HomeMy WebLinkAbout03506 ORD - 07/08/1953AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER OF THE CITY OF CORPUS CHRISTI TO EXECUTE FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI A SUPPLEMENTAL AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES WITH MYERS & NOYES AND ASSOCIATES IN CONNECTION WITH THE PLANNING AND CONSTRUCTION OF A WATER SUPPLY MAIN FROM THE NEW FILTRATION PLANT NEAR CALALLEN TO THE CITY TO SOME PAINT NEAR THE WESTERLY CITY LIMITS, A COPY OF WHICH SUPPLEMENTAL AGREEMENT IS ATTACHED HERETO AND MADE A PART HEREOF; APPROPRIATING OUT OF NO. 298 CITY OF CORPUS CHRISTI WATERWORKS CONSTRUCTION FUND FOR SUCH ADDITIONAL ENGINEERING SERVICES; AND DECLARING AN EMERGENCY. WHEREAS, UNDER AUTHORITY OF ORDINANCE No. 3371, THE CITY OF CORPUS CHRISTI, ACTING BY AND THROUGH ITS CITY MANAGER, EXECUTED A CONTRACT -:BY AND BETWEEN THE CITY AND MYERS & NOYES AND ASSOCIATES FOR ENGINEERING SERVICES, WHICH CONTRACT IS DATED DECEMBER 24, 1952; AND WHEREAS, IT IS NOW DESIRABLE TO ENLARGE AND SUPPLEMENT SAID CONTRACT BY THE ADDITION THERETO OF ENGINEERING SERVICES,AND PREPARE A PRELIMINARY' ENGINEERING REPORT AND STUDY WITH RECOMMENDATIONS,TOGETHER WITH COST ESTI- MATES, INCLUDING FIELD SURVEYS, SUPERVISION OF BORINGS AND FOUNDATION INVESTI- GATIONS; ASSISTANCE TO THE CITY IN ADVERTISING FOR BIDS AND AWARDING OF CON- TRACTS; GENERAL SUPERVISION OF CONSTRUCTION AS DISTINGUISHED FROM RESIDENT FIELD SUPERVISION AND INSPECTION AND SERVICES OF A RESIDENT ENGINEER AND INSPECTORS AS REQUIRED DURING CONSTRUCTION. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER OF THE CITY OF CORPUS CHRISTI, FOR AND ON BEHALF OF THE CITY, BE, AND HE IS HEREBY, AUTHORIZED TO EXECUTE A SUPPLE- MENTAL AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES WITH MYERS & NOYES AND ASSOCIATES IN CONNECTION WITH WORK TO BE DONE AT THE NEW FILTRATION PLANT NEAR CALALLEN SO MOREPARTICULARLY SET FORTH IN THE TERMS AND PROVISIONS OF SAID SUPPLEMENTAL AGREEMENT, WHICH IS ATTACHED HERETO AND MADE A PART HEREOF- SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF NO. 298 CITY OF CORPUS CHRISTI WATERWORKS CONSTRUCTION FUND THE SUM OF FIVE THOUSAND DOLLARS ($5,000.00) FOR SUCH ADDITIONAL WORK TO BE DONE. SECTION 3. THE NECESSITY FOR SUPPLEMENTING SAID CONTRACT ABOVE MENTIONED BY THE ADDITION OF ENGINEERING SERVICES OF THE FILTRATION PLANT AT CALALLEN CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING 35�� V THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCILS AND THE MAYOR HAVING DECLARED THAT SUCH PUBLIC EMERGENCY AND IMPERATIVE PUBL1C NECESSITY EXIST, AND HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE IT IS INTRO- DUCED, AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED. OU PASSED AND APPROVED, THIS THE �_ DAY OF1953- MAYOR 4- 1- ,W-THE CITY OF CORPUS CHRISTI TEXAS -2- MYERS a NOYES AND ASSOCIATES CONSULTING ENGINEERS C P 7, P53 y Honorable City Manager & City Council Corpus Christi, Texas Gentlemen: In line with further discussion concerning the engineering services to be performed on the design and construction of a new water supply main from Calallen to the City of Corpus Christi, between such points as shall be designated by the City of Corpus Christi, and in consideration of the fact that the City may elect to super- vise the construction of this line, we wish to present the following revised proposal. Engineering services to be rendered: 1. preliminary report and estimate on proposed water line. This phase of the work to be completed within fifteen (15) days after receipt of work order. ` 2. Design of line and preparation of plans, specifications and con- tract documents to the point of letting contracts ready for con- struction. This phase of the work to be completed within one hundred and fifty (150) days after receipt of work order. 3. General supervision of the work as construction proceeds, said supervision to include periodical visits to the work by a mem- ber of our firm. 4. Services of our engineers in connection with City supervision, These services to be rendered at the rate of $75.00 per day per man. Should the engineering contract be awarded to us on the basis of items 1 through 4, the engineering fee will be five (5) per cent of the actual cost of construc- tion. Breakdown of the engineering fee on above listed items is to be as follows: (a) For performing only the work involved under item 1 above, the fee will be $5, 000.00. (b) For performing only the work involved under item 2 above, the fee is to be 55 per cent of the 5 per cent basic fee. Page 2 City Manager & City Council July 7, 1953 (c) For General Supervision as set out under item 3, the fee is to be 45 per cent of the 5 per cent basic fee. The liability of the City shall be for such work as is authorized in writing by the City, provided that should work under items 1, 2 and 3 all be authorized by the City then the $5, 000.00 fee provided in (a) above shall be considered as a par- tial payment and credited on the total fee of five per cent (5%) of the actual cost of construction. Should the City so desire, it will be satisfactory with us for the services performed under this contract to terminate with the completion of items 1 and 2 above, with the City assuming all supervision of the project. This work shall be considered as a project supplemental to the work specifically described in our existing contract with the City dated December 24, 1952, and shall be covered by all the provisions of that contract except as herein specifi- cally provided. The above proposal is in accordance with the Schedule of Fees and Salaries as published by the National Society of Professional Engineers and we trust this will meet with your approval.
