OUT OF FUNDS BERk°IOFORE APPROPRIATED ON ANCE OF A TOTAL DUE (ON CONTRACT IN THE ORIGINAL AMOUNT OF $165,834.00) OF $ 172,838.003 AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS. CHRISTI, SECTION 1. That the work of construction of Utilities Building south of the City Hall in the City of Corpus Christi, Nueces County, Texas, performed by Braselton Construction Company under their contract with the City, having been performed and completed in accordance with the terms and provisions of the contract and the plans and specifications therein contained, said contract having been entered into on the 1st day of September, 1954, as authorized by Ordinance No. 3862, and the Director of Public Works having inspected the same and certified to the completion of said work in accordance with said plans and specifications, and said work aforesaid is hereby found to have been completed in accordance with the plans and specifications and is here now accepted and received by the City Council of the City of Corpus Christi, Texas. SECTION 2. That final payment of $22,444.85 out of fluids hereto- fore appropriated, due on the contract (fin the original amount of $165,834.00), of $172,838.00, as set out in the final estimate attached hereto and made a part hereof, prepared by the Director of Public Works, dated May 4, 1955, to be paid from. No. 298 Waterworks Bond Construction Fund, 1953 Bond Issue, in accordance with the appropriation ordinances. SECTION 3• That the necessity for completion of such project by said acceptance and final payment creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule providing.that no ordinance or resolution shall be passed finally on the date it is introduced and that such Ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, requesting that such Charter rate be suspended and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.
