HomeMy WebLinkAbout04235 ORD - 06/01/1955AN ORDINANCE RECEIVING AND ACCEPTING THE WORK OF BURNETT CONSTRUCTION CO FOR CONSTRUCTION OF A FIRE STATION ON MORGAN AVENUE IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, AUTHORIZED BY CONTRACT DATED NNE 6, 1954, BY ORDINANCE NO. 3793; AUTHORIZING FINAL PAYMENT IN THE AMUNT OF $2,500.00, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF,, . DATED MAY 16, 1955, OUT OF FUNDS HERETOFORE APPROPRIATED ON THE BALANCE OF A TOTAL DUE (ON CONTRACT IN THE ORIGINAL AMOUNT OF $116,640.00 OF $117,528.00; AND DECLARING AN EMERGENCY. WHEREAS, The work of construction of a fire station on Morgan Avenue in the City of Corpus Christi, Nueces County, Texas, has been inspected and recommended for acceptance by the architect in charge of such construction and by the Director of Public Works in the City of Corpus Christi; and contract, CORPUS CHRISTI, TEXAS: WHEREAS, it has been recommended that payment be made for such NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SECTION 1. That the work of construction of Morgan Avenue Fire Station in the City of Corpus Christi, Nueces County, Texas, performed by Burnett Construction Company under a contract with the City dated June 6, 1954, as authorized by Ordinance No. 3793, having been performed and completed in accordance with the terms and provisions of contract, plans and specifications, and the Director of Public Works having inspected and certified completion of said work in accordance with said plans and specifications, and the supervising Architect, K. R. Darrah, concurring in said approval, the work is here and now accepted and received by the City Council of the City of Corpus Christi., Y` ' SECTION 2. That fin' nt due under the contract mentioned and set out in the final estimate attached her $ made a part hereof, prepared by the Director of Public Works, and dated May 16, 19551 in the sum.of $2,500.00 due on the contract (in the original amount of $116,640.00) of $117,528.00, be paid out of No. 212 Fire Station Bond Construction Fund in accordance with the appropriation ordinances heretofore made. SECTION 3. That the necessity for completion of such project by said acceptance and final payment creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule providing that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, requesting that such Charter rule be suspended and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.
