DECLARING AN FMERGENCY .
WHEREAB, certain improvements have been determined to be necessary;
and
WHEREAB, there are sufficient funds available and unappropriated
in No. 295 Storm Sewer Bond Improvement Fund to cover the cost of said improvements;
ands
WHERM, bids have been received considered] and six award made
for the lowest and most advantageous bid to the City of Corpus Christi, Texas, and it
is now necessary to authorize the execution of a contract and to 3mike such appropriation;
NOW, THEREFORE, BE IT OM= MD BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS; .
SECTION 1. That the City Manager is hereby authorized and
directed to execute for and on behalf of the City of Corpus Christi a contract with
Heldenfels Brothers for the construction of Storm Sewer Improvements on Santa Fey Ropes
_ Rossiter, Sinclair and South Staples Streets by the construction of concrete pipe storm
sewers and appurtenant structures as set out in plans and specifications, which contract
'has been awarded in accordance with plans, specifications and contract documents on
file in the office of the City Secretary, all of which are made a part hereof byt
reference and according to the bid of Heldenfels Brothers opened on the 19th day of
January, 1955, the said bid of Heldenfels Brothers being the lowest and most advanta.
geous to the City of Corpus Christie Texas.
SECTION 2. That there is hereby, appropriated out of No. 295
Storm Sewer Bond Iapprovemeut Fnnd the sum of $181,745.31, out of which sum there is to
be paid. according to the terms of the contract described in Section 1 hereof, the sum
of $179,745.31 to cover contract construction cost and the balance of $2,000.00 to
cover the amount of contingency cost of said project.

provided that no funds stall be paid out of the funds hereby appropriateds except with
the approval of the City Council on motion passed by a majority of the Council.

be suspended and that this ordinance be passed finally on the date it is introduced

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING -
ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN-
SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; II THEREFORE,
HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS
THIS ORDINANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING
OF THE CITY COUNCIL.
