SPECIAL COUNCIL MEETING
NOVEMBER 17, 1976

Mayor Pro Tem.Tipton called the meeting to order in the temporary absence
of Mayon Luby:
City Secretary Read noted there wasa quorum present for a legally constituted
meeting:
City Manager Townsend announced the publichearing on Application #976-6,
Juan A. Hinojosa, for change of zoning from 'R -1B" One -family Dwelling District to
"B -I" Neighborhood BusinessDistrict, on Lot 1, Block 5, John Jones #1, located at the
the southeast corner of Stafford and. Hudson Streets. He explained that the recom-
mendation of the Planning Commission is "that it be denied, but in lieu thereof a
special permit be approved to continue the present use with a waiver of any further
parking requirements, waiver of the standard screening fence requirement, and that
signing be in compliance with those requirements under a home occupation." He added
that the site plan was approved by the Planning Commission on October 12, 1976. Mr.
Townsend stated the Planning Staff's recommendation is that the request be denied,
on the basis.. that it would be en intrusion into an existing residential area With a
park and school nearby. .Be.also reported that in response to notice of the public
hearing, seven letters were returned in opposition and two in favor.
Chief Planner Larry Wenger described the surrounding zoning and land use,
explaining that the applicant now ' has a noxi' -conforming use - a key shop in the
back portion.of .their lot.

Mrs. Elvira Hinojosa, wife of the applicant, stated they have operated
their key shop business next to their home for 13 years, and have not had any.
complalnts.during that time. She explained she believes some people might have
misunderstood their zoning application and might believe they plan to change or
expand their'shop,: but they as not..
Motion by -de Ases that the hearing be closed; seconded by Lozano and
passed unanimously:
Motion by de Ases to accept the recommendation of the Planning Commission
for a special permit; seconded by Lozano and passed unanimously.
City Manager. Townsend next announced the public hearing on Application
#1072-2, Larry J: Nelson, for change of zoning from "R -1B" One -family Dwelling District
to "I-2" Light Industrial District on Lot 5, Block 3, Cabaniss Acres, located on the
north side of. Frederick. Drive approximately 210' west of Ayers Street. He noted that
the Planning Cothmission and Planning Staff recommend approval; and that four notices
have been- returned in.favor of the request.
Chief Planner Larry Wenger described the surrounding zoning and land use.
There was no one in the audience in opposition.
(Mayor Luby returned at this time.)
Motion by Sample that the hearing be closed; seconded by Gulley and
passed unanimously.
Motion by.Gulley that the application be approved; seconded by de Ases
and passed unanimously.
City.Manager Townsend then presented the. ordinances on the two foregoing
zoning cases.
ORDINANCE NO. 13488
AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY
OF AUGUST, 1937 APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE
AND RESOLUTION RECORDS., AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED
BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF JUAN A. HINOJOSA BY GRANTING
A SPECIAL COUNCIL. PERMIT TO CONTINUE THE PRESENT USE WITH A WAIVER OF ANY FURTHER
PARKING REQUIREMENTS., WAIVER OF THE STANDARD SCREENING FENCE REQUIREMENT, AND THAT
SIGNING BE IN COMPLIANCE WITH THOSE REQUIREMENTS UNDER A HOME OCCUPATION, ON ALL OF
LOT 1, BLOCK 5, JOHN JONES #1, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS,
SUBJECT TO THE CONDITIONS SET FORTH HEREINAFTER; KEEPING IN EFFECT ALL OTHER PROVISIONS
OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
AND DECLARING AN EMERGENCY.
The Charter Rule was suspended and the foregoing ordinance was passed by the following
vote: Luby, Tipton, de Ases, Gill, Gulley., Lozano and Sample voting -"Aye".

AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY
OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE
AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY
ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF LARRY J. NELSON BY AMENDING THE
ZONING MAP BY CHANGING THE ZONING ON LOT 5, BLOCK 3, CABANISS ACRES, SITUTATED IN THE
CITY OF CORPUS CHRISTI, NUECESCOUNTY, TEXAS, FROM "R -1B" ONE -FAMILY DWELLING DISTRICT
TO "I-2" LIGHT INDUSTRIAL DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE
EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
DECLARING AN EMERGENCY.

On Motion by Gulley, seconded by Lozano and passed unanimously, the
