AN ORDINANCE RECEIVING AND ACCEPTING THE WORK OF REHABILI- TATION OF GAR MAINS IN THE LEOPARD -HILL AREA, BEING DESIGNATED AS "PROJECT PUG -9`', PERFORMED BY PETTY CONSTRUCTION COMPANY, UNDER 'CONTRACT DATED OCTOBER 6, 1954, As AUTHORIzED BY.ORDI- NANCE NO. 3899; AUTHORIZING PAYMENT OF FINAL ESTIMA.TE,- A_6DPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF- DATED APRIL 25, 195 -5, IN THE AMOUNT OF $11,406.64, THE ixma a DUE ON A TOTAL PAYMENT OF $105,275.90 ON A TOTAL CONTRACT PRICE OF $107,701.50., TO BE PAID OUT 01, 200 GAS, SYSTEM BOND 'IMPROVEMENT FUND IN ACCORDANCE WITH THE APPROPRIATION ORDINANCE) AND DECLARING AN M91RGENCY BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS. CHRISTI, SECTION 1. That the work of rehabilitation of Gas Mains in the Leopard -Hill area performed by Petty Oonstraction Company under their contract with the City, having been performed and completed in accordance with the terms and provisions of the contract and the plans and specifications therein contained, said contract having been entered into on the 6th day of October, 1954, as authori- zed by Ordinance No. 3899, and the Director of Public Works having inspected the same and certified to the completion of said work in accordance with said plans and specifications, and said work aforesaid is hereby found to have been completed in accordance with the plans and specifications and is here now accepted and received by the City Council of the City of Corpus Christi, Texas. SECTION 2. That final payment due under the contract and as set out in the final estimate attached hereto and made a part hereof, prepared by the Director of Public Works, dated April 25, 1955, in the sum of $11,406.64, the balance due on a total payable of $105,275.90 on a total contract price of $107,701.50, be paid from-No. 200 Gas System Bond Improvement Fund in accordance with the.appropriation ordinance. SECTION 3. That,the necessity for completion of such project by said acceptance and final payment immediately creates a public emergency and an imperative public necessity requiring the suspension of the Charter Rule providing that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, requesting that such Charter rule be suspended and that this ordinance be passed fins Uy on the date of its introduction and take effect,and be in full force and effect from and after its passage, IT IS AqqORDINGLY S0 0 PASSED AND APPROVED, this theday of A. A DIRE670R OF FINANCE CORPUS CHRISTI, TEXAS April 25� o(, 1955 TO THE MEMBERS OF THE CITY COUNCIL CORPUS CHRISTI, TEXAS GENTLEMEN: FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN- SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
