AN ORDINANCE
APPROPRIATING THE AMOUNT OF $4.917.00 OUT OF N0.
102 CURRENT FUND TO PARK DIVISION BUDGET CODE %G
FOR LAND AND BUILDING-; AND APPROPRIATING THE AMOUNT
OF $1,500.00 OUT OF NO. 108 STREET FUND TO STREET
MAINTENANCE AND CONSTRUCTION DIVISION BUDGET CODE
DI FOR STREET MAINTENANCE, SAID SUMS OF MONEY BEING
THE PROCEEDS FROM E. BIEL WHOLESALE GROCERY, INC.,
FOR THE CLOSING AND DEEDING OF A PORTION OF TENTH
STREET TO SAID E. BIEL WHOLESALE =EBY, INC.; PITD
DECLARING AN EMERGENCY.
WHEREAS, By Ordinance No. 3924, passed and approved on the 3rd
day of November, 1954, the City Manager for and on behalf of the City of
Corpus Christi, executed a deed without warranty to E. Biel Wholesale
Grocery, Inc., for a portion of Tenth Street in the City of Corpus Christi,
Nueces County, Texas, for and in consideration of the sum of $6,417.00;
and
WHEREAS, Out of the amount of $6,417.00, $4,917.00 was allocated
as reimbursement to the City for the portion of said land in which the Park
Division was interested, and $1,500.00 was allocated for the portion of
said land in which the Street Division was interested, which sums were to
be deposited in the proper funds after receipt thereof by the City:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CCRPUS CHRISTI, TEXAS:
SECTION 1. That there is hereby appropriated out of No. 102
Current Fund out of the funds received from the closing of a portion of
Tenth Street which by Ordinance No. 3924, was closed and deeded without
warranty to E. Biel Wholesale Grocery, Inc., the sum of $4,917.00 to Park
Division Budget Code %G for land and buildings.
SECTION 2. That there is hereby appropriated out of No. 108
Street Fund out of the funds received from the closing of a portion of
Tenth Street which 1by Ordinance No. 3924, was closed and deeded without
warranty to E. Biel Wholesale Grocery, Inc., the aum of $1,500.00 to
Street Maintenance and Construction Division Budget Code DI for Street
Maintenance and Construction.
SECTION 3• The necessity for transferring these funds in order
to provide for reimbursement of the Street Division and the Park Division
for their portion of said Tenth Street for the use of said divisions,
creates a public emergency and an imperative public necessity requiring

the suspension of the Charter rule that no ordinance or resolution
shall be passed finally on the date of its introduction and that
such ordinance or resolution shall be read at three several meetings
of the City Council, and the Mayor, having declared such emergency and
necessity to exist, requesting the suspension of said Charter rule and
that this ordinance be passed finally on the date of its introduction
and take effect and be in full force and effect from and after its
passage, IT IS ACCORDINGLY PASSED AND APPROVED, This the day
of November, 1954•

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE
FOREGOING OPOINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST
FOP. THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORD.NANCE
OF RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED,
AND THAT SUCH OPDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS
')F THE CITY COUNCIL; 1, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID
CHAPTER RULE OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE
IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
