City Manager R. Marvin Townsend City Attorney J. Bruce Aycock City Secretary Bill G. Read Mayor Pro Tem Bill Tipton called the meeting to order while Mayor Jason Luby was conducting official City business in his office. The invocation was given by Dr. W. H. Colson, Director of Missions for the Corpus Christi Baptist Association. *Mayor Luby arrived at the meeting at this time. City Secretary Bill Read called the roll of required Charter officers and stated that a quorum was present. Motion by Lozano that the Minutes of the Regular and Special Council Meetings of February 23, 1977 be approved as submitted; seconded by Tipton, and passed unanimously. Mayor Luby read and presented Dr. W. H. Colson a proclamation declaring March 16 through April 3, 1977 as "Good News '77 Week." Mayor Luby announced that he had also presented the following proclamations: "Beta Sigma Phi Week" - March 19 through 26, 1977; and "American G I Forum Week" - March 20 through 27, 1977. Councilmember Gill called the Mayor's attention to the fact that a number of members of "Spectrum", sponsored by the Human Relations Youth Forum, were present in the audience. Mayor Luby recognized Danny Terry who introduced other members of "Spectrum" who had been elected during a meeting of their organization to emulate the Mayor, Councilmembers and the City Manager in connection with their study of Municipal Government. Minutes Regular Council Meeting March 16, 1977 Page 3 the City Manager's office,presented a report on the services to be provided by Senate Bill 89, stating that the Bill would give the Executive Director of the Texas Department of Community Affairs the authority to coordinate drug treat- ment and rehabilitation programs through existing public and private agencies. Mr. Basile also explained the methods to be used in referrals of persons who are dependent on drugs to treatment and rehabilitation centers and stated that treatment records are to remain confidential and cannot be used in any criminal proceeding against the patient except with certain stipulations. Councilmember Sample inquired about the purpose of the bill and how it would differ from the agencies and treatment facilities now in existence. City Manager Townsend stated that the passage of this Bill would better organize the programs; that it would be supplemental to the programs being conducted by MH -MR but would not replace any of the existing local programs; and pointed out to the Council that the amount of the appropriation is not included in the Bill and that funds would be provided by a separate action by the State Legislature. After further discussion, City Manager Townsend withdrew Item "f" from consideration for approval by the Council until Councilmembers had had an oppor- tunity to review it. It was also suggested that the City Staff contact our area Legislators to obtain their opinion of the Bill and also provide a report from the local police officials in regard to their opinion of the Bill. Council - member Gulley also requested City Manager Townsend to attempt to ascertain the approximate amount of funds that may be appropriated by the State for implemen- tation of the programs proposed by the Bill. City Manager Townsend next presented the ordinances. There were no questions from the Council in regard to the ordinances. Mayor Luby inquired if anyone in the audience had any questions in regard to the ordinances. Mrs. Margaret Walberg, 336 Montclair, spoke at this time in regard to the third reading of the ordinance establishing a policy to allocate certain funds for art in public building construction projects. Mrs. Walberg, speaking on behalf of the Municipal Arts Commission, expressed their appreciation to this Council as being the first Council to display an interest in placing art in public buildings. Minutes Regular Council Meeting March 16, 1977 Page 4 There being no further discussion pertaining to the ordinances, City Secretary Read polled the Council for their vote. The following ordinances were approved by the Council: FIRST READING: AMENDING THE CODE OF ORDINANCES, CITY OF CORPUS CHRISTI, 1976 REVISION, BY AMENDING SECTION 53-250, SCHEDULE I, "ONE-WAY STREETS AND ALLEYS", BY ADDING ITEMS THERETO AS MORE FULLY DESCRIBED HEREINAFTER; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING SEVERABILITY; PROVIDING FOR PUBLICATION; AND PRO- VIDING AN EFFECTIVE DATE. The foregoing ordinance was read for the first time and passed to its second reading by the following vote: Luby, Tipton, de Ases, Gill,Gulley, Lozano and Sample voting "Aye". THIRD READING - ORDINANCE NO. 13698: ESTABLISHING THE POLICY TO ALLOCATE CERTAIN FUNDS FOR ART IN PUBLIC BUILDING CONSTRUCTION PROJECTS. The foregoing ordinance was read for the third time and passed finally by the following vote: Luby, Tipton, de Ases, Gill, Gulley, Lozano and Sample voting "Aye". Mayor Luby then inquired if there were any petitions or discussion items from members of the audience. Mrs. J. Arthur Ellis, 10935 Leopard, spoke at this time and wished all of the Councilmembers a "Happy St. Patrick's Day", presenting to them a replica of a Blarney stone and leprechaun. City Manager Townsend then presented the following Resolution for con- sideration by the Council: RESOLUTION NO. 13699: EXPRESSING THE SUPPORT OF THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI FOR PASSAGE OF HOUSE BILL NUMBER 1 OR SIMILAR LEGISLATION; INSTRUCTING THE CITY SECRETARY TO FORWARD A TRUE COPY OF THIS RESOLUTION TO SENATOR CARLOS TRUAN, THE CHAIRMAN AND MEMBERS OF THE SENATE COMMITTEE ON ECONOMIC DEVELOPMENT, GOVERNOR DOLPH BRISCOE, AND LIEUTENANT GOVERNOR WILLIAM P. HOBBY; AND DECLAR- ING AN EMERGENCY. The Charter Rule was suspended and the foregoing ordinance was passed by the following vote: Luby, Tipton, de Ases, Gill, Gulley, Lozano and Sample voting "Aye". City Manager Townsend reminded the Council of the Consortium Executive Committee meeting on Thursday, March 17, 1977, at the Corpus Christi National Bank Assembly Room at 1:30 p.m. Minutes Regular Council Meeting March 16, 1977 Page 5 City Manager Townsend stated that there are several items to be discussed in connection with the Consortium meeting. Mr. Ernest Briones, Director of Planning and Urban Development, explained the matters to be considered. Mr. Briones stated that there is a need to appoint a Youth Advisory Council; men- tioned that approximately $20,000 is available for the Summer Youth Program; and indicated that there will be a discussion of the Governor's Office of Migrant Affairs program. City Manager Townsend then gave a status report on Choke Canyon. He stated that President Jimmy Carter had removed 19 water projects with no appro- priations from the list of previously approved projects. Choke Canyon was not included in this list but is included in another list of projects on which President Carter has requested a re -study. Mr. Townsend indicated that there is no problem on Choke Canyon except for the Section 404 permit and reiterated that Choke Canyon has the support of all of the legislators and all involved departments, except for the Fish and Wildlife Department. He informed the Council that he had met with Mr. Tom Olds, Deputy Associate Director -Environment, of the Fish and Wildlife Department, who will provide the City with a status report soon. Motion by Gulley to go into closed session under authority of Article 6252-17, Paragraph 2(e), as stipulated by City Attorney Bruce Aycock, to discuss pending litigation; seconded by Lozano, and passed unanimously.' The Council then went into closed session at 3:35 p.m. There being no further business to come before the Council following the closed session, on motion by Gulley, seconded by Tipton, and passed unani- mously, the meeting was adjourned at 4:07 p.m., March 16, 1977.
