Mayor Jason Luby called the meeting to order in the Council Chambers of
City Hall.
The Invocation was given by Mr. Lloyd Scott, Associate for the Bayshore
Evangelical Free Church.
City Secretary Read called the roll and stated there was a quorum present.
Mayor Luby announced Proclamations for Youth Appreciation Week, November 8
through 13, 1976; United States Marine Corps Day, November 10, 1976; Christmas Seal
Days, November 10 through December 25, 1976; and Key Club Week, November 14 through
20,• 1976.
Motion by Tipton, seconded by Lozano and passed unanimously, that the
Minutes of the Regular Meeting of October 20, 1976; the Special Council Meeting of
October 21, 1976 at 4 p.m.; and the Regular Meeting of October 27, 1976 be approved
as submitted.
' City Manager Townsend announced the scheduled public hearing on the annexation
of McKinzie Road from the city limits north of IR 37 to that portion of the road
being dedicated by the developers of Castle River Unit I Subdivision, and explained
the Staff's recommendation for annexation.
There was no opposition from the audience.
Motion by Sample, seconded by Lozano and passed unanimously, that the hearing
be closed.
Motion by Gulley, seconded by Lozano and passed unanimously, to proceed
with the annexation of McKinzie Road as described.

City Manager Townsend then announced the recessed public hearing at 2 p.m.
on closing the deadend portions of Bennet and Pearl Streets between North Shoreline
Boulevard and the water's edge located generally east of Surfside Boulevard between
Breakwater and Canal Avenue on Corpus Christi Beach. He reviewed that on October
13, 1976 the hearing was recessed until today to give the Staff time to prepare
information on the Corpus Christi Beach drainage project which would have an outfall
located on that portion of Pearl Street requested to be closed. He explained the
applicant has requested that the street closings be withdrawn and they be allowed
to continue their discussion of drainage of the beach. Mr. Townsend stated the
Staff's recommendation is that the Council consider the hearing closed on the basis
of the withdrawn application.
Mr. James P. Ryan, attorney for Mr. Wayne Johnson, asked.to be allowed to
discuss the drainage situation. He emphasized again that they oppose draining that
area across the sandy beach or into the marina, but rather believe it should be
carried into the ship channel.
Dr. Hans Suter, ecologist, addressed the Council that he believes the beach
value would be severely impaired with drainoff running into the shallow area of water.
He explained that runoff is highly contaminated; that it would collect in that area,
creating oxidationand health problems. He stated he favors taking it into the ship
channel.
City Manager Townsend asked Dr. Suter to meet with the Staff and give his
suggestions regarding the beach drainage. He agreed.
Attorney Ryan also expressed a desire that Dr. Metzger, Director of the
Department of Health and Welfare, give his input on the drainage.
Mr. Bert Haas, architect, showed the Council Captain Clark's plans for a
new fishing pier, marina, and sales area for tackle and shrimp. He spoke against
the present storm sewer drainage design, saying it would spill out silt in front of
Captain Clark's property and the area would have to be dredged out all the time.
In further discussion, City Manager Townsend responded to Councilmember
Gulley the status and cost of the Corpus Christi Beach drainage project. Mr. Jimmy
Lontos, Director of Engineering and Physical Development, explained some of the
difficulties involved in draining the low, flat beach area.

Mayor Luby called for the City Manager's Report, and City Manager Townsend
presented the following items, with related comments and explanations:
a. Recommendation that a public hearing on the following zoning applications
be held at a Special Council Meeting at 3:30 p.m. on December 1, 1976:
(1) Mr. Ray Dault: "I-2" to "A-2", located on the south side of Leopard
Street approximately 500 feet east of Rhew Road
(2) Mr. Jack Carter: "R-2" to "AB", located on the southwest corner of
Annapolis Drive and South Staples Street
(3) Great Expectations Oil Corporation: "R -1B", "R-2" and "SP" to "B-4",
located in the 3700 block of Leopard Street (Woodlawn Shopping Center).
b. Recommendation that bids be received at 11 a.m., Tuesday, November 30,
1976 for the following:
(1) Sale and removal of a 4 -room and bath, one-story wood frame house and
a 3 -room, one-story wood frame apartment -type building behind the
house located at 246 Aviation Street. The property was acquired as
part of the Naval Air Station Safety Zones Land Acquisition project.
(2) Two replacement radar units for the Police Department.
(3) 57,800 tons of caliche and the testing thereof for use by the Street,
Water and Wastewater Services Divisions.
c. Recommendation that 82,600 pints of milk for the Senior Citizens Nutrition
Program be purchased from FOREMOST FOODS COMPANY, Corpus Christi, on the
basis of low bid of $16,625.62. Bids were received from 4 firms. Price
comparison shows a decrease of 5%. (Bid Tab #76-76)
d. Recommendation that 3 6 -person and 12 4 -person bus shelters be purchased
from Melrose Displays, Inc. of Passaic, New Jersey on the basis of low bid
of $15,078.69. The proposed locations for the shelters are as follows:
(1) Ayers Street north of Third to serve Spohn Hospital and the Medical
Center
(2) Hospital Boulevard east of Baylor Street to serve Memorial Hospital
(3) Corpus Christi State School
(4) Alameda Street north of Airline Road near Cullen Mall
(5) Winnebago Street near Coke Street
(6) Ayers Street at Pearse Street
(7) Staples Street at Morgan
(8) Brownlee Boulevard and Morgan
(9) Ayers Street north of Tarlton near Ayers Shopping Center
(10) Staples Street at Laredo
(11) Two shelters on Leopard Street just east of Carrizo Street at the
County Courthouse
(12) Staples Street south of Carmel Parkway at Parkdale
(13) Padre Island Drive at the Social Security office
(14) Brownlee Boulevard south of Agnes.
The shelters are included in the 1975 Urban Mass Transportation Administration
capital grant. Bids were received from three firms. A true price comparison
cannot be established since bus shelters have'not been purchased in quantity.
A shelter was purchased in 1974 and in 1975. Price comparison shows a 2%
decrease since 1974 and a 23% decrease since 1975. (Bid Tab 1177-76)

e. Recommendation that the request of the Transit Study Board to reduce
the fare of the C.B.D. Shuttle from 15C to 100 be approved. The Board
believes that the dime fare will reduce change problems and be better
accepted without adversely affecting total revenues. Approval of the
Board's request should, in the opinion of this office, not increase the
90 -day operating deficit by more than $500.
f. Recommendation that the ordinances awarding the contracts for Washington -
Carver area Unit I street improvements, Phases A and B, be amended to
provide for a reduction of the appropriation from the Community Development
Fund of $86,943.31 and appropriating an equal amount out of the Street Bond
Fund in order that the obligation of the Bond Fund will be equal to the
assessments on the project.
g.
Recommendation that the following minute orders authorizing street projects
in cooperation with the State Department of Highways and Public Transportation

1. Recommendation that the utilities deposit schedule be revised to:
(1) provide for a $25 minimum deposit where water, gas, wastewater and
garbage services are requested -- $20 for gas only, $10 for water or
water and wastewater only, and $5 for garbage only. No additional
deposit will be required for garbage if another utility service is
requested.
(2) Continue the requirement that deposits for commercial accounts equal
2 times average monthly bill for water, wastewater and gas services,
but with a $15 minimum for water/wastewater and $25 minimum for gas.
(3)
Allow certificates of deposit in lieu of cash for deposit amounts over
$500 with the customer receiving the interest thereon.
The present minimum residential deposit schedule is $20 for all services,
$10 for gas or gas/garbage, $10 for water or water/wastewater, $6 for
garbage only, and $12.50 for water/wastewater/garbage. Present commercial
deposits are 2 times average monthly'bill with a $20 water/wastewater minimum
and $20 gas minimum.

Recommendation that the 13 points of delivery of gas for City customers
formerly served by Area 3 of the Corpus Christi Municipal`Gas Corporation
be added to the Lo -Vaca Gas Supply contract as of the date the City acquired
Area 3 (January 1, 1975) when Municipal Gas retired its debt. The delivery
points are those that are still in use from the original Area 3 gas supply
contract (1963) with Southern Community Gas Corporation. No physical change
in delivery points or gas measurement is involved. These points should be
added to the contract to avoid future problems.
k. Recommendation that the Standard Fire Prevention Code, 1976 edition,
published by the Southern Building Code Congress, be adopted to update
the existing Fire Prevention Code. The existing Code is the 1970 edition
published by the American Insurance Association and was adopted in January,
1973. The American Insurance Association has also published a 1976 edition
of their Fire Prevention Code which is very similar to the Code being
recommended for adoption. Since the City currently uses and has adopted
the Building Code, the Gas Code and the Plumbing Code published by the
Southern Building Code Congress, adoption of the Fire Prevention Code
published by this body will eliminate some interpretation problems between
codes, provide a standard terminology, and provide a more easily administered
code.
Under discussion, Councilmember de Ases informed the Staff that he believes
bus shelters are needed near TEC and on Lipan near Carancahua. City Manager Townsend
replied that the Staff would check into it.
Under comments from the audience, Mrs. Clark asked what the improvements
would be under item "h-3". City Manager Townsend replied the application is for
additional recreation areas, restrooms, additional parking facilities and improved
access into the Nueces River Park.
Mr. Robert Koimn asked the status of the Mexican -American and BUILD projects
which were hoped to be funded under the Public Works Act.
City Manager Townsend answered that the Staff had presented additional
information on those projects during the morning Workshop Meeting. He explained that
BUILD'S proposal would not qualify in its present state because no building with
space for private rent can be included; but that the Staff will proceed in trying
to develop a viable project. Concerning the Mexican -American Plaza de Amistad
proposal, Mr. Townsend stated the Staff is proceeding with detailed architectural
and engineering plans. He told Mr. Koimn that if the applications were mailed in
without further work on the projects they would just be returned because the plans
are insufficient in their present state.
Mr. Raymond Freddie with BUILD asked how soon the City Staff would start
working with their group on the project. City Manager Townsend responded that some
of the Staff will be assigned to work with both groups in the next two days or so.

Motion by Sample, seconded by de Ases and passed --with Tipton voting No
on item "i" --that the City Manager's Report be approved.
Mayor Luby inquired of City Manager Townsend about an article in the
Caller/Times dealing with possible misuse of funds by an employee of the Corpus
Christi Tourist Bureau. Mr. Townsend replied that the Staff is investigating the
matter and will make a full report within the next 15 days.
City Manager Townsend next announced consideration of an appeal of Mr. Ben
House on behalf of C -K Paving, Inc. from the rejection of an application for water
service outside the city adjacent to the city limits near Rand Morgan Road.
Mr. Ben House, attorney, restated they feel it is arbitrary, unreasonable,
discriminatory and unconstitutional to deny water service to C -K Paving, Inc. when
the City is presently furnishing water outside of the city limits to other entities
and individuals. He cited a case involving the City of Boulder, Colorado, supporting
his stand. He charged that the City must provide water service on a non-discriminatory
basis; he urged that the City waive the requirement of annexation and furnish water
to them to avoid a possible lawsuit over the matter.
City Manager Townsend responded that water service has been administered
without discrimination since passage of the ordinance governing same.
Mr. House repeated that "others are getting water and we feel we should be
getting water too." He said they have no other source to turn to, because the City
has a monopoly on water supply.
After further discussion, City Manager Townsend responded that in three weeks
the Staff will bring back to the Council a full presentation on water service outside
the city.
(City Manager Townsend left the meeting at 3:45 to catch a flight out of
town on City business. Assistant City Manager Archie Walker presided for the
remainder of the meeting.)
The meeting was recessed at 3:45 to go into a Special Council Meeting on
three zoning cases.
The Regular Council Meeting was resumed at 5:15 p.m. with presentation of
the ordinances by Assistant City Manager Walker.

Under discussion from the audience, Capt, R. J. Herschback addressed the
Council relative to the ordinance deleting four budgeted fire alarm operator
positions and replacing them with four fire dispatcher positions. He said he was
"shocked" to see the Council abolish those fire alarm operator positions, and thinks
that is probably a violation of the law. He stated the present firefighters serving
as dispatchers would have two to four years experience; he said he believes women
could serve in those positions with the proper experience and equivalent pay. He
stated that sometimes in the event of a fire the dispatchers are left alone until a
senior officer arrives. He also remarked that the City should upgrade the Fire
Department rather than downgrade it.
Assistant City Manager Walker responded that the Staff is not trying to
downgrade the position of dispatcher but believes the position of fire alarm operator
is not needed in order to carry out that function of the Fire Department. He added
there is someone with firefighting experience in the station at all times, plus
radio communication with the commanding officer.
Capt. R. R. Ramirez addressed the Council that the problem is not with the
fire alarm operator positions but the failure of management to notify employees to
go for those positions.
Assistant City Manager Walker responded that the Staff met with representa—
tives of the Firefighters' union before the ordinance was ever presented the first
time, and they had no opposition to this recommendation. He explained that the
change puts trained firefighters back out in the field, and allows people trained
for dispatching to do that efficiently. He added that the Firefighters' contract
provides that the Department could have civilian dispatchers although it does not
specify abolishment of the fire alarm operator positions.
Councilmember Gulley agreed the union would have voiced its objection by this
time if they were opposed to the change.
Mayor Luby called for the vote on the ordinances. City Secretary Read polled

Mayor Luby then called for petitions or information from the audience. Mr.
P. R. Ochoa, repfesenting the Americans of Texas, spoke against the bilingual
requirement for many jobs in Corpus Christi, saying that was against the native
Texans who cannot read and write both languages. He said some Mexican -American
societies in the city are working subversively against the natives of Texas; he
urged the Council "to resolve the problem to protect the Texans and not people
who come from the other side of the border."
There being no further business, on Motion by de Ases, seconded by Sample
and passed unanimously, the Regular Council Meeting of November 10, 1976 was adjourned
at 5:52 p.m.
