HomeMy WebLinkAbout03686 ORD - 03/10/195440 , AN ORDINANCE CLOSING THAT UNNAMED STREET EXTENDING FROM THE SOUTH BOUNDARY LINE OF HOLLY STREET TO THE NORTH BOUNDARY LINE OF SOUTHLAND ROAD, ALL OF SAID STREET BEING AND LYING WHOLLY WITHIN THE CITY OF CORPUS CHRISTI AND SITUATED BETWEEN LOTS 4 AND 5, BLOCK 1, OF SOUTHLAND ESTATES AND BEING IN THE CITY OF CORPUS CHRISTI; AND RELINQUISHING ALL TITLE THERETO; AND DECLARING AN EMERGENCY. WHEREAS, THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI HAS BEEN PETITIONED THAT THAT CERTAIN UNNAMED STREET HEREINAFTER DESCRIBED BE CLOSED; AND WHEREAS, NOTICE OF THE PROPOSED CLOSING OF SAID STREET HAS BEEN GIVEN BY PUBLICATION AND BY MAIL TO THE LAST KNOWN ADDRESS OF ALL OWNERS OF PROPERTY ABUTTING SAID STREET AND WITHIN 450 FEET THEREFROM IN ACCORDANCE WITH THE CHARTER OF THE CITY OF CORPUS CHRISTI AS PROVIDED BY ARTICLE II, SECTION 6 THEREOF; AND WHEREAS, IN ACCORDANCE WITH THE NOTICE GIVEN AS ABOVE SET OUT, A PUBLIC HEARING BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI WAS HELD AT 7.30 O'CLOCK P.M. ON THE 18 DAY OF Febru2r3r , 1954, IN THE CITY COUNCIL CHAMBER IN THE CITY HALL; AND WHEREAS, THE PUBLIC WELFARE, SAFETY, CONVENIENCE AND NECESSITY WILL BE BETTER SERVED BY THE CLOSING OF SAID UNNAMED STREET TO TRAFFIC AND TO THE EXISTENCE AND MAINTENANCE OF SAID STREET; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THAT CERTAIN UNNAMED STREET DESCRIBED AS FOLLOWS: A STRIP OF LAND 40 FEET WIDE AND 6116.92 FEET LONG, LYING BETWEEN LOTS 4 AND 5, BLOCK 1, SOUTHLAND ESTATES, A SUBDIVISION SHOWN BY MAP OF RECORD IN THE OFFICE OF THE COUNTY CLERK OF NUECES COUNTY, TEXAS, IN MAP BOOK 10 AT PAGE 52, BEING THE AMENDED VERSION OF MAP OF RE- CORD IN SAID OFFICE IN MAP BOOK 10 AT PAGE 42, BEING SHOWN ON SAID MAPS AS AN EASEMENT FOR FUTURE ROAD, EX- TENDING BETWEEN A PUBLIC ROAD KNOWN AS HOLLY STREET AND A PUBLIC STREET FORMERLY KNOWN AS SOUTHLAND ROAD AND NOW CALLED SOKOL DRIVE. SAID TRACT IS SITUATED IN NUECES COUNTY, TEXAS, ABOUT 5 MILES S. 17' W. FROM THE COUNTY COURTHOUSE, AND IS MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS, AS FOLLOWS: BEGINNING AT A POINT IN THE NORTHEAST BOUNDARY LINE OF A PUBLIC ROAD KNOWN AS SOKOL DRIVE, (FORMERLY SOUTH- LAND ROAD) THE WEST CORNER OF SAID EASEMENT FOR FUTURE ROAD IN BLOCK 1, SOUTHLAND ESTATES, AS SHOWN ON SAID if , recorded maps of Southland Estates, for the west cor- ner of this tract,- Thence N.290E., parallel with and 20 feet north- westerly, measured at right angles, from dividing line between said Lots 4 and 5, in Block 1 of Southland Estates, as shown by said map of Southland Estates re- corded in Map Book 10 at page 42, and as shown un- amended on said map recorded in Map Book 10 at page 52, 646.93 feet to a point in the southwest boundary line of said Holly Street, for the nor th corner of this tract,- Thence S.611291E., along said southwest boundary line of Holly Street,- at 20.00 feet, a 1 -inch iron pipe set flush with the ground for the east roadside corner of said lot 4 and north roadside corner of said Lot 5,- in all, 40.00 feet to a point for the east corner of this tract,- Thence S.290001W., parallel with and 20 feet south- easterly, measured at right angles, from said divid- ing line between Lots 4 and 5, 696.91 feet to a point in said northeast boundary line of Sokol Drive for the south corner of this tract, - Thence N.610311W., with said northeast boundary line of Sokol Drive,- at 20.00 feet, a 1 -inch iron pipe set flush with the ground for the south roadside corner of said Lot 4 and west roadside corner of said Lot 5, - in all, 40.00 feet to the place of bsginning,- be, and the same is hereby closed to the public. SECTION 2. That the City of Corpus Christi hereby releases and re- linquishes all rights, title and interest in or to any of said street described in Section 1 hereof to the property owners abutting said street and the same shall revert to said owners. SECTION 3. The fact that public convenience and necessity will be better served by the closing of said street within the limits described in this ordinance, creates a public emergency and public imperative necessity re- quiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such public emergency and imperative neess- sity exist, and having requested that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.
