HomeMy WebLinkAbout03777 ORD - 06/09/1954AN ORDINANCE CLASSIFYING THE ATTRAC'T'IONS AND PURPOSES FOR WHICH THE MEMORIAL AUDITORIUM IS RENTED; FIXING AND PRO- VIDING A SCHEDULE OF PATES OF RENTALS TO BE CHARGED EACH CLASS OF ATTRACTIONS; PROVIDING EXTENT TO WHICH UTILITIES, SOUND SYSTEM, SPOTLIGHTS, STAGE HANDS AND OTHER SERVICES, CONVENIENCES AND ACCESSORIES WILL BE FURNISHED WITHOUT ADDITIONAL CHARGES PROVIDING FOR THE RENTAL AT REDUCED RASES FOR REHEARSAL AND PRE- PARATION PURPOSES AND FOR THE MOVING OF EQUIPMENT IN AND OUT; PROVIDING THAT THE RIGHT TO OPERATE CONCESSIONS SHALL BE RESERVED BY THE CITY UNLESS SPECIALLY CON- TRACTED OTHERWISE; REQUIRING CERTAIN PROVISIONS IN ALL RENTAL CONTRACTS; DESIGNATING THE ADMINISTRATOR OF SUCH BUILDING AND FACILITIES. Now. Therefore, be it ordained by the City Council of the City of Corpus Christi, Texas: SECTION 1: The various attractions and purposes for which the Memorial Auditorium are rented are divided and classified into the following classes, to -wit: Class 1 shall include the following: (A) Professional athletic exhibitions or contests. (B) Commercial shows including all meetings, conventions or exhibitions at which charges for space are made against exhibitors. (C) Promotional theatrical exhibitions, (D) Any and all other attractions which are not clearly within some of the following definitions of other classifications or attractions. Class 11 shall include the following: (A) Exhibits, performances or functions sponsored by and for Public Schools, including recognized organizations connected with public school affairs such as faculty, student or parents of students organizations. (B) Exhibits, pexfo miances or functions of religious organizations and associations. (C) Industrial and commercial meetings (But not including such meetings, conventions or exhibitions at which charges for space are made against exhibitors, in which case the attraction shall be classified as Class 1, and shall be liable for rental at the rates herein above provided for in Class 1 attractions). (D) Charitable exhibitions including exhibitions, performances or functions, the proceeds of which will be used for charitable purposes. Charitable exhibitions as the term is here used shall include only exhi- bitions where all of the proceeds and receipts over and above the actual expense of staging the attraction are to be devoted directly to a specific and defined charitable purpose, and where the applicant for the charitable rate is itself a non- profit organization or association chartered or formed for an express and designated charitable purpose. No part of the said building shall be rented at the Class 11 schedule of rentals on the ground that it is for a charitable exhibition unless some responsible person author- ized to act and acting for the renting organization files at the time appli- cation is made for the charitable rate, a written statement signed and sworn to, stating facts showing that it complies with the foregoing requirements. Class 111 shall include amateur athletic exhibitions. Class 1V shall include the following: (A) Local meetings, assemblies and conventions for purposes of consideration of matters of civic or national interest. (S) Conventions, assemblies and meetings of a patriotic nature (but not including such meeting, conventions or exhibitions at which charges for space are made against exhibitors, in which case the attraction shall be classified as Class 1, and shall be liable for rental at the rates herein- after provided for in Class 1 attractions). To be entitled to be considered to be of this classification all such meetings, assemblies, or conventions shall be open to the public without admission charge. Class V shall include political meetings. Class Vl shall include any and all events or attractions of what- ever sort for which a building or space therein is to be rented for a period of eight days or longer or under special contracts for a certain date each month or certain other recurrent dates over a substantial period of time. SECTION 2. The following schedule of rentals shall be charged: (A) Class 1 attractions or exhibitions shall be charged and shall be liable for rent as follows: Morning - - - - - - - - - - - - $ 75.00 Matinee - - - - - - - - - - - 175.00 Night - - - - - - - - - - - - - 250.00 Rehearsal - - - - - - - - - - - 50.00 All Day - - - - - - - - - - - - 425.00 -2- (B) Class 11 attractions shall be charged and liable to pay rent at the following rates: Morning - - - - - - - - - - - - p 50.00 Matinee - - - - - - - - - - - - 115.00 Night - - - - - - - - - - - - - 150.00 Rehearsal - - - - - - - - - - - 35.00 All Day - - - - - - - - - - - - 265.00 (C) Class 111 attractions or exhibitions shall be charged Two Hundred ($200.00) per day or any part thereof. The following terms shall mean the following hours respectively: (a) "Morning" shall mean the period of 7 a.m. to 12:00 noon following. (b) "Matinee" shall mean the period of 1 p.m. to 6 p.m. following (c) "Night" shall mean the period of 7 p, m. to 12:00 midnight following. (d) "Rehearsal" shall mean a period equivalent to the performance period on such other day as is designated in the rental contract, or such other period bearing a lower rate as may be specified by the manager in the rental contract. (D) Class 1V attractions shall be charged rent herein above pro- vided for Class 11. (E) Class V meetings shall be charged the same rental as is charged for Class 1. (F) Class V1 attractions or exhibitions of whatever sort for which any of the said building or part thereof is rented for a period of eight (8) days or more shall be calculated upon the basis of the daily rental provided in the classes above listed, less a discount of ten percent (10$J. (G) All City Departments or Divisions shall be exempted from pay- ment of any rental when using Memorial Auditorium for activities of a civic nature, which are of benefit to the community as a whole, but such activity is subject to prior approval of the Park & Recreation Beard. (H) In the case of a request for the rental of Parlours or Meeting rooms, when available, the following rates shall be charged: Day rates - 3 hour period between 7 a. m. and 6p. m. - - - - - - - - - - $ 5.00 Night rates - 3 hour period between 6 p.m. and 7 a. m. ----- - - - - -- 10.00 Overtime day rate - (per hour) - - - - - - 2.50 Overtime night rate - (per hour) - - - - - 5.00 -3- SECTION 3. Restrictions on use and special provisions: (A) The use of Memorial Auditorium by any individual, firm or corporation for the purpose of selling merchandise is hereby prohibited, except that the selling of merchandise by display, exhibit or presence of the merchandise under the sponsorship of the Home Show, Retail Grocers Association, Antique Club, Art Clubs, and Associations, Charitable Organi- zations such as Y. M. C. A. and Y. W. C. A. and other similar organizations and hotel conventions, restaurant shows and activities of a similar nature shall be excepted from the provisions of the preceding sentence and shall be permitted upon the approval of the Auditorium Manager. (B) No beer or alcoholic beverages of any type shall be sold in Memorial Auditorium. (C) The Memorial Auditorium shall not be rented for the purpose of promotional dances, except when said dances are sponsored by bona fide civic organizations the proceeds of which shall be devoted to welfare or charitable purposes. (D) Verbal agreements to rent are not recognized under any circum- stances and these regulations and the rental application, after acceptance, constitute the entire rental agreement and may not be varied or altered unless done so in writing signed by authorized representatives of both parties. (E) In the case of a request for the use of any facility not covered by the approved rental fees, Park and Recreation Board will set the fee. For the purpose of determining rental fees, a certified copy of all contracts entered into by the sponsoring organization shall be submitted with the application for use of the Auditorium. (F) In any case where the services of police, guards or watchman are needed or desired incidental to the handling of a large crowd or for the protection of equipment, they shall be employed and paid by the renting organization and will be subject to the supervision of the Auditorium Manager. (G) Acting through its agents (the Auditorium Manager, the Director of Parks and Recreation, and the City Manager) , the City of Corpus Christi reserves the right to refuse to rent Memorial Auditorium or Exposition Hall to any individual or group not acting in the best interest of the public or —4— the city. (U) Utilities -- The rates of rental herein provided shall include water and all necessary utilities for heating and lighting pro- vided the aggregate cost of all such utilities including water does not exceed Twenty -Five ($25.00) per day but unless specially otherwise authorized, all constracts of rental shall require the renter to pay the amount by which utility charges may exceed the aggregate amount of Twenty -Five ($25.00) per day. SECTION 4: Special Services: Utilities, sound system, spot- lights, and other services, conveniences and accessories will not be furnished except as stated in the rental contract and for the charges herein provided. If sound system is to be used, an additional charge will be made for the use of the sound system including the services of the operator thereof at the rate of Ten Dollars (4;1O.00) for the first four hours such system is used during any one day and Eight Dollars ($8.00) for each additional four hours or fractional part thereof. If spotlight is to be used, an additional charge for the use of the spotlight, includ- ing the service of its operator will be made at the rate of Twenty -Five ($25.00) per light for each performance. All expenses for special light- ing and /or other service not herein specifically provided to be furnished to the tenant, shall be charged to and paid by the tenant as a part of the rental in addition to the other charges herein provided. SECTION 5: Rehearsal charges -- Any person, firm or corporation contracting for the renting of any of the buildings, or parts thereof, herein referred to may arrange for the use either of such buildings or part thereof or any of the other buildings herein referred to for re- hearsal purposes on other dates in advance of the date for which the building has been rented at the reduced rates herein specified provided the space desired to be used for rehearsal purposes is available and open. SECTION 6: "Moving in and out" - If the person, firm, or corporation renting any space at the rates herein specified desires the limited right of occupancy of such space on any day or days immediately prior to or immediately following the day or for which the space has been -5- rented at the full rate, for the purpose of moving equipment, etc., in and out of the premises, such extra moving in and out time shall be set out in the contract and be paid for at one -half (3p) of the regular full - time rate; provided that the Auditorium Manager shall have the right in approving special contracts for periods of eight days (8) or longer under Class V1 to permit such free periods for moving in and out not exceeding 1 day, as the Auditorium Manager sees fit. V SECTION 7; Concessions -- No person, firm, or corporation rent- ing any part of the building or parts thereof herein referred to at the rates hereby established shall acquire any right to any of the concessions but such contracts for rents shall reserve to the City and its assigns the exclusive right to operate concessions for the sale of food, drinks, etc. SECTION 8: This ordinance shall become effective from and after the date of its final passage. SECTION 9: All tenants shall hold the City harmless from any and all liabilities for any claim or claims resulting from their rental or use of the premises and,shall indemnify the City in case of any claims result- ing from their operations or occuring during their occupation of the premises and all rental contracts shall specifically include such proyigions. SECTION 10: Designating the Administrator -- The administrator in charge of Memorial Auditorium and Exposition Hall shall be the Auditorium Manager or such other person as may be assigned to the duties of administrator by the City Manager. -6- —15— 3111 Ellroy King P.
