HomeMy WebLinkAbout03977 ORD - 12/08/1954;v xxros�v x as:fi , - AN ORDINANCE AMENDING AN ORDINANCE BEING #3635, DATED THE 6TH A J ARV, CRDED IN VOLUME 21, PAGE .• 501 OF THE ORDINANCE AND RESOLUTION RECORDS OF THE CITY OF CORPUS CHRISTI, TEXAS, ENTITLED, "PROVIDING FOR THE ESTABLISHMENT OF A COUNCIL CF FIRE PRE- VENTION; PROVIDING OFFICERS THEREFOR; DEFINING THEIR POWERS AND DUTIES; ADOPTING A FIRE PREVENTION CODE, KNOWN AS THE FIRE PREVENTION CODE, RE0024MOD BY THE NATIONAL BOARD OF FIRE UNDERWRITERS, BEING PARTICULARLY THE 1953 EDITION THEREOF; PROVIDING PENALTIES FOR THE VIOLATION THEREOF; REGULATING THE CONVERSION OF BUILDINGS FOR THE USE OF OCCUPANCY OF NURSERIES, CONVALESCENT HOMES AND HOMES FOR THE AGED; PROHIBITING GUESTS FROM SMOKING RESULTING IN FIRE, EXPRESSLY REPEALING IN ITS ENTIRETY ORDINANCE NO. 1713, RECORDED IN VOLUME 14 AT PAGE 86 OF THE ORDI- NANCE AND RESOLUTION RECORDS OF THE CITY OF CORPUS CHRISTI; REPEALING ALL FORMER ORDINANCES OR PARTS THEREOF CONFLICTING OR INCONSISTENT WITH THE PRO- VISIONS OF THE CODE HEREBY ADOPTED; AND ESTABLISHING FIRE LIMITS; "BY ADOPTING THE AUGUST 1954 AMENDMENTS TO THE FIRE PREVENTION CODE OF 1953 WHICH SAID CODE WAS ADOPTED A1H7 INCORPORATED BY REFERENCE WITH CERTAIN SPECIFIED r'7. CCEBTIONS IN SECTION 4 OF SAID ORDINANCE #3635; PROVIDING A PENALTY; PROVIDING FOR RESPONSIBILITY FOR CORPORATION• PROVIDING A REPEALING 4USE• PRO- VIDING A SEVERANCE CLAUSE; PROVIDING FOR PUBLICATION. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance #3635, dated the 6th day of January, 1954, recorded in Volume 21, Page 501 of the Ordinance and Resolution Records of the City of Corpus Christi, Texas, is hereby amended as follows, to -wit: SECTION 2. That Section 4 of said Ordinance #3635, the title of which is set down in particularity in Section 1, is hereby amended to read as follows, to -wit: °SECTION 4• There is hereby adopted by the City Council for the purpose of prescribing regulations, govering conditions hazardous to life and property, from fire or explosion, that certain code ]mown as The Fire Prevention Code recommended by the National Board of Fire Under - writers; being particularly the 1953 edition thereof, AMENDED ORDINANCE #3635 - ,ENB:MLD - 11 -16 -54 - PAGE 2 AND THE WHOLE THEREOF SAVE AND EXCEPT SUCH PORTIONS AS ARE HEREAFTER DELETED, MODIFIED OR AMENDED (BY • - _ SECTION 5 OF THIS ORDINANCE), AS AMENDED BY THE AUGUST, 1954 AMENDMENTS TO THE FIRE PREVENTION CODE, EDITION OF 1953, OF WHICH CODE NOT LESS THEN THREE (3) COPIES HAVE BEEN, AND ARE NOW FILED IN THE OFFICE OF THE CITY SECRETARY OF THE CITY OF CORPUS CHRISTI, TEXAS, OF WHICH SAID AUGUST, 1954 AMENDMENTS TO THE FIRE PREVENTION CODE, EDITION OF 1953, NOT LESS THAN THREE (3) COPIES HAVE BEEN, AND ARE NOW FILED IN THE OFFICE OF THE CITY SECRETARY OF THE CITY OF CORPUS CHRISTI, TEXAS, AND THE SAME ARE HEREBY ADOPTED AND INCORPORATED AS FULLY AS SET OUT AT LENGTH HEREIN, AND FROM THE DATE ON WHICH THIS ORDINANCE SHALL TAKE EFFECT THE PROVISIONS THEREOF SHALL BE CONTROLLING WITHIN THE LIMITS OF THE CITY OF CORPUS CHRISTI, TEXAS." SECTION 3. ANY AND ALL PERSONS, FIRMS, PARTNERSHIPS OR CORPORATIONS WHO SHALL VIOLATE ANY OF THE PROVISIONS OF THIS ORDINANCE OR FAIL TO COMPLY THEREWITH, OR WHO SHALL VIOLATE OR FAIL TO COMPLY WITH ANY ORDER OR REGULATION MADE THEREUNDER, OR WHO SHALL BUILD IN VIOLATION OF ANY DETAILED 3TATE14ENT OF SPECIFICATIONS OR PLANS SUBMITTED AND APPROVED THEREUNDER, OR ANY CERTIFICATE OR PERMIT ISSUED THEREUNDER, SHALL SEVERALLY FOR EACH AND EVERY VIOLATION AND NONCOMPLIANCE RESPECTIVELY BE FINED IN A SUM NOT LESS THAN TEN ($10.00) DOLLARS, AND NOT TO EXCEED THE SUM OF TWO HUNDRED ($200.00) DOLLARS. THE IMPOSITION OF ONE FINE FOR ANY VIOLATION OF THIS ORDINANCE SHALL NOT EXCUSE THE VIOLATION, OR PERMIT IT TO CONTINUE; AND ALL SUCH PERSONS, FIRMS, PARTNERSHIPS OR CORPORATIONS SHALL BE REQUIRED TO CORRECT OR REMEDY r SUCH VIOLATIONS OR DEFECTS WITHIN A REASONABLE TIME; AND WHEN NOT OTHERWISE SPECIFIED, EACH TEN DAYS THAT PROHIBITED CONDITIONS ARE -2- maintained shall constitute a separate offense. The application of the above penalty sha11 not be held to prevent the enforced removal of prohibited conditions. In case a�a rporation is the violator of any provision of this ordinance, the President, vice- president, secretary, treasurer, manager or any agent or employee of such corporation shall be also severally liable for the penalties herein prescribed; provided further, that should a different punishment be prescribed in any case by state law for any offense included in this ordinance, and should the punish- ment prescribed by state law be the only punishment which can lawfully be adjudged for any such offense, then the punishment prescribed by state law shall be adjudged by the corporation court against such offender in lieu of the penalty hereinabefore provided. Sn'CTION 4. All ordinances and parts of ordinances in con- flict herewith are hereby repealed. r SECTION 5. That if any part of this ordinance is, or should be held invalid or unconstitutional for any reason, then that fact shall not invalidate the entire ordinance, but the balance thereof ®hall remain in full force and effect.
