HomeMy WebLinkAbout03730 ORD - 04/14/1954' AC:4/12/54 TEXAS: AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER FOR AND ON BEHALF DEHALF OF THE CITY OF CORPUS CHRISTI TO EXECUTE A CON- TRACT WITH CORPUS CHRISTI INDEPENDENT SCHOOL DISTR= PROVIDING FOR THE ANNEXATION OF CERTAIN PROPERTY OWNED BY THE CORPUS CHRISTI INDEPENDENT SCHOOL DISTRICT OF APPROXIMATELY 7.27 ACRES LOCATED ON GOLLIHAR ROAD OUT OF LOT 11, SECTION D, OF PAISLEY'S SUBDIVISION OF THE HOFFMAN TRACT, NUECES COUNTY, TEXAS, A COPY OF WHICH CONTRACT IS MADE A PART HEREOF FOR ALL PURPOSES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. THAT THE CITY MANAGER OF THE CITY OF CORPUS CHRISTI BE, AND HE 15 HEREBY AUTHORIZED TO EXECUTE FOR AND ON BEHALFOF THE CITY OF CORPUS CHRISTI, A CONTRACT WITH CORPUS CHRISTI INDEPENDENT SCHOOL DISTRICT, PROVIDING FOR THE ANNEXATION OF CERTAIN PROPERTY OWNED BY THE CORPUS CHRISTI INDEPENDENT SCHOOL DISTRICT OF APPROXIMATELY 7.27 ACRES OF LAND LOCATED ON GOLLIHAR ROAD OUT OF LOT 11, SECTION O, OF PAISLEY'S SUBDIVISION OF THE HOFFMAN TRACT, NUECES COUNTY, TEXAS, A COPY OF WHICH CONTRACT IS MADE A PART HEREOF FOR ALL PURPOSES, AND READS AS FOLLOWS: 5� v THE S'i°aAT$ of TZUS X COMITY (1p Imm WHERE, on the day of , l954, the Hoard of Education of the Corpus Christi Independent School District in Nueces County, Texas,, has by proper resolution authorized the Corpus Christi Independent School District to contract with the City of Corpus Christi, Nueces County, Texas, for the admission into said City of the lands hereinafter described; and WaEREAS, such resolution was made known to the Mayor, City Mana- ger, and City Council of the City of Corpus Christi, Nueces County, Texas, by certified copies of such resolution; and WHWYAS, the City Councii of the City of Corpus Christi., Nueces County, Texas, has determined that it is to the best interest of the City of Corpus Christi, Nueces County, Texas, that the children who shall attend the school to be constructed on said lands shall have the benefit of the police and fire protection services of the City of Corpus Christi, Nueces County, Texas, and that it is to the beast interest of the City of Corpus Christi, Texas to have dedicated the easements agreed to be dedicated by the Corpus Christi Independent School District upon the annexation of the lands hereinafter described, as evi- denced by Resolution of the City council of the City of Corpus Christi authorizing the City Manager of the City of Corpus Christi to enter into a contract on behalf of the City of Corpus Christi with the corpus Christi Independent School. District, pursuant to Article I, Section 2 of the City Charter, City of Corpus Christi, for the admission into said City of said lands hereinafter described, as evidenced by a certified copy of said Resolution attached hereto; NOW, MRSYM, KNOW ALL MU BY TRW I+USEITS, That the Corpus Christi Independent School District, acting by and through J. D. Slaybaugh, its Director of Tax, Finance and Property, hereunto duly authorized by the Board of Education, and the City of Corpus Christi, a municipal corporation, acting by and through its City Manager, hereunto duly authorized by the City Council of the City of Corpus Christi, do mutually con- tract and agree that the following described lands owned by the Corpus Christi Independent School District, adjacent to the city limits of the City of Corpus Christi, Texas, on which there are no resident voters, be admitted into the City of Corpus Christi, Nueces County, Texas, and that the City Limits of the City of Coitus Christi, Texas, be extended so as tc include and embrace such lands and constitute them an integral part thereof, which said lands are described as follows: A %27-acre tract of land in Nueces Coiu:ty, Texas, out of E1 Rincon del Oso Grant to Enrique Villareal, Abstract No. 1, about 4 miles 8.320W. from the County Seat, out of Lot li. in Section D of Paisley's Subdivi- sion of the Hoffman Tract, a subdivision shown by map of record in the office of the County Clerk of Nueces County, Texas, in Map Hook A at page 28. Said 7.27 -acre tract embraces the southwest 7.27 acres of a 10.00 acre tract out of said Lot 11, conveyed to the Corpus Christi Independent School District by the Convent Academy of the Incarnate Word by deed dated April 23, 1952, Wad recorded in the Deed Records of Nueces County, Texas, in Volume 550 at page 301, and is more particularly described by metes and bounds, as fci_I ws: Beginning at a joint ?.r the southwest boundary line of the present corporate limits of the City of Corpus Christi, where said present City Limits line .intersects the southeast boundar line of said Lot 1i, and of said 10.00 -acre tract out of Lot 11, and northwest boundary line of Lot 10, all in Section D of Paisley's Subdivision of the Hoffman `.Bract, for the east corner of this tract, whence a point, a 1 1f2 -inch iron pipe set flush with the ground in the unpaved intersection of Gollihe.r Road and Prescott Street, the common corner of Lots 6, 7, 10, and. 1.1 in said Sectior_• D, bears N. 2,3020 "E. 18 ±.00 feet, - Thence 4. ?8020 w., v_th the div4.ding line between seid Lots 7.0 and I1, and along the southeast boundary line of said 10.00 -acre tract, 48,).00 feet to a 7. -inch iron pipe, the south corner of said 1.0.)0 -Pare tract, for the south corner of this tract,, - Thence I6.6104C'w., with the southwest boundary line of said 10.00 - acre tract, 660.,0 feet to a 1 -inch iron 11ye, the west corner of said 10.00 -sere tract, for the west corner of this tract, - Thence N.28020'N., with the northwest boundary line of said 10.00- acre tract, 48c.0�; feet to a point in said present City Limits line, for the north corner of this tract, whence a point, the north corner of said 1;.00 -acre tract, bears X.28020 1E. 180.06 feet, - Thence 6.6104;'E., alon,° said present City Limits line, and parallel with and 180.00 feet southwesterly, measured at right angles, from the northeast boundary line of said Lot '_ -:L, and of said 10.cO -acre tract, 660.00 feet to the place of beginning,- Containing an area of 7.27 acres. And from the date of the passage of an Ordinance in conformity herewith by the City Council of the City of Car.;ns Christi, Nueces County, Texas, the above and foregoing lands shal-1 be admitted into the City of CorpLio Christi, Nueces County, Texas and the city limits of the City of Corpus Christi, Texas, extended so as to embrace and include the same. It is agreed by the Corpus Christi Independent School District thet upon the passage of an ordinance in conformity herewith by the City Council of the City of Corpus Christi, Nueces County, Texas, that the Corpus Christi Independent School District will cause to be executed and filed for record proper instruments dedicating as a right -of -way for street, drainage, and utility easement purposes a strip of land twenty -five feet (25') in width on and along the northwestern edge of that certain ten -acre tract of land described in deed from the Convent Academy of the Incarnate (lord to the Corpus Christi Independent School District of record in Volume 550 at page 301 of the Deed Records of Nueces County, Texas; and on and along the northwestern edge of that certain two -acre tract lying between the lands described in said deed from the Convent _.cademy of the Incarnate Word hereinabove referred to and Gollihar Park Subdivision Unit No. 2, being more particularly described in deed from .Monterrey Developers to the Corpus Christi Independent School District dated the 30th day of January, 1954, filed for record in the Deed Records of Nueces County, Texas, in the office of the County Clerk of Nueces County, Texas on March 16, in,54 at 3.55 'r.m. and bearing file number 396109, said right -of -wetly to be a zortion of Bernadino Street extending from Gollihar Road to the north - crest Corner of Lot 1 in Block 4 of Gollihar Park Subdivision Unit No. 2 and dedicating for utility easement purposes a strip of land five feet (51) in width on and along the southeastern edge of each of said tracts extending from GQllihar Road to the northeast Corner of Block 7, Gollihar Park Subdivision thAt No. 2. In witness whereof, Corpus Christi Independent School District has caused these presents to be signed by J. D. THE SHORTAGE OF SITES FOR SCHOOLS WITHIN THE CORPOR- ATE LIMITS OF THE CITY OF CORPUS CHRISTI CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT 15 INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE i,'IAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THAT SUCH CHARTER RULE DE SUSPENDED, AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTIONS, AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED.
