.
There being no further business to come before the Council at this Special
Meeting, by unanimous consensus the Special Council Meeting of July 14, 1976 was
adjourned at 4:22 p.m.
