R E S O L U T I O N
WHEREAS, THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, HAS
HERETOFORE,BY PASSAGE OF AN ORDINANCE NUMEERED 3824, DESIGNATED THAT AREA OF
SUCH CITY FROM THE BASCULE BRIDGE TO THE REEF BRIDGE AS A RECREATIONAL AREA
AND DETERMINED THAT EXCESSIVE WHISTLE BLOWING IN SUCH RCCREATIONAL AREA IS
DETRIMENTAL TO THE GENERAL WELFARE OF THE CITIZENS OF THE CITY, AND HAS AUTHOR-
IZED AND DIRECTED THE DIRECTOR OF PUBLIC S:,FETY TO DESIGNATE SUCH POINTS AND
LOCATIONS IN SUCH AREA WHERE RAILROAD WHISTLES SHOULD BE SOUNDED AND BLOWN;
AND
WHEREAS, THE DIRECTOR OF PUBLIC SAFETY OF THE CITY OF CORPUS CHRISTI
HAS CAUSED TO BE MADE SURVEYS, STUDIES, AND FINDINGS IN ACCORDANCE WITH SUCH
OROINANCE, WHICH STUDIES, SURVEYS AND FINDINGS, TOGCTHER WITH THE DETERMINATION
AND DESIGNATIONS, WERE ASCERTAINED WITH REGARD TO EXCESSIVE WHISTLE BLOWING IN
RECREATIONAL AREAS BEINGDETRIMENTAL TO THE GENERAL WELFARE BUT WITH DUE REGARD
TO THE NECESSITY OF WARNING THE PUBLIC OF THE EXISTENCE OF RAILROAD CROSSINGS;
AND
WHEREAS, SUCH RECOMMENDATION AND DESIGNATION OF SPECIFIC LOCATIONS
AND WHISTLE BLOWING IN THE NORTH BEACH RECREATIONAL AREA HAS SEEN SUB14ITTED TO
THE CITY COUNCIL, AND SUCH -RECOMMENDATION IS HEREBY DEEMED TO BE JUSTIFIED, ADE-
QUATE AND DESIRABLE:

NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT SUCH DETERMINATION AND DESIGNATIONS AS MADE BY THE
DIRECTOR OF PUBLIC SAFETY OF POINTS AND LOCATIONS AT WHICH RAILROAD WHISTLES
SHALL BE BLOWN AND SOUNDED IN THE NORTH BEACH RECREATIONAL AREA ARE HEREBY
DEEMED TO BE AND ARF APPROVED, WHICH SAID DETERMINATION AND DESIGNATIONS ARE
SET FORTH IN A COPY OF THE RECOMIlIErlDATION ATTACHED HERETO AND MADE A PART HEREOF,
AND IN ALL THINGS INCORPORATED HEREIN.
SECTION 2. THE FACT THAT THE EXCESSIVE BLOWING OF WHISTLES IN THE
NORTH BEACH RECREATIONAL AREA IS DETRIMENTAL TO THE GENERAL PUBLIC AND NECESSITATES
THE DESIGNATION OF LOCATIONS AT WHICH RAILROAD WHISTEES SHALL BE BLOWN CREATES
A PUBLIC EMERGENCY AND PUBLIC IMPERATIVE NECESSITY REQUIRING THE SUSPENSION
OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY
ON THE DATE IT IS INTRODUCED AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE
READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DE-
CLARED THAT SUCH PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST, AND HAVING
REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED, AND THAT THIS RESOLUTION BE
PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN
FULL FORCE AND EFFECT FROM AND AFTER ITSPASSAGE, IT IS ACCORDINGLY SO RESOLVED.

IN ACCORDANCE WITH THE PROVISIONSDF 0RDINAHCE NO. 38241 THE
RECOMMENDATION OF INC DIRECTOR OF PUBLIC SAFETY OF THE DESIGNATION OF LOCATIONS
IN THE NORTH BEACH RECREATIONAL AREA AT WHICH RAILROAD ENGINE WHISTLES SHALL
BE BLOWN OR SOUNDED IS AS FOLLOWS:
FOR TRAINS PROCEEDING NORTHI
1. 25 FEET SOUTH OF THE SOUTH EDGE AT
NAVIGATION SOULEVARO.
2. 50 FEET SOUTH OF THE SOUTH EDGE AT
GOLF PLACE. `
3. 100 FEET SOUTH OF THE SOUTH EDGE AT
OXFORD STREET.
FOR TRAINS PROCEEDING SOUTHS
1. 50 FEET NORTH OF THE NORTH EDGE OF
FOGG STREET.
2. 50 FEET NORTH OF THE NORTH EDGE OF
OXFORD STREET.
3. 50 FEET NORTH OF THE NORTH EDGE OF

THESE LOCATIONS ARE DETERMINED AND DESIGNATED IN VIEW OF EXCESSIVE
WHISTLE BLOWING, BEING DETRIMENTAL TO THE GENERAL WELFARE BUT WITH DUE REGARD
TO THE NECESSITY OF WARNING THE PUBLIC OF THE EXISTENCE OF RAILROAD CROSSINGS.

Texas. has heretefore, by passage of an Ordinance numbered 3824,

Corpus Christi has oamsed to be made surveys, studies, and

surveys and findings. together with the determination and de-

blowiaU !a recreational treat being detrimental to the general
welfare but with due regard to the necessity of warning the pub-
lic of the existence of railroad crossings; and
WHEREAS. Such recommendation and designation of specific
locations and whistle blowing in the North Beach Recreational
Area has beea submitted to the City Council, and such recom-
mendation is hereby deemed to be justified, adequate, and de-
sirable:
NOW, THEREFORE, BE 1T HEREBY RESOLVER BY THE CITY COUNCIL
OF THE CITY Of CORPUS CHRISTI, TEXAS,
SUCTION 1. That such determination and designations
as made by the Director of Public Safety of points and locadous
at which railroad whistles shall be blown and sounded In the
North aeach Recreational Area are hereby deemed to be and are
approved, wi.Ich said determination and designations are set
forth In a copy of the recommendation attacked hereto and made
a part hereof, and to all things incorporated herein.
SECTION 2. The tact that the excessive blowing of
whistles in the 'forth Beach Recreational Area is detrirental
to t.hc general public and ecessitates the desigoatiaa of
locations at which railroad whistles shall as blown creates
a pablio emergency and public imperative necessity repairing
the suspension of the Charter Ruic that no ordinance or re-
solution shall bt passed finally on the date it is introduced
zind that such ordinance or resolution shall be read at three
a,everal wcctings of the City Couacil, and the Mayor, having
declared xhsi such public emergency and imperative necessity
exist. and havia� raquested that sueb Charter rule be sus-
pended, and that this resolution ire passed finally on the date
of Its Introduction and taKe effect and be in full force and
