CREATING THE OFFICE OF THE REGISTRAR OF VITAL STA-
TISTICS OF THE CITY OF CORPUS CHRISTI; FI%ING THE
TERM AND ENUMERATING THE DUTIES OF SUCH OFFICER;
PROVIDING FOR APPOINTMENT; PROVIDIIG FOR THE REG-
ISTRATION OF BIRTHS, DEATHS, AND FETAL DEATHS WITH-
IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS;
PROVIDING PENALTY FOR VIOLATIONS; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH AND SPECIFICALLY
REFEALIM ORDINANCE M. 3476 AS AMENDED; PROVIDING
A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION.
WHEREAS, the Legislature of Texas, at its 52nd Regular Session in 1951,
amended Rule 53a, Article 4477 of the Revised Civil Statutes of Texas, so as to
exempt cities having an ordinance requiring that true and accurate copies of birth,
death, and fetal death certificates be permanently filed in the office of the City
Registrar; and
WHEREAS, it is necessary to provide for the office of Registrar of Vital
Statistics of the City of Corpus Christi and provide for the appointment of such
officer;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. There is hereby created the Division of Vital Statistics,
which,shall be under the direction of the Registrar of Vital Statistics, which
officer shall be appointed by the Texas State Board of Health upon a recommender
tion of the Mayor made with the approval of the City Council and who shall serve
with such salary as may be provided by the City Council.
SECTION 2. The Registrar of Vital Statistics is hereby designated,
authorized and directed to act as Registrar of births, deaths, and fetal deaths,
including the amendment and certification of such records, and such other duties
as prescribed by Rules 34a-55a, Article 4477 of the Revised Civil Statutes of
Texas, as amended, and the regulations promulgated by the Texas State Department
of Health, and the Registrar or his deputy, as hereinafter provided, shall per-
form the duties as required, and shall secure a complete record of each birth,
death, and fetal death that occurs within the corporate limits of the City of
Corpus Christi.
SECTION 3. The Mayor and the City Council of the City of Corpus Christi
shall furnish the Registrar of Vital Statistics, in his capacity as Registrar, with
the necessary funds and such clerical assistance as may be necessary to maintain an

adequate Division of Vital Statistics, and to enable said Registrar to secure com-
plete records, and shall provide for the safe preservation of such birth, death,
and fetal death records, and their respective amendments.
SECTION 4. Certificates of all births, deaths, and fetal deaths occurring
within the City of Corpus Christi shall be filed with the Registrar of Vital Sts -
tistica in strict compliance with the provisions of Rules 34a - 55a, Article "77,
Revised Civil Statutes of Texas, as amended, and the regulations of the Texas State
Department of Health.
SECTION 5. The Registrar of Vital Statistics shall permanently preserve
in his office true and accurate copies of each certificate of birth, death, and
fetal death occurring within the City of Corpus Christi.
SECTION 6. In the transportation and disposition of dead human bodies,
as well as the disinterment and the reinterment of dead human bodies, the funeral
director shall strictly conform to the statutory provisions and the regulations of
the Texas State Department of Health relating to these subjects.
SECTION 7. The Registrar of Vital Statistics shall complete, correct and
arrange in chronological order the original birth, death and fetal death certifi-
cates and shall forward them to the State Bureau of Vital Statistics.
SECTION 8. The Registrar of Vital Statistics shall index all records of
births, deaths, and fetal deaths and their respective amendments, and shall tabu-
late the data contained in such records, and shall make a monthly report to the
City Council in such form as may be required by that body.
SECTION 9. The Registrar of Vital Statistics may issue to a properly
qualified applicant upon the payment of a fee of Fifty Cents ($0.50), a certified
copy of a birth, death, or fetal death certificate filed in his office, provided
that the restrictions contained in Rule 47a, Article 4477, Revised Civil Statutes,
as amended, shall be observed in the issuance of such copies. All fees collected
by the Registrar of Vital Statistics for the issuance of certified copies of records
of births, deaths, and fetal deaths shall be deposited with the City Treasurer.
SECTION 10. The Registrar of Vital Statistics and /or the Deputy Registrar
of Vital Statistics shall make application for and obtain appointment as a Notary
Public in accordance with the laws of the State of Texas, providing that the costs
of filing for such appointment shall be paid by the City. Notary fees as prescribed
by Statutes of the State of Texas shall be charged for notarising documents, papers,
statements and certifications as required in the conduct of the Vital Statistics
Division. Full and complete records shall be kept of said fees received and the
salary, as established by the City Council, of the Registrar of Vital Statistics
and /or the Deputy Registrar of Vital Statistics who shall be appointed as Notary
Public shall be reduced by the total amount of said fees, provided that the
Registrar of Vital Statistics and /or the Deputy Registrar of Vital Statistics who
shall be appointed Notary Public may elect to pay all Notary fees into the City
Treasury and receive the full salary established by the Council.
SECTION 11. The said Registrar of Vital Statistics shall designate
some person as Deputy - Registrar of Vital Statistics, whose duty it shall be to
act for said Registrar of Vital Statistics in his absence, to the end that at all
times a Registrar may be available for the registration of births, deaths and fetal
deaths, and all reports made to the State Bureau of Vital Statistics shall be under
the signature of the Registrar of Vital Statistics.
SECTION 12. Any person who violates any section of this ordinance, Rules
34a - 55a, Article 4.477, of the Revised Civil Statutes of Teas, as amended, Article
781a of the Penal Code, or regulations as promulgated by the Texas State Department
of Health, or any person required by the said ordinance, statutes or regulations to
perform any act who fails or refuses to do so, or, shall furnish false information
affecting any certificate or record so required under said ordinance, statutes or
regulations shall for the first offense be fined not less than Five Dollars ($5.00)
nor more than Fifty Dollars ($50.00), and for each subsequent offense not less than
Ten Dollars ($10.00) nor more than One Hundred Dollars ($100.00), or be imprisoned
in the County jail.not more than sixty days or be both fined and imprisoned.
The Registrar of Vital Statistics shall immediately report to the City
Attorney any apparent violation of the said ordinance, statutes or regulations
brought to his attention, and the City Attorney shall immediately follow such cases
with the necessary court procedure, to the end that every birth, death and fetal
death shall be registered and recorded in full compliance with the existing laws
and regulations, in order to promote and further the compilation and maintenance of
true and complete Vital Statistics records concerning such births, deaths and fetal
deaths.
SECTION 13. If any section, paragraph, subdivision, clause, phrase or
provision of this Ordinance shall be adjudged invalid or held unconstitutional,
the same shall not affect the validity of this Ordinance as a whole or any part
or provision thereof other than the part so decided to be invalid or unconatitu-
tional.
SECTION 14. Ordinance No. 3476, as amended, is herewith specifically
repealed; and, all other ordinances or parts of ordinances in conflict herewith are
hereby repealed.
SECTION 15. This being an ordinance providing for a penalty in case of
its violation, the same shall be published by publishing its caption or title stat-
ing its purpose and the penalties for violation thereof as set forth in Section 10
hereof, said publication to be QK&C in the official newspaper of the City; and
this ordinance shall be in full force and effect from and after its publi-
cation.

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING
ORDINANCE, A PUBLIC EMERGENCY AND IMPERATtVE NECESSITY EXIST FOR THE SUSPEN-
SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCILS I, THEREFORE,
HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS
THIS ORDINANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING
OF THE CITY COUNCIL.
