City Manager R. Marvin Townsend City Attorney J. Bruce Aycock City Secretary Bill G. Read Mayor Luby called the meeting to order in the Council Chambers of City Hall. City Secretary Read noted there was a quorum of the Council and the necessary Charter Officers present to have a legally constituted meeting. City Manager Townsend presented Application #C776-5, City of Corpus Christi, for change of zoning from "R -1B" One -family Dwelling District and "AT" Apartment - Tourist District to "B-4" General Business District, on a portion of Nueces Bay and of Block 415, Brooklyn Addition, located at the north end of Corpus Christi Beach in the west right-of-way for U.S. Highway #181, at the south approach of Nueces Bay Causeway. He explained that the recommendation of the Planning Commission is that it be denied, but in lieu thereof a special permit be approved subject to the approved site plan; and that the Staff also favors the special permit. Chief Planner Larry Wenger showed a zoning map and the land uses of the surrounding area. There was no opposition from the audience. Motion by Tipton, seconded by Lozano and passed unanimously, that the hearing be closed. Motion by Lozano, seconded by Tipton and passed unanimously, to issue a special permit according to the approved site plan, as recommended by the Planning Commission. City Manager Townsend next announced Application #776-8, Jack Solka, for change of zoning from "AB" Professional Office District to "B-1" Neighborhood Business District on the south 100' of Lot 2, Block 1, Stonegate North Unit #l, located on the northwest corner of Bonner Drive and Everhart Road. He reported that the Planning Commission's recommendation is that "B-1" be denied, but in lieu thereof a special permit be approved; that the site plan has been approved; and that the Planning Staff recommends denial of the "B-1" request but would not oppose a special permit. City Manager Townsend added that in response to notices of the public hearing, three letters have been received in favor and two in opposition to the zoning change. Motion by Sample, seconded by Lozano and passed unanimously that the hearing be closed. Motion by Sample, seconded by Gulley and passed unanimously to accept the recommendation of the Planning Commission. City Manager Townsend then presented Application #876-1E, Horace B. Brown, for an exception to the screening fence requirement along the perimeter of Lot 4, Block 1, Waldron Oaks Unit #2, located on the northeast side of Caribbean Drive approximately 320' east of Waldron Road. He stated that the Planning Commission's recommendation is that the request be granted; that the Planning Staff recommends the variance not be approved along the north and east property lines. In response to notices of the public hearing, two were returned in favor of the application. Mr. Wenger described the surrounding zoning. No one was in opposition. Motion by Tipton, seconded by Gulley and passed unanimously, that the hearing be closed. Motion by Tipton, seconded by Gulley and passed unanimously, to concur with the Planning Commission's recommendation. City Manager Townsend next announced Application #C876-2, City of Corpus Christi, for change of zoning from "B-1" Neighborhood Business District to "R -1B" One -family Dwelling District, located on the west side of the Crosstown Expressway at Nogales Street, being portions of Lots 6, 7 and 8, Block 8, San Diego Addition. He reviewed that the Planning Commission's recommendation is that it be approved; that no letters were received in response to notification of the public hearing. Chief Planner Wenger described the surrounding land use and zoning. No one addressed the Council in opposition. Motion by Sample, seconded by Tipton and passed unanimously, that the hearing be closed. Motion by Gulley, seconded by Tipton and passed unanimously, to approve the recommendation of the Planning Commission. a Minutes Special Council Meeting September 8, 1976 Page 3 Mr. Townsend then announced Application #876-3, Walter Wisznia, for change of zoning from "R -1B" One -family Dwelling District to "A-1" Apartment House District, located on the southeast corner of Denver and Rossiter Streets, being Lots 33 and 34, Block 14, Port Aransas Cliffs. He reviewed that the Planning Commission recommended that it be approved; that the Planning Staff does not recommend a change of zoning but would not be opposed to a special permit. He.reported that in response to notices of the public hearing, one letter had been received in favor and two in opposition to the zoning change. Mr. Wenger described the zoning map and land uses of the area. Mr. Earl Gilbert spoke in opposition, saying he wants to keep the area residential rather than for apartments. Mr. Walter Wisznia told the Council he plane to build two townhouses on the property which would be identical to the two he recently completed in front of it; that the cost would be in excess of $250,000 so he does not feel it would devalue the property nearby and might increase some of it; and that he considers his townhouses to be the finest in the city. Mrs. Blackwell spoke in favor, Baying that she owns property close by and thinks it would be an attractive addition to the city. Mr. John Chapman stated he anticipates purchasing one of the two new units to be constructed; and that he thinks the existing property has improved the appearance of the entire area. Mrs. Nancy Moran stated she also plane to purchase one of the new townhouses; she pointed out that both units will have fully enclosed, two -car garages which would maintain the appearance of the area, Mr. Gilbert told the Council he was withdrawing his opposition. Motion by Tipton, seconded by Gulley and passed unanimously, that the hearing be closed. Motion by Gulley, seconded by de Asas and passed --with Gill voting No --that the property be zoned "A-1" as requested and as recommended by the Planning Commission. City Secretary Read presented the following ordinances for the coning cases, which passed as follows: Minutes Special Council Meeting September 8, 1976 Page 4 ORDINANCE NO. 13386 AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF JACK SOLKA, BY GRANTING A SPECIAL PERMIT FOR A SHOPPING CENTER TO BE APPROVED CONTINGENT ON THE PLAN SUBMITTED AS WELL AS THE DESCRIPTION OF SIGN REQUIREMENTS, SUBJECT TO THE CONDITIONS HEREINAFTER SET FORTH ON LOT 2, BLOCK 1, STONEGATE NORTH UNIT 1/1, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. The Charter Rule was suspended and the foregoing ordinance was passed by the following vote: Luby, Tipton, de Ases, Gill, Gulley, Lozano, and Sample, present and voting "Aye". ORDINANCE NO. 13387 AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF HORACE B. BROWN, FOR AN EXCEPTION TO THE STANDARD SCREENING FENCE REQUIREMENT ALONG THE PERIMETER OF LOT 4, BLOCK 1, WALDRON OAKS UNIT #2, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCE IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. ORDINANCE NO. 13388 AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF THE CITY OF CORPUS CHRISTI, BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON THE REMAINING PORTIONS OF LOTS 6, 7, AND 8, BLOCK 8, SAN DIEGO ADDITION SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "B-1" NEIGHBORHOOD BUSINESS DISTRICT TO "R -1B" ONE -FAMILY DWELLING DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. ORDINANCE NO. 13389 AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF WALTER WISZNIA BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON LOTS 33 AND 34, BLOCK 14, PORT ARANSAS CLIFFS SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -1B" ONE -FAMILY DWELLING DISTRICT TO 'Al" - APARTMENT HOUSE DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. The Charter Rule was suspended and the foregoing ordinance was passed by the following vote: Luby, Tipton, de Ases, Gill, Gulley, Lozano, and Sample, present and voting "Aye". There being no further business to come before the Council at this Special Meeting, by unanimous consensus the Special Council Meeting of September 8, 1976 was adjourned at 4:05 p.m.
