BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the work of resurfacing of 11.4 miles of streets with hot -mix asphaltic concrete in the city of Corpus Christi, Nueces County) Texas, performed by Heldenfels Brothers under their contract with the City, having been per- formed and completed in accordance with the terms and pro':*isions of the contract and the plans and specifications therein contained, said contract having been entered into on the 26th day of January, 1955, as authorized by Ordinance No. 4074, which Ordinance also appropriated the sum of $79,807.34 for said resurfacing,rand the Director or Public Works having Inspected the same and certified to the completion of said work in accordance with said plans and specifications, and said work aforesaid is hereby found to have been completed in accordance with said plans and specifications and is here and now accepted and received by the City Councilof the City of Corpus Christi, Texas. SECTION 2. That final payment due under the contract and as set out in the final estimate attached hereto and made a part_ther,cof, prepared by the Director of Public Works, dated April 30, 1955, in the sum.of $16,180.25, the balance of a total of $79,807.34 of a total due under said contract, be paid from funds heretofore appropriated in said Ordinance No. 4074, in accordance with the said ordinance, from No. 220 Street Bond Improvement Fund. SECTION 3. That the necessity for completion of such project by said acceptance and final payment immediately creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule providing that no ordinance or resolution shall be passed finally on the date it is introduced H aD"� and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, requests that such Charter rule be suspended and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT 19 ACCORDIMLY EO OFDAIJM. OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
