City Manager R. Marvin Townsend City Attorney J. Bruce Aycock City Secretary Bill G. Read Mayor Jason Luby called the meeting to order in the Council Chambers of City Hall. City Secretary Read noted there was a quorum present. City Manager Townsend announced the public hearing on Application #1076-1, Ray Dault, for change of zoning from "I-2" Light Industrial District to "A-2" Apartment House District on Tract 5, Eleanor Tract Subdivision, located on the south side of Leopard Street approximately 500' east of Rhew Road. He explained that the recommendation of the Planning Commission is that the "A-2" be denied, but in lieu thereof a special permit be approved; and the Staff recommends denial. He reported that in response to notice of the public hearing, one reply had been received in favor. Chief Planner Larry Wenger described the surrounding zoning and land uses. He informed the Council that the request for change of zoning comes about as a result of enforcement; that there are presently eight rental units on the lot which the applicant wants to continue. He added that the applicant is agreeable to the special permit. There was no one in opposition. Motion by Lozano that the hearing be closed; seconded by Tipton and passed unanimously. Motion by de Ases to accept the recommendation of the Planning Commission that the "A-2" be denied but in lieu thereof a special permit be approved; seconded by Sample. and passed --with Gulley abstaining. Carter, for change of zoning from "R-2" Multiple Dwelling District to "AB" Professional Office District on Lots 18 and 19, Block 14, Belaire Park Unit 1, located at the southwest corner of Annapolis Drive and South Staples Street. He explained that the recommendation of the Planning Commission is that it be approved, but the Planning Staff believes the property should remain "R-2". He reported that in response to notice of the public hearing, two letters had been received in favor and two in opposition. Chief Planner Larry Wenger described the surrounding land uses and zoning. No one spoke in opposition. Motion by Lozano that the hearing be closed; seconded by Sample and passed unanimously. Motion by Sample to accept the recommendation of the Planning Commission that the application be approved; seconded by Lozano and passed --with Gill voting No. City Manager Townsend then presented the public hearing on Application #1076-4, Great Expectations Oil Corporation, for change of zoning from "R -1B" One - family Dwelling District, "R-2" Multiple Dwelling District and a Special Permit to "B-4" General Business District on Lots 4 through 15, Woodlawn Addition, located in the 3700 block of Leopard Street (Woodlawn Shopping Center.) He reported that both the Planning Commission and Planning Staff recommend approval; that nine letters have been received in opposition. Chief Planner Larry Wenger summarized the surrounding zoning and land uses and advised the Council that the 20% rule would be in effect on the case, requiring six affirmative votes -for passage of the ordinance. He added that the Staff recommends approval of the change of zoning since it is an existing shopping center; and explained that the owner wants to convert the vacant service station into a food franchise operation. No one spoke in opposition. Motion by Lozano that the hearing be closed; seconded by Sample and passed unanimously. Motion by Lozano to concur with the recommendation of the Planning Commission that "B-4" be approved; seconded by Tipton and passed unanimously. There being no further business at this Special Council Meeting, it was adjourned at 4:22 p.m., December 8, 1976.
