SPECIAL COUNCIL MEETING
SEPTEMBER 15, 1976

Mayor Pro Tem Tipton called the meeting to order in the Council Chambers
of City Hall.
Assistant City Secretary Pierce noted there was a quorum of the Council and
the necessary Charter Officers present to have a legally constituted meeting.
Assistant City Manager Walker announced Application #776-9, R. N. Conolly,
for a change of zoning from "R -1B" Dwelling District to "B-4" General Business
District, on the south one-half of Lot 17, Section 48, Flour Bluff and Encinal
Farm & Garden Tracts, located on the east side of Flour Bluff Drive approximately
650' south of Graham Road. He explained that the recommendation of the Planning
Commission is that it be approved and that the Planning Staff recommends denial.
He reported that in response to notification of the public hearing, two letters
had been received in favor.
Chief Planner Larry Wenger described the surrounding zoning and land uses.
No on€ in the audience was in opposition to the zoning request.
Mr. Ed Tarpley stated he is associated with the company which plans to
put mini storage units on the property, similar to the ones they have constructed
along I.H. 37 in the city, with special emphasis on boat storage. He said the
units will be of steel reinforced concrete block, which would be very safe and
durable, and the area would be paved, fenced and lighted. He commented that there
is a great need for safe boat storage facilities in the area, and that he believes
the proposed property in Flour Bluff is an excellent location for same.
Motion by Gulley, seconded by Lozano and passed unanimously, that the
hearing be closed.
Motion by Gulley, seconded by Lozano and passed unanimously, to grant "B-4"
zoning as recommended by the Planning Commission.

Assistant City Manager Walker next presented Application #876-4, Great
Expectations Oil Corporation for a change of zoning from "R -1B" One -family
Dwelling District, "R-2" Multiple Dwelling District and a Special Permit to
"B-4" General Business District, located in the 3700 block of Leopard Street
(Woodlawn Shopping Center), being Lots 4 through 15, Woodlawn Addition. He
reviewed that the recommendation of the Planning Commission is that "B-4" be
denied but in lieu thereof the existing special permit be altered to accommodate
the proposed kiosk and other requirements of the initial special permit be
complied with; that the Staff recommends approval. He reported that in response
to notification of the public hearing, eight letters had been received in
opposition and one in favor. Chief Planner Wenger described the surrounding
zoning and land uses.
Mr. Jay Taylor, agent for the owners of Woodlawn Shopping Center, stated
the sole purpose of the zoning request is to erect a 4' x 9' kiosk (drive-thru
film shop) on the parking lot. He stated they would prefer to be granted an •
amendment to their special permit because some of the existing signs in the
shopping center would not be in compliance with "B-4" zoning. He also said the
fence along the alley behind the shopping center frequently gets damaged and they
are going to repair it again soon; and that if it is deemed necessary they would
construct a wooden fence around the service station rather than the existing chain
link fence.
Speaking in opposition was Mrs. Ervin L. Phillips, 3756 Macleod Drive,
who complained of loud noise throughout the night from unloading, raw garbage
in open trash containers in the alley which she said creates a strong odor problem
and breeds flies and mosquitoes, constant debris and an unsightly and unrepaired
fence. She contested that the existing fence is not a "solid" fence as required;
and that trash continually blows through onto their property.
Mr. Dave Hill, representing Fotomat Corporation, stated their company would
be willing to split the cost of constructing a suitable fence with Great Expectations
Oil Corporation.
Motion by Sample, seconded by Lozano and passed unanimously, that the hearing
be closed.
Assistant City Manager Walker assured that the Staff would promptly inspect
the existing fence.
Motion by Sample, seconded by Gulley and passed unanimously, to concur
with the recommendation of the Planning Commission.
The Special Council Meeting was adjourned at 4:10 p.m.
