Home My WebLink About03724 ORD - 04/07/1954AN ORDINANCE REGULATING THE CONSTRUCTION, ENLARGEMENT, ALTER- ATION, REPAIR REMOVAL, AND DEMOLITION OF BUILDING AND STRUCTURES AND CERTAIN APPURTENANCES THERETO, AND CHANGES OF OCCUPANCY THEREOF; ADOPTING THE SOUTHERN STANDARD 30ILDING CODE (1954 REVISICN) WITH CERTAIN CHANGES THEREIN AND ADDITIONS THERETO; PRO- VIDING FOR ADMINISTRATION AND ENFORCEMENT; AND MAKING VIOLATIONS A MISDEMEANOR PUNISHABLE BY FINE NOT EXCEED - 1% $200,00; PROVIDING FOR PUBLICATICN BY NOTICE; PRO - VIDING A SAVINGS CLAUSE; AND REPEALDNG ALL WDINANCES IN CONFLICT THEREWITH, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. The book entitled "Southern Standard Building Code, 1954 Revision" (A copy of which, authenticated by the signatures of the Mayor and the City Secretary, and made a public record by this ordinance of the City Council, is on file in the City Secretary's office) is hereby adopted as the Building Code of the City of Corpus Christi, as fully as if copied at length in this ordinance, but with the following changes therein: 1. Sub- Section 101.1 of Section 101 is hereby changed to read as follows: "The - Building Code of the City of Corpus Christi, Texas ". 2. Sub - Section 102.1 (a) is hereby changed by substituting the term "Inspection Section" for the term "Building Department ". 3. Sub- Section 103.2 is hereby amended by the addition of the words "or his Assistants" following the words "upon notice from the Building Official" in the first sentence. 4. Sub - Section 103.3 is hereby amended by the addition of the words "or his Assistants" following the words 'The Building Official" in the first line of said sub - section. S. Sub - Section 103.4 (c) is hereby amended by substituting the phrase "Board of Building Code Appeals" for the phrase "Board of Adjustment and Appeals ". 6. Sub- Section 103.7 is hereby amended by substituting the phrase "Board of Building Code Appeals" for the phrase "Board of adjustment and Appeals ", in the first sentence of said sub- section. 7. Sub - section 103.8 is hereby amended by substituting the phrase "Board of Building Code Appeals" for the phrase "Board of Adjustment and Appeals in the last sentence of said sub- section. 6. Section 106.2 shall be and is hereby deleted. 9. Section 111.1 is hereby amended by Substituting the phrase "Board of Building Code Appeals" for the phrase "Board of Adjustment and Appeals" in the first sentence of said sub- section. 10. Section 111.1 is hereby amended by adding the sentence "The Director of Public forks shall be an ex- official member of the Board" at the end of the sub - section. 11. Sub - section 201.2 of Section 201 is hereby amended by adding to the definition of an "Architect" the words "Under the laws of the State of Texas" at the end of the sentence. 12. Sub - Section 201.2 of Section 201 is hereby amended by adding to the definition of "Engineer" the words "Under the laws of the State of Texas" at the end of the sentence. 13. Sub - Section 403.7 is hereby amended by substituting the phrase "Board of Building Code Appeals" for the phrase "Board of Adjustment and Appeals" in the last sentence of said sub - section. 14. Section 1305 shall be added to the code as a new section following Section 1304, and shall read as follows: Section 1305 - Floating Slab Foundations. Floating slab foundations for one story building must be in compliance with the requirements of the Federal Housing Administration specifications pertaining to same." N. Chapter XIX shall be and is hereby deleted in its entirety. 16. Section 2002 shall be and is hereby deleted in its entirety. 17. Section 2204 shall be and is hereby deleted in its entirety. 18. Sub - Section 1602.3 of Section 1602 is hereby amended by changing the first sentence to read as follows: "All concrete work except on one and two family dwelling units shall be supervised by the architect or engineer responsible for its design, or by a competent representa- tive of the architect or engineer responsible for construc- tion under whose supervision the construction is being con- ducted. 19. Sub - Section 1701.7 of Section 1701 is hereby amended by changing the second paragraph to read as follows: "All wood foundation sills which are less than 12 inches above exposed unprotected ground under the building, shall be a heartwood grade of a durable species as listed in Sec. 1701.4 or shall be pressure treated with an approved preservative." SECTION 2. If any part of this ordinance, or of the Southern Standard Building Code embodied herein by reference, be held void, such part shall be deemed severable and the invalidity thereof shall not affect the remaining parts of this ordinance or said Code. SECTION 3. The Building Code, passed and approved May 28, 1936, and all amendments thereto, are hereby repealed. All other ordinances inconsistent herewith are repealed only to the extent of such incon- sistency. Provided, nothing in this Ordinance or in the Code hereby adopted shall be construed to affect any suit or proceeding now pending in any court, or any rights acquired, or liability incurred, or any causes of action accrued or existing under any act or ordinances repealed hereby. Provided further, if the adoption of the Southern Standard Building Code by this Ordinance be ineffective to enact said Code as law, then this entire Ordinance shall be void for all purposes and all now exist- ing ordinances shall remain in effect. SECTION 4. Any person who shall violate any provision of this Ordinance, or of the Southern Standard Building Code as adopted herein, shall be deemed guilty of a misdemeanor and punished by a fine not exceed- ing two hundred dollars. If the violation be continuing, each day's violation shall constitute a separate offense. SECTION 5. This ordinance shall take effect from and after its publication one time in the official publication of the City of Corpus Christi, which publication shall contain the caption stating in summary the purpose of the ordinance and the penalty for violation thereof. SECTION 6. If for any reason any section, paragraph, subdivision, clause, phrase, or provision of this ordinance shall be held invalid, it shall not affect any valid provisions of this or any other ordinance of the City of Corpus Christi to which these rules and regulations relate.
