HomeMy WebLinkAbout03627 ORD - 12/30/1953f AN ORDINANCE No. 3627 AMENDING ORDINANCE NO. 2241 ENTITLED "AN ORDINANCE REGULATING TRAFFIC UPON THE PUBLIC STREETS, ALLEYS, AND OTHER THOROUGHFARES IN THE CITY OF CORPUS CHRISTI, TEXAS, AND FIXING A PENALTY FOR VIOLATIONS AND REPEAL- ING ALL OTHER ORDINANCES AND SECTIONS OF ORDINANCES IN CONFLICT HEREWITH" BY AMENDING SUB - PARAGRAPH W OF SECTION 483 OF SAID ORDINANCE NO. 2241 AS AMENDED. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 2241 passed and approved by the City Council of the City of Corpus Christi, on the 16th day of March. A.D. 1948, and entitled: "AN ORDINANCE REGULATING TRAFFIC UPON THE PUBLIC STREETS, ALLEYS, AND OTHER THOROUGHFARES IN THE CITY OF CORPUS CHRISTI, TEXAS, AND FIXING PENALTY FOR VIOLATIONS AND REPEALING ALL OTHER ORDINANCES AND SECTIONS OF ORDINANCES IN CONFLICT HEREWITH ", as amended, be amended by amending Section 485 so that Sub - Paragraph (A) of said Section 485 shall hereafter read as follows: "SECTION 483. Prohibiting obstructions such as shrubs and other structures at intersections in restricted zones. (A) No person shall erect any wall, fence, or other structure to a height greater than three (3) feet above the level of the crown of the roadway, or plant any hedge, tree, shrub. or growth of a height greater than three (3) above the level of the crown of the roadway, or maintain or permit the existence of any such wall. fence, or other structure of a height greater than three (3) feet above the level of the crown of the roadway. or maintain or permit the growth or existence of any hedge, tree, shrub, or other structure to a height greater than three (3) feet above the level of the crown of the roadway upon his property or on property under his control wherever said property is bounded on two adjacent sides by public right -of -ways for road, street, boulevard, alleyway, or other public passage- way; the area so restricted being the area of the corner or corners of such om property, more particularly described as being that area bounded by two intersecting boundaries of the public right -of -ways for a distance of twenty (20) feet of each of.said boundaries from the point of inter- section, and bounded by a third side determined by the drawing of a straight line from the points on the two intersecting boundaries twenty (20) feet from their intersection; PROVIDED, However, that the existence of a tree shall not be unlawful so long as such tree is free of branches and foliage for a height of at least seven (7) feet above the level of the crown of the roadway, and provided, however, that the provisions of this ordinance shall apply only to those areas of the City of Corpus Christi, Texas, designated and classified by the Zoning Ordinance of the City of Corpus Christi, being Ordinance No. 2266, as the same has been or may be amended, as follows: R -1, One- Family Dwelling District use; R -2, Two - Family Dwelling District use; A -1, First Apartment House District use; A -2, Second Apart- ment House District use; and A -3, Third Apartment House District use. SECTION 2. This ordinance shall take effect from and after its publication one time in the official publication of the City of Corpus Christi, which publication shall contain the caption stating in summary the purpose of the ordinance, and the penalty for violation thereof.
