APPROPRIATING FROM NO. 202 CITY OF CORPUS CHRISTI

STAPLES STREET,,BEING $307,207.83 FOR CONTRACTOR'S �i �.•
SERVICES AND $3,900.00 FOR CONTINGENCIES; AUTHORIZING
AND DIRECTING THE CITY MANAGER TO E)MCUTE FOR AND ON
BEHALF OF THE CITY A,CONTRACT WITH BRODIE CONSTRUCTION
COMPANY FOR CONSTRUCTION WORK ON SAID PROJECT, IN AC-
CORDANCE.WPTH PLANS AND SPECIFICATIONS AND CONTRACT
DOCUMENTS MADE A PART HEREOF BY REFERENCE; AND DECLARING
AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TE MS:
SECTION 1. That there is hereby appropriated from No. 202 City
of Corpus Christi Waterworks System Construction Fund the sum of $310,207.83 for the
construction of the project designated as Unit II of Lexington Boulevard Water Distri-
bution Main from Chapman Ranch Road to South Staples Street, being 07.
$307,283 for
contractor's services and,$3,000.00 for contingencies.
SECTION 2. That the City Manager of the City of Corpus Christi,
for and on behalf of the City of Corpus Christi, be and he is authorized hereby and
directed to execute a contract with Brodie Construction Company for the construction work
on this project, in accordance with plans and specifications and contract documents,
made a part hereof by reference, all of which are on file in the office of the City
Secretary.

SECTION 3• That the unexpended balance,of aforesaid,$3,000.00 ap-
propriation for contingencies,on April 302 1955, shall revert to the fund for which
it was appropriated, and further provided that no funds shall be paid out of the con-
tingency fund hereby appropriated, except with the approval of the City Council on
motion passed by a majority of the Council.
SECTION 4. That the necessity for the construction of-Unit II of
Lexington Boulevard Water Distribution Main creates a public emergency and an imperative
public necessity requiring the suspension of the Charter rule that no ordinance or reso-
lution shall be passed finally on the date it is introduced and that such ordinance or
resolution shall be read at three several meetings of the City Council, and the Mayor,
having declared such emergency and necessity to exist, requesting the suspension of
said Charter rule and that this ordinance be passed finally on the date of its intro-
duction and take effect and be in full force and effect from and after its passage,

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING'
ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN-
SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT 15 INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE
HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS
THIS ORDINANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING
OF THE CITY COUNCIL.

the contract, agreement➢ obligation, or expenditure contemplated ix
the above and foregoing Ordinance is in the Treasury of the City of
Corpus Christi to the credit of No. -20 z
Fund from which it is proposed to be drawn, and such money is not
appropriated for any other purpose.
