AN CRDINANCE
APPROPRIATING THE SUM OF $5,013,22 FROM THE
UNAPPROPRIATED FUND BALANCE CF NO. 141 WATER
MAINTENANCE AND OPERATIONS FUND FOR THE PUR-
POSE OF PAYING THE ATTOR1EYS1 FEES OF KEYS,
RUSSELL, KEYS AND WATSON, ATTMMS FOR SERPICES
AND EIMSES RENDERED IN THE PROCEEDINGS IN THE
CAUSE OF A. W. GREGG VS. CITY CF CORPUS CHRISTI;
AND DECLARING AN E14MGENCY.
WHEREAS, The City has by contract employed the firm of
attorneys of Keys, Russell, Keys and Watson to represent the City
in the cause of A. W. Gregg vs. the City of Corpus Christi concern-
ing the validity of certain oil, gas and mineral leases relating
to property of the Corpus Christi Water Works System; and
WHEREAS, a portion of said fees are due said attorneys
for services through the Court of Civil Appeals in said proceeding
in the amount of $5,000.00, and incidental expenses in the amount
of $13.22.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF OHMS CHRISTI, TESASS
SECTION I. That the amount of ;5,013.22 is hereby
appropriated from the unappropriated fund balance of No. 141 Water
Maintenance and Operations Fund to pay the attorneyst fees and
expenses now due Keys, Russell, Keys and Watson for services rendered
in accordance with our contract, being $5,000.00 attorneys fees and
$13.22 incidental expenses.
SECTION 2. That the necessity foir making payment in
accordance with the contract between the City and said attorneys
creates a publio emergency and an imperative public necessity re-
quiring the suspension of the Charter role or requirement that no
.ordinance or resolution shall be passed finally on the date it is
introduced, and that such ordinance or resolution ahall be read
at three several meetings of the City Council, and the Mayor,
having declared such emergency and necessity to exist, having
requested the suspension of said Charter rule and that this
ordinance be passed finally on the date of its introduction and

THAT SUCH ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT
FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY PASSED AND APPROVED
THIS THE 9y DAY OF FEBRUARY, 1955.

GENTLEMEN:
FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING -
SORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN-
SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; 11 THEREFORE,
HEREBY REQUEST THAT YOU SUSPEND SAID-CHARTER RULE OR REQUIREMENT AND PASS
THIS ORDINANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING
OF THE CITY COUNCIL.
