On this the day of April, 1955 the City Council

Of the City of Corpus Christi, Texas, convened in , meeting,
with the following members of said Council present, to -kYt:

I. M. Singer, City Attorney,
with the following absent: i(h—y constituting a.
quorum, at which time the following among other business was transacted:
Mr. Farrell D. Smith, Mayor, presented for the consideration
of the Council an ordinance. The ordinance was read by the City Secretary.
The Mayor presented to the Council a communication in writing pertaining to
said proposed ordinance, as follows:

TO THE CITY COUNCIL,
Corpus Christi, Texas.
Gentlemen:
The public importance and pressing need for the permanent j
improvements to be constructed by use of the proceeds of the bonds contem- i
plated to be voted pursuant to said ordinance create an emergency and an im-
perative public necessity requiring the suspension of rules and Charter pro-
visions requiring ordinances to be considered and voted upon at three regular
meetings. I, therefore, request that the City Council pass the proposed
ordinance calling an election for the issuance of said bonds as an emergency
measure. You will please consider this request in connection with the
ordinance which has been introduced in the City Council on this subject.

Commissioner made a motion that the
Charter provision prohibiting ordinances from being passed finally on the
date introduced be suspended for the reasons stated in the written request
of the Mayor and stated in the eme en cla a of the ordinance. The motion

was seconded by Commissioner. The motion was carried by a
unanimous vote by the City Council, viz:
AYES: Commissioners Culli, Roberts, Bigler and
Maldonado.
NOES: None.
The Mayor requested that the records show that he voted

The ordinance is as follows:
ORDINANCE NO.®
BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS, CALLING AN ELECTION ON THE
QUESTION OF THE ISSUANCE OF 700,000.00
BRIDGE BONDS AND DECLARING AN EMERGENCY.
WHEREAS, due to to vehicular traffic conjestion resulting

from the Bascule bridge across the ship channel it has been determined that
such bridge should be removed and relocated; and
WHEREAS, the total cost of such removal and relocation is
to be borne jointly by the City, Nueces County, the Nueces County Navigation
District and the Federal Government (uner the Truman -Hobbs Act); and

WHEREAS, it has been determined that the City's part of
the cost of such removal and relocation amounts to $700,000.00 and the City
Council deems it necessary that bonds be issued to provide its funds for such
purpose;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
1. That an election be held in said City of Corpus
Christi, Texas, on the 21st day of May, 1955, at which election the follow-
ing proposition shall be submitted to the resident, qualified electors of the
City of Corpus Christi, Texas,who own taxable property in said City and who
have duly rendered the same for taxation:
"Shall the City Council of the City of Corpus
Christi, Texas, be authorized to issue the bonds of said
City in the amount of $700,000.00, maturing serially in
such installments as the City Counci} may prescribe, the
maximum maturity being not more than Thirty (30) years
from their date, bearing interest at a rate not to exceed
Four (4 %) per cent per annum, and to levy a tax on all tax-
able property within said City sufficient to pay the annual
interest and provide a sinking fund to pay the bonds at
maturity, for the purpose of providing funds to remove and
relocate the Bascule Bridge."
2. That voting machines shall be employed at the election
herein ordered in accordance with the provisions of V. A. T. S. Election Code,
Article 7.14, and said election shall be held at the polling places in the
regularly prescribed voting precincts of the City of Corpus Christi, such

3. That said election shall be held in accordance with
the provisions of Chapter 11 Title 22 of the Revised Civil Statutes of Texas,
1925, as amended, including the provisions of Article 704, as amended by
Chapter 382, passed at the First Called Session of the 44th Legislature, and
the City Charter of the City of Corpus Christi, Texas, and only legally
qualified electors who own taxable property in the City and who have duly
rendered the same for taxation shall be qualified to vote.
4. The ballots for said election shall have written or
printed thereon the following:
"FOR THE ISSUANCE OFBRIDGE BONDS"
"AGAINST THE ISSUANCE OF BRIDGE BONDS"
5. A substantial copy of this ordinance signed by the
Mayor of said City and attested by the City Secretary shall serve as proper
notice of said election. Notice shall be given in accordance with Article
704, Revised Civil Statutes of 1925, as amended. The Mayor is authorized and
directed to have a copy of said notice posted at the City Hall in said City
and at each of the voting places in said City, not less than fifteen days
prior to the date fixed for holding said election. He shall also cause said
notice to be published on the same day in each of two successive weeks in a
newspaper of general circulation published within said City, the date of the
first publication to be not less than fourteen days prior to the date set for
said election. Except as otherwise provided in said Article 704, as amended,
the manner of holding said election shall be governed by the laws governing
general elections.
6. That the public importance and the pressingneed for
the removal and relocation of the Bascule Bridge create an emergency and an
imperative public necessity requiring the suspension of rules and Charter
provisions requiring same to be considered and voted upon at three regular
meetings, and such facts require that this ordinance be passed and take effect
immediately as an emergency measure, and such rules and provisions are hereby
suspended and this ordinance is passed and shall take effect as an emergency
measure, and shall be in full force and effect immediately upon its passage.

ORDINANCE, A PUBLIC. EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN-
SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE,
HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS
THIS ORDINANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING
OF THE CITY COUNCIL.
