CITY OF CORPUS CHRISTI, TEXAS
SPECIAL COUNCIL MEETING
SEPTEMBER 22, 1976
3:30 P.M.

Mayor Pro Tem Tipton called the meeting to order in the Council Chambers of
City Hall. There was a quorum of the Council and required Charter Officers present.
City Manager Townsend announced Application No. 876-6, Joe Adame, Realtor,
for a change of zoning from "R -1B" One -family Dwelling District to "B-1" Neighborhood
Business District on Lot 20A, Block 3, Gardendale 1, located on the northeast corner
of Cain Drive and Everhart Road. He explained that the recommendation of the Planning
Commission and Planning Staff is for approval. Chief Planner Larry Wenger described
the surrounding zoning and land uses. No one in the audience spoke in opposition to
the zoning change.
Motion by de Ases, seconded by Gulley and passed unanimously, that the hearing
be closed.
Motion by de Ases, seconded by Lozano and passed unanimously, to accept the
recommendation of the Planning Commission and Staff.
City Manager Townsend then announced Application #876-7, Creveling Dodge Motor
Company, for a change of zoning from "B-1" Neighborhood Business District to "B-3"
Business District on Lots 10, 11 and 12, Block 5, Woodlawn Estates, located on the
southwest corner of Clare Drive and South Padre Island Drive. He reported that the
recommendation of both the Planning Commission and Staff is that the request be
approved. Mr. Wenger described the surrounding zoning and land uses. No one from
the audience addressed the Council in opposition to the zoning change.
Motion by Lozano, seconded by Sample and passed unanimously, that the hearing
be closed.
Motion by Sample, seconded by Gulley and passed unanimously, to accept the
recommendation of the Planning Commission and Staff.

City Manager Townsend announced Application #876-8, Eugene Bouligny, for a
change of zoning from "R -1B" One -family Dwelling District to "R-2" Multiple Dwelling
District, on Lot 15B, Block 7, Molina 11, located on the west side of Barrera Street,
100 feet south of Bloomington Street. He informed the Council that the Planning
Commission and Planning Staff recommend denial of the case. Chief Planner Wenger
described the surrounding zoning and land uses. City Manager Townsend added that
he was not aware of this upcoming request to change the zoning when he recommended
a refund adjustment to Mr. Bouligny for the property several weeks ago.
Mr. Eugene Bouligny stated that there is over 2200 square feet in the building
and it would cost about $25,000 to restore it. He said that housing is badly needed
in the area and it would upgrade the neighborhood. He also told that vandals have
caused considerable destruction to the building,and charged that "the reason the
property is in this derelict condition is because of the ten-month delay in getting
the tax lien problem solved with the City."
Mr. Jerry Jernigan, a builder, explained the extensive improvements contemplated
for the structure, saying they plan to restore it to excellent condition, including
wall-to-wall carpeting and central air. He stressed that the building is sound
with a sound roof and that there is adequate parking for the apartments; and that it
must be converted to a duplex or triplex in order to get a return on their investment.
Mayor Pro Tem Tipton called for -those in opposition, and Mr. Carlos Chapa, Jr.
told the Council he was speaking for his parents, who have lived on their property at
4307 Barrera for 26 years. He contested that there would be adequate parking space
for a duplex use.
Mrs. Armando Flores, 737 Bloomington, stated she is against apartments in
the building and thinks the house should be condemned.
Mrs. Jose Escalona, 4308 Barrera, also voiced her opposition.
City Manager Townsend reminded the Council that the 20% rule would be in
effect, requiring six affirmative votes for passage of the ordinance.
Motion by Sample, seconded by de Ases and passed unanimously, that the hearing
be closed.
Motion by de Ases, seconded by Gill and passed unanimously, to accept the
recommendation of the Planning Commission and Staff that the application be denied.

City Manager Townsend then reviewed Application No. 876-9, Plant World,
Inc., for a change of zoning from "R -1B" One -family Dwelling District to "F -R"
Farm -Rural District on Lots 1 and 2, McKinzie Acres, located on the east side of
McKinzie Road and north of Highway No. 44, adding that the Planning Commission
and Staff recommend that it be approved. Chief Planner Wenger described the
surrounding zoning and land uses. No one from the audience spoke in opposition
to the request.
Motion by de Ases, seconded by Lozano and passed unanimously, that the hearing
be closed.
Motion by Gulley, seconded by Lozano and passed unanimously, to concur with
the recommendation of the Planning Commission.
City Manager Townsend presented the following zoning ordinances. The vote
was taken and all ordinances passed unanimously, as follows:
ORDINANCE NO. 13417
AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY
OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE
AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY
ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF JOE ADAME, REALTOR, BY AMENDING
THE ZONING MAP BY CHANGING THE ZONING ON LOT 20A, BLOCK 3, GARDENDALE 1, SITUATED IN
THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -1B" ONE -FAMILY DWELLING
DISTRICT TO 1B-1" NEIGHBORHOOD BUSINESS DISTRICT; KEEPING IN EFFECT ALL OTHER PROVI-
SIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND DECLARING AN EMERGENCY.
The Charter Rule was suspended and the foregoing ordinance was passed by the following
vote: Tipton, de Ases, Gill, Gulley, Lozano and Sample, present and voting "Aye";
Luby absent.
ORDINANCE NO. 13418
AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY
OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE
AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY
ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF CREVELING DODGE MOTOR COMPANY BY
AMENDING THE ZONING MAP BY CHANGING THE ZONING ON LOTS 10, 11 AND 12, BLOCK 5, WOODLAWN
ESTATES, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "B-1"
NEIGHBORHOOD BUSINESS DISTRICT TO "B-3" BUSINESS DISTRICT; KEEPING IN EFFECT ALL OTHER

AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY
ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF PLANT WORLD, INC. BY AMENDING THE
ZONING MAP BY CHANGING THE ZONING ON LOTS 1 AND 2, MCKINZIE ACRES, SITUATED IN THE

Council Meeting of September 22, 1976 was adjourned at 4:15 p.m.
