AN ORDINANCE
AUTHORIZING AND DIRECTING THE MAYOR AND CITY MANAGER, FOR
AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE
AN AGREEMENT WITH THE UNITED STATES OF AMERICA RELATING
TO THEREMOVAL AND RELOCATION OF THE BASCULE BRIDGE, A C PY
OF WHICH AGREEMENT IS ATTACHED HERETO AND MADE A PART HERE-
OF; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL-OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. THAT THE MAYOR AND CITY MANAGER ARE HEREBY AUTHORIZED
AND DIRECTED FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI TO EXECUTE AN
AGREEMENT WITH THE UNITED STATES OF AMERICA IN,;CONNECTION WITH THE REMOVAL
AND RELOCATION OF THE BASCULE BRIDGEy A COPY OF WHICH AGREEMENT IS ATTACHED
HERETO AND MADE A PART HEREOF.
SECTION 2. THE NECESSITY FOR PROVIDING FOR REMOVAL AND RELOCATION
OF THE BASCULE BRIDGE CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC
NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED AND THAT SUCH
ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY
COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST,
REQUESTING THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE
PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKEEFFECT AND BE IN FULL
FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY PASSED AND
APPROVED, THIS THE 28TH DAY OF JULY, 1954.

WHEREAS the Secretary* of the ArW has good reason to believe and does
believe that the City's bridge across the Port Aransas - Corpus Christi Water-
way at the entrance to the =Lin turning basin at Corpus Christi, Texas, is
6,, tu-ressonable obstruction to free navigation of the Port Aransas - Carpus
Cliristi Waterway because of inadequate harisontal clearance through '.he
drag span of said bridge; and
WHEREAS a public hearing was held at Corpus Christi, Texas, on
10 December 1952 ii conformity With Section 3 of the Act of Congress of
21 June 1c,*0, as amended by the Act of Congress of 16 July 1952.

WHEREAS at the said hearing the City presented, in lieu of altering
:.he ' bridge at the entrance to the wain turning basin., as alternate plan
&ich consisted in ronstructi:ng a new bridge at a location over the Channel
to Tole IALU and the removal of the existing bridge; and
WHMMI Section 13 of the Act of Congress of 21 June 1940, as amended
by the Act of Congress of 16 July 1952, provides for such relocation In
