HomeMy WebLinkAbout03732 RES - 04/14/19541 A RESOLUTION DECLARING 'SITE PLANS AND REC CMMENDAT IONS OF PALMER & EAKET:, INC., SUBMITTED UNDER PROVISIONS OF CONTRACT OF OCTOBER 7, 1953, TO BE UNACCEPTABLE TO THE CITY, AND DIRI=ING THE CITY SECRETARY TO GIVE NOTICE TO PALMER & BAKER, INC., OF SJCH ACI ION OF THE COUNCIL, WHEREAS, Ey the provisions of a contract dated October 7, 1963, by and between the City of Corpus Christi and Palmer & Eaker, Inc„ providing among other things the following: "The Engineer will proceed immediately upon the execution of this contract with the above - mentioned surveys, borings, and traffic studies, and upon completion of such studies, will present to the City a plan of financing, Including a toll schedule and an estimate of all costs to be included in the revenue bond issue necessary to finance the work. "If such a plan is not prepared and presented within six (6) months, or if when presented contains a plan of financ- ing or a toll schedule, either of which the City in its sole discretion determines to be unacceptable, then this contract shall become null and void, and IIH&EAS, Palmer & Baker, Inc., did present to the City on or about February 17, 1954, a plan accompanied by two letters of transmittal, one dated February 8, 1954, and the other dated February 17, 1954, as performance of a portion of the services contemplated in said contract; and WHERL:AS, Said plan as presented and as supplemented by further re- ports and communications from Palmer & Baker, Inc., and other sources, to- gether with recommendations, statements of policy, declarations of projects, and other relevant matterg have been considered by the Council and the Council has determined that it is to the best interest of the City that said plan and 4 recommendation of Palmer & Baker, Inc, be rejected: _31 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1, That the plan prepared and presented by Palmer & Baker, Inc., under their tender of performance under the contract dated October 7, 1953, is hereby determined to be unacceptable to the City. SECTION 2. The City Secretary is hereby directed to notify Palmer & Baker, Inc., by registered mail of the action of the City as set forth in this resolution by transmitting a certified copy of this resolution to said Palmer & Baker, Inc., Mobile Alabama SECTION 3.
