RESOLUTION
SETTING FORTH THE STREET PSM ING ASSESSMENT POLICY
OF THE. CITY OF CORPUS CHRISTI TO BE ,APPLIED IN
DETERMINIPIG THE PERCENT!'',GE OF COST OF IMPROVEMENTS
TO BE ASSESSED AGAINST '+BUTTING PROPERTY OWNIERS;
DIRECTING THE DIRECTOR OF PUBLIC ;IORKS TO FOLLO!,J
SUCH POLICY IN PREP!`,RING ESTIMATES OF IMPROVEMENTS;
"NO PROVIDING FOR THE CORRECTION OF ALL ESTIMATES

WHEREAS, THE QUALIFIED VOTERS OF THE CITY OF CORPUS CHRISTI HAVE
AUTHORIZED T',iE ISSUANCE OF BONDS FOR THE CARRYING OUT OF A PERMANENT IMPROVE-
MENT PLANT FOR THE IMPROVEMENT OF STREETS BY THE CONSTRUCTION OF SIDEWALKS,
CURDS, GU "ITERS AND PAVEMENT IN THE CITY OF CORPUS CHRISTI, UPON THE BASIS
OF PARTICIPATION OF THE CITY IN THE PAYMENT FOR SUCH IMPROVEMENTS IN
CONNECTION WITH THE ASSESSMENT OF A PORTION OF THE COST AGAINST THE ABUTTING
PROPERTY OWNER; AND
4WHEREIS, IT IS IMPORTANT THAT A UNIFORM POLICY OF ASSESSMENT BE
ADOPTED FOR THE PARTICIPATION IN THE PAYMENT OF SUCH IMPROVEMENTS BY ASSESS-
MENT AGAINST THE PROPERTY OWNERS AND PAY:' ?ENT BY THE CITY; AND
WHERtAS, THE CITY COUNCIL HAS DETERMINED A REASONABLE POLICY FOR SUCH
ASSESSMENTS:
NO'U, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THE POLICY FOR STREET PAVING ASSESSMENTS FOR STREETS WITH
A NAXItLUM WIDTH OF THIRTY (30') FEET FROM FACE OF CURB TO FACE OF CURB SHALL BE
AS FOLLOWS:
T4ESE STREETS SHALL CONTAIN A MAXIMUM OF TWENTY -SEVEN (27) FEET
OF ASPHALT PAVED SURFACE AND ON EACH SIDE OF THE STREET ONE AND ONE -HALF (1 - 1/2)
FEET OF GUTTER SECTION, ONE (1) SIX (6) INCH CURB AND A FOUR ('4) FOOT SIDEWALK.
SIDEWALKS SHALL BE REQUIRED ONLY WHERE THE LAND HAS BEEN SUBDIVIDED OR DEVELOPED
BY SALE OF LOTS BY METES AND SOUNDS. � -
PROPERTY OWNERS ABUTTING ON EACH SIDE OF THE STREET SHALL BE
ASSESSED FORTY (40) PER CENT OF THE TOTAL COST OF THE PAVEMENT, CURB AND GUTTER
AND SIDEWALKS A'dUTTING THE PROPERTY AS DETERMINED BY APPLYING THE UNIT PRICES
OBTAINED BY BIDS TO THE CALCULATED QUANTITIES FOR THE IMPROVEMENTS ABUTTING THE
PROPERTY. -
ASSESSMENTS ARE ADJUSTED BY GIVING CREDIT FOR ADEQUATE EXISTING
SIDEWALKS, CURBS AND GUTTERS AND THE AMOUNT PREVIOUSLY SPENT FOR A PERVIANENT-
TYPE PAVEMENT THAT THE PROPERTY OWNERS HAVE HAD INSTALLED ABUTTING THEIR
PROPERTY. -
THE ASSESSMENT FOR CURB AND GUTTER, SIDEWALK AND PAVEMENT ABUTTING
THE SIDE OF ANY LOT SHALL BE ADJUSTED IN PROPORTION TO THE WIDTH OF THE
PROPERTY PERPENDICULAR TO THE STREET BEING IMPROVED. ONE (1) PER CENT SHALL
BE ADDED TO FIFTY (50) PER CENT OF THE ASSESSMENTFOR EACH FOOT OF WIDTH OF
THE PROPERTY GREATER THAN FIFTY (50) FEET OF WIDTH UP TO A MAXIMUM OF ONE
HUNDRED (100) PER CENT FOR PROPERTY OF ONE HUNDRED (100) FEET OR MORE IN
WIDTH. IN NO CASE SHALL LESS THAN FIFTY (50) PER CENT OF THE FORTY (40)
PER CENT
�� OF COST BE ASSESSED OR MORE THAN ONE HUNDRED (100) PER CENT OF THE
FORTY (`110) PER CENT OF THE COST DE ASSESSED.
LOTS ZONED FOR ONE AND TWO- FAMILY DWELLING UNITS (R -1 AND R -2)
WITH THE BACK OF THE LOT ABUTTING THE STREET TO BE IMPROVED SHALL BE ASSESSED
TWENTY -FIVE (25) PER CENT OF THE FORTY (40) PER CENT OF THE COST. WHERE THERE
IS ACCESS TO THE STREET BY DRIVEWAY FROM THE PROPERTY TO THE STREET, THEN
THE ABUTTING PROPERTY SHALL BE ASSESSED FIFTY (50) PER CENT OF THE FORTY (40)
PER CENT OF THE COST. ON ALL PROPERTY ZONED OR USED FOR OTHER THAN ONE OR TWO -
FAMILY DWELLING UNITS, THE COST OF THE PAVEMENT SHALL BE ASSESSED THE OWNER
AS IF THE LOT WERE FACING ON THE STREET TO BE IMPROVED.
SECTION 2. THAT THE POLICY FOR STREET PAVING ASSESSMENTS FOR STREETS
WITH A WIDTH OF MORE THAN THIRTY (30) FEET FROM FACE OF CURB TO FACE OF CURB
SHALL DE AS FOLLOWS;
THESE STREETS SHALL CONTAIN THE WIDTH OF ASPHALT PAVED SURFACE RE-
QUIRED, ONE AND ONE -HALF (1 -1/2) FEET OF GUTTER SECTION, ONE (1) SIX (G) INCH
CURB AND A FOUR (4) FOOT SIDEWALK 014 EACH SIDE OF THE STREET. THE SIDEWALK
MAY BE OMITTED ON ONE SIDE OF THE STREET AFTER APPROVAL OF THE CITY COUNCIL.
SIDEWALKS SHALL BE REQUIRED ONLY WHERE THE LAND HAS BEEN SUBDIVIDED OR DEVELOPED
BY SALE OF LDTS BY METES AND BOUNDS.
PROPERTY OWNERS WITH ZONING FOR ONE AND TWO- FAMILY DWELLING UNITS
tl SHALL BE ASSESSED FORTY (40) PER CENT OF THE COST OF THEIR ONE-HALF (1/2) OF
OF AN EQUIVALENT THIRTY (30) FOOT STREET, WHICH SHALL BE THE FOUR (4) FOOT

SIDEWALKS CURB AND GUTTER AND 13.5 FEET OF PAVEMENT WIDTH ABUTTING THE PROPER-
TY. THE CALCULATI O;JS SHALL BE BASED ON APPLYING THE UNIT PRICES OBTAINED
6Y BIDS AND CALCULATING THE QUANTITIES FOR THE IMPROVEMENTS ABUTTING THE
PROPERTY.
PROPERTY OWNERS WITH ZONI PIG USED FOR OTHER THAN ONE OR TWO- FAMILY
D WELLING UNITS SHALL BE ASSESSED FORTY (4O) PER CENT OF THE COST OF TFIE
P AVEMFNT, CURBS AND GUTTERS AND SIDEWALK ABUTTING THE PROPERTY AS DETERMINED
BY APPLYING THE UNIT PRICE OBTAINED BY BIDS TO THE CALCULATED QUANTITIES FOR
THE IMPROVEMENT ABUTTING THE PROPERTY. THE PAVEMENT WIDTH FOR THESE CALCU-
LATIONS SHALL BE DETLRMINED BY THE WIDTH OF THE STREET PLANNED LESS THE THREE
F EE OF GUTTER SECTION.
FOR ONE AND TWO- FAMILY DWELLING UNITS, THE ASSESSMENT FOR CURB AND
G UTTER, 5IDEWALK AND PAVEMENT ABUTTING THE SIDE OF ANY LOT SHALL BE ADJUSTED
IN THE PROPORTION TO THE WIDTH OF THE PROPERTY PERPENDICULAR TO THE STREET
EEING IMPROVED. ONE (1) PER CENT SHALL BE ADDED TO FIFTY (50) PER CENT OF
THE ASSESSMENT FOR EACH FOOT OF WIDTH OF THE PROPERTY GREATER THAN FIFTY (50)
FEET OF WIDTH UP TO A MAXIMUMS OF ONE HU14DRED (100) PER CENT FOR PROPERTY OF
ONE HUNDRED (100) FEET OR MORE IN WIDTH. IN IJO CASE SHALL LESS THAN FIFTY
(50) PER CENT OF THE FORTH (40) PER CENT OF THE COST BE ASSESSED OR MORE THAN
ONE HUNDRED (100) PER CENT OF THE FORTY (40) PER CENT OF THE COST BE ASSESSED.

THE LOT ABUTTING THE STREET TO BE IMPROVED SHALL BE ASSESSED TWENTY -FIVE (25)

COST OF THE PAVEMENT SHALL BE ASSESSED THE OWNER AS IF THE LOT WERE FACING ON
''HE STREET TO BE IMPROVED.
SECTION 3. THAT THE DIRECTOR OF PUBLIC WORKS OF THE CITY OF CORPUS
CHRISTI, IN PREPARING ESTIMATES OF THE AMOUNT TO BE ASSESSED AGAINST EACH
TRACT OF LAND AND THE OWNERS THEREOF OF EACH AND EVERY TRACT ABUTTING UPON STREETS,
AND THOROUGHFARES PROPOSED TO BE IMPROVED SHALL SHOW THE AMOUNT ASSESSABLE
ON THE FRONT FOOT BASIS AS TO EACH ABUTTING PROPERTY CALCULATED

AT A UNIFORM RATE AND THAT IN ADDITION TO SUCH AMOUNT SO CALCULATED THAT
THE DIRECTOR OF PUBLIC WORKS CALCULATE AS TO EACH AND EVERY PIECE OF PROPERTY
AN ADJUSTMENT OF SUCH AMOUNT IN ACCORDANCE WITH THE ABOVE ESTABLISHED POLICY.
SECTION 1E. IN ALL INSTANCES THE CITY COUNCIL SHALL IN ITS DISCRETION
DETERMINE THAT THE ASSESSMENT AS TO EACH AND EVERY PARCEL OF PROPERTY SHALL
NOT EXCEED THE BENEFIT WHICH SUCH PROPERTY WILL RECEIVE BY REASON OF THE CON-
11 STRUCTION OF THE IMPROVEMENTS PROPOSED TO BE MADE, AND IN THE EVENT THE AMOUNT
OF THE ASSESSMENT DOES EXCEED THE BENEFITS AS TO ANY ONE OR MORE PARCELS OR
TRACTS OF LAND, THEN THE PROPOSED ASSESSMENT SHALL, AS TO SUCH PARCELS OR TRACTS,
BE REDUCED SO AS NOT TO EXCEED THE BENEFIT OF THE IMPROVEMENTS.
SECTION 5. THAT THE FOREGOING ORDINANCE WAS READ FOR THE FIRST
TIME AND PASSED TO 'ITS SECOND READING ON THIS THE DAY OF ,
