AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER OF THE CITY OF CORPUS CHRISTI FOR AND ON BEHALF OF THE CITY TO EXECUTE A REVOKABLE PERMIT TO THE UNITED STATES COAST GUAM FOR OCCUPATION OF A FIFTEEN FOOT (15') SQUARE LOCATED ON CITY PROPERTY NEAR BARGE DOCKS AND SH.IP CHANNEL, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF; AND DE- CLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER OF THE CITY OF CORPUS CHRISTI FOR AND ON BEHALF OF THE CITY, BE, AND HE IS HEREBY, AMTHORIZED AND DIRECTED TO EXECUTE A REVOKABLE PERMIT TO THE UNITED STATES COAST GUARD FOR OCCUPATION OF A FIFTEEN FOOT (15') SQUARE LOCATED ON CITY PROPERTY NEAR BARGE DOCKS AND SHIP CHANNEL, A COPY OF WHICH PERMIT 15 ATTACHED HERETO AND MADE A PART HEREOF. SECTION 2. THAT THE NECESSITY FOR GRANTING THIS PERMIT TO THE UNITED STATES COAST GUARD, TO ERECT, CONSTRUCT, MAINTAIN, AND USE NAVIGATIONAL AID CREATES AN EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DE- C LARED SUCH PUBLIC EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUS- PENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY PASSED AND APPROVED, THIS THE xe DAY OF MAY, A.D. 1953• ATTEST: CITY S CRE`DARY APPRO D AS TO GAL FORM: CITY ATTORNEY MAYOR Plvv THE CITY CORPUS CHRI TI, TEXAS 3y�l COMMander, 8th CG District United States Coast Guard R$t Corpus Christi Channel Cal, B Kest Roar 282, Custom House Range Front Lights Pelt La erect Now Orleans, Louisiana on property of City of Corpus Christi Gentlemenn Upon your representation and request this permit is hereby given and granted to the United States of America represented by the u. S. Coast Curd, to erect, construct, maintain, and use navigational aid designated hereinafter as Corpus Christi Channel !gut B West Range Front Light and located on property of permitter on a plot 15 x 15 feet square with right of in- gress and egress to and from said plot for maintenanoe of such aid, more particularly des- cribed on attached chart hereto annexed and made a part hereof. The permitter does not asaums any liability for injury or damage to any parson or property incident to or that may arise during and in consequence of= (a) the use, occupancy and enjoyment, in accordance with this permmit by the Coast Guard of the lands affected hereby or, (b) the construction of, presence of, maintenance of, or failure to properly and safely so*- struet, operate, maintain and use said aid to navigation or part thereof. This permit shall ba effective uaon exse'ation hereof, subject to ter- UnaLion by either party at any time on thirty days written notice. The Coast :ward shall, at its oxn coat and sx- peare, upon receiving written notice from the permitter, change the location of said aid and appurtenances or any part thereof or remove same from the property as nearly as possible to the same state and condition it was in prior to the installation of said aid to navigation. When, and In the event, the channel is widened on the southerly side, and it thus becomes necessary to relocate this light, permission is hereb.r granted to move the light structure approximately 75 feet south. In each !event the movement will be entirely at Coast Guard ex- pense and the old location cleared and restored to its original condition. In the event that this permit is terAnated, the Coast Guard shall have thirty days after such notice of relocation or tern- 4ARtion to relocate or remove said structure and any im- provements placed by the Coast : ivard on the property covered by this perrait. This permit shall remain in force until Ler_3inated. AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; 1, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
