AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER TO
EXECUTE AN ACCEPTANCE FOR AND ON BEHALF OF THE
CITY OF THE TERMS AND CONDITIONS SET FORTH IN
THE PROPOSAL OF THE TEXAS AND NEW ORLEANS RAIL-
ROAD COMPANY. DATED JANUARY 27, 1955, A COPY OF
WHICH IS ATTACHED HERETO AND MADE A PART HEREOF;
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. THAT THE CITY MANAGER FOR AND ON BEHALF OF THE CITY
OF CORPUS CHRISTI, BE AND HE IS HEREBY AUTHORIZED AND DIRECTED TO
EXECUTE THE ACCEPTANCE OF THE TERMS AND CONDITIONS SET FORTH IN THE
COMMUNICATIONS DATED JANUARY 27, 1955, FROM THE TEXAS AND NEW ORLEANS
RAILROAD COMPANY,A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART
HEREOF.
SECTION 2. THAT THE NECESSITY FOR COOPERATING WITH THE COUNTY
• OF NUECES AND THE TEXAS AND NEW ORLEANS RAILROAD COMPANY IN THE PRO-
VIDING OF RIGHT -OF -HAY FOR THE LOCATION OF THE HIGH LEVEL VEHICULAR
CHANNEL CROSSING BRIDGE CREATES A' PUBLIC EMERGENCY AND AN IMPERATIVE
PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE PROVIDING
THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF
ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT
THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DE-
CLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION
OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE
DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE TAKE EFFECT AND BE IN
FULL FORCE AND EFFECT FROM AND AFTER IT ASSAGE, IT IS ACCORDINGLY PASSED
AND APPROVED. THIS THE DAY OF . 1955.

At meeting held in Corpus Christi on Wednesday, January 5,
to consider problem of possible relocation of some of this com-
pany's facilities in Corpus Christi in order to make right of
way available for Texas Highway Popartment's proposed high -level
bridge project; the following tentative items of agreement were
reacheds
(1) That the local interests and the Railroad Com-
pany, subject to approval of their respective councils,
commissions and boards of directors, agree that there is
a basis for exchange of properties so am to permit eventual
acquisition by the County of what is now railroad property
on North'Broadway,'for use in the construction of a high -
level highway bridge over the Corpus Christi ship channel.
(2) That the properties to be exchanged to the Rail-
road Company will.•be improved by means of installation of
utilities, including water lines, sanitary sewers, storm
sewers, gas lines and electric lines, so as to make them
in every way comparable to property to be released by the
Railroad.
(3) A system of vehicular roadways will be installed
for the purpose of providing easy access.for the newly de-
veloped area to the Corpus Christi downtown street pattern
as well as the traffic interchange at the south and of the
new highway bridge.
(A) That all improvements now located on railroad
property to be exchanged will be either replaced or relo-
cated to the satisfaction of the Railroad Company or
Its tenants as their respective interests appear.

(5) That the cost of all track changes necessary in
connection with the overall project will be borne by the
political subdivision properly responsible for such costs.
(6) That all adjustments or relocation of trackage,
Improvements or other facilities will be undertaken so as
not to interfere with the normal operation of the Railroad
Company or its tenants or patrons.
(7) That both parties will proceed in a cooperative
manner to effect this exchange as expeditiously as possible.
The purpose of this letter is to confirm to'you that the
above memorandum is sotiefactory to the Texas and New Orleans
Railroad Company and to offer you our cooperation in carrying
out the principles outlined therein.
This letter is being furnished to you in triplicate and if
it meets with your approval, will each of you pleose sign all
three copies in the apace indicated for your signature as duly
authorised representatives of the City of Corpus Christi and
the County of Nueces, retain ono copy for each of your respective
files, and return one to me for the Railroad Company's records?

BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; 1, THEREFORE,
HEREBY REQUEST THAT YOU SUSPEND SAID-CHARTER RULE OR REQUIREMENT AND PASS
THIS ORDINANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING
OF THE CITY COUNCIL.
