SAN ORDINANCE , APPROPRIATING FROM NO. 202 CITY OF CORPUS CHRISTI .,, „MS., „.,..,,,..,;..,,..• 19ATERWORKS,SYS224 CONSTRUCTION FUND THE SUM OF__ ,.--,...,,, .,�,..,.,.,�..,.»,.........,.. ,.., ...............,... r .�„_, $890,541.00 FOR THE CONSTRUCTION OF THE PROJECT DESIGNATED AS 48” WATER MAIN FROM THE EXISTING 48" MAIN IN THE VICINITY OF CLARKWOOD, TEXAS, TO A CONNECTION WITH A 36" MAIN IN SAVAGE LANE iu CORPUS CHRISTI, TEXAS, BEING $885,541.00 FOR CONTRACTOR'S SERVICES AND $5s000•ED FOR CONTIN- GENCIES; AUTHORIZING APED DIRECTING THE CITY MANAGER TO EXECUTE FOR AND ON BEHALF OF THE CITY A CONTRACT WITH BRODIE CONSTRUCTION COMPANY FOR CONSTRUCTION WORK ON SAID PROJECT, IN ACCORDANCE WITH PLANS AND SPECIFI- CATIONS AMID CONTRACT DOCUMENTS MADE A PART HEREOF BY BEMMCE; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby appropriated from No. 202 City of Corpus Christi Waterworks System Construction Fund the sum of $890,541.00 for the construction of the project designated as 48" Water Main from the existing 48" Main in the vicinity of Clarkwood, Texas, to a connection with a 36" Main in Savage Lane in Corpus Christi, Texas, being $885,541.00 for contractor's services and $5,000.00 for contingencies. SECTION 2. That the unexpended balance of aforesaid $5,000.00 ap- propriation for contingencies on April 30, 19551 shall revert to the fund for which it was appropriated, and further provided that no funds shall be paid out of the contingency fund hereby appropriated, except with the approval of the-City Council on motion passed by a majority of the Council. ' SECTION 3• That the City Manager of the City of Corpus Christi, for and on behalf of the City of Corpus Christi, be and he,is authorized hereby and directed to execute a contract with Brodie Construction Company for the construction work on this project, in accordance with pleas and specifications and contract documents, made a part hereof by reference, all of which are on file in the office of the City Secretary. SECTION 4. The necessity for the construction of the 48" Water Main from the existing 48" Main in Savage Lane in Corpus Christi, Texas, creates a public emer- gency and an imperative public necessity requiring the suspension of the Charter rule that nc ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution sball be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, requesting the sus- pension of said Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, 1T IS ACCORDIIIOLY PASSED AM APPROVED, this the 196��y of January, 1955• Qc MAYOR CITY OF CORPUS CHRISTI, TEAS ATTEST: City Secretary APPROVED AS TO LEGAL FORM: rl9City Attorney CORPUS RISTI, TEXAS a� 1955 TO THE MEMBERS OF THE CITY COUNCIL CORPUS CHRISTI TEXAS GENTLEMEN; FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING OROINANCE� A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN- SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; 11 THEREFORE; HEREBY REQUEST THAT YOU SUSPEND SAID'CHARTER RULE OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRODUCED OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
