HomeMy WebLinkAbout03723 ORD - 04/07/1954TEXAS: AN ORDINANCE AUTHORI"LING AND DIRECTING THE CITY MANAGER FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI TO EXECUTE A CON- TRACT WITH ENIX CONSTRUCTION COMPANY FOR THE CONSTRUC- TION OF STORM SEWER IMPROVEMENTS ON PROCTOR- BRAWNER STORM SEWER FROM CORPUS CHRISTI BAY TO APPROXIMATELY 200' BEYOND STAPLES STREET, BEING DESIGNATED AS "PROJECT PWS -1 "; APPROPRIATING THE SUN OF $384.132.76 FROM NO. 295 STORM SEWER BOND IMPROVEMENT FUND FOR SUCH CONSTRUC- TION; MAKING SAID CONTRACT A PART HEREOF BY REFERENCE; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager is hereby authorized and directed to execute for and on behalf of the City of Corpus Christi a contract with Enix Construction Company for the construction of a monolithic concrete box storm sewer and appurtenant structures, which contract has been awarded in accordance with plans, specifications and contract documents on file in the office of the City Secretary, all of which are made a part hereof by reference, and according to the bid of Enix Construction Company, opened on the 10th day of March, 1954, the said bid of Enix Construction Company being the lowest and most advantageous to the City of Corpus Christi, Texas; and for payment the sum of $384,132.76 is hereby appropriated from No. 295 Storm Sewer Bond Improvement Fund. SECTION 2. The necessity for executing the above mentioned contract to provide adequate drainage for Proctor- Brawner Area creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, having requested the suspension of said Charter rule and that this ordinance be passed finally on the date of its in- troduction and that such ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY PASSED AND APPROVED, This the Zdday of April, 1954. 1 MAYOR PRO TEM THE CITY OF CORPUS CHRISTI, �4EXAS ATTEST: Ci-fy SecAt'ary APPROVED AS TO LEGAL FORM: a a I - City Att iney 61' APRIL 7, 1954 I CERTIFY TO THE CITY COUNCIL THAT THE MONEY REQUIRED FOR THE CONTRACT, AGREEMENT, OBLIGATION, OR EXPENDITURE CONTEMPLATED IN THE ABOVE AND FOREGOING ORDINANCE IS IN THE TREASURY OF THE CITY OF CORPUS CHRISTI TO THE CREDIT OF No. NO. 29' STORM 5'EWER 3OND IMPROVEMENT FUND FUND FROM WHICH IT 15 PROPOSED TO BE DRAWN, AND SUCH MONEY IS NOT APPROPRIATED FOR ANY OTHER PURPOSE.
