THE IMPROVEMENT OF ALAMEDA STREET PAVING PROJECT WITHOUT
ANY OMISSIONS; AUTHORIZING THE PAYMENT OF THE A14OUNTS DUE
THE CONTRACTOR ON SAID ASSESSMENTS AND FOR THE CONSTRUCTION
OF SAID IMPROVEMENTS UPON THE DELIVERY OF ASSIGNMENTS BY
THE SAID CONTRACTOR OF SAID ASSESSMENT CERTIFICATES;
APPROPRIATING THE AMOUNT OF OUT OF NO. 220
STREET BOND IMPROVEMENT FUND; AND DECLARING AN EMERGENCY.
WHEREAS, THE CITY OF CORPUS CHRISTI HAS HERETOFORE AWARDED A CONTRACT
DATED FEBRUARY 2, 1955, TO HELDENFELS BROTHERS, CONTRACTORS, FOR THE IMPROVEMENT
OF ALAMEDA STREET FROM THE NORTH PROPERTY LINE OF LOUISIANA AVENUE TO THE SOUTH
PROPERTY LINE OF DODDRIDGE STREET, AND HAS HERETOFORE DULY APPROPRIATED FUNDS
TO COVER THE COST TO THE CITY OF IMPROVING SAID STREET UNDER SAID CONTRACT; AND
WHEREAS, SAID HELDENFELS BROTHERS HAS NOTIFIED SAID CITY THAT THE
OWNERS AND PROPERTY HEREINAFTER LISTED, ABUTTING UPON SAID STREET, HAVE REFUSED
TO EXECUTE MECHANICS LIEN CONTRACTS TO SECURE THE PAYMENT OF THE PORTIONS OF
THE COST OF IMPROVING SAID STREET ASSESSED AGAINST SAD RESPECTIVE PROPERTIES,

OF SAID IMPROVEMENTS ON THE SAID STREET IN FRONT OF AND ABUTTING THE SAID
RESPECTIVE PROPERTIES; AND
WHEREAS, SAID IMPROVEMENTS HAVE BEEN CONSTUCTED AND THE CERTIFI-
CATES ISSUED, AND THERE ARE SUFFICIENT FUNDS AVAILALBE TO PAY FOR SAID IMPROVE-
MENTS AND TAKE ASSIGNMENTS OF SAID CERTIFICATES AND INDEBTEDNESS REPRESENTEDD
THEREBY:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1._ THAT THE CITY MANAGER IS HEREBY AUTHORIZED, FOR AND ON
BEHALF OF THE CITY OF CORPUS CHRISTI, TO ACQUIRE FROM HELDENFELS BROTHERS, CON-
TRACTORS, THE ASSESSMENT LIENS AND INDEBTEDNESS ASSESSED AGAINST CERTAIN PROPERTY
HERETOFORE AUTHORIZED FOR CONSTRUCTION BY THE CONTRACTOR AFTER HIS 140TICE OF
CLAIM OF HOMESTEAD ON THE PROPERTY ABUTTING SUCH IMPROVEMENTS, WHICH IMPROVEMENTS
WERE AUTHORIZED SO AS TO COMPLETE THE IMPROVEMENT OF ALAMEDA STREET PAVING PROJECT,
FROM THE NORTH PROPERTY LINE OF LOUISIANA AVENUE TO THE SOUTH PROPERTY LINE OF
DODDRIDGE STREET, WITHOUT ANY OMISSIONS.
SECTION 2. THAT PAYMENT BE MADE TO THE SAID HELDENFELS BROTHERS,
CONTRACTORS, OUT OF FUNDS HEREIN APPROPRIATED. THE AMOUNT OF ASSESSMENTS
LEVIED AGAINST THE ABOVE DESCRIBED OWNERS AND PROPERTIES UPON THE TRANSFER
AND ASSIGNMENT BY SAID CONTRACTOR TO THE CITY OF THE SAID ASSESSMENTS, AND

AND AN IMPERATIVE PUBLIC NECESSITY, REQUIRING THE SUSPENSION OF THE CHARTER
RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS
INTRODUCTION, AND THAT SAID ORDINANCE SHALL BE READ AT THREE SEVERAL MEETINGS
OF THE CITY COUNCILI AND THE MAYOR. HAVING DECLARED SUCH EMERGENCY AND IMPERATIVE

For the reasons set forth in the emergency clause of the foregoing
ordinance. a public emergency and imperative necessity exist for the suspen-
sion-of the Charter rule or requirement that no ordinance or resolution shall
he passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
hereby request that you suspend said Charter rule or requirement and pass
this ordinance finally on the date it is introduced, or at the present meeting
of the City Council.

COUNTY OF NUECES a KNOW ALL MEN BY THESE PRESENTS:
WHEREAS, by resolution adopted on the 9th day of March, 1955,
by its City Council, the City of Corpus Christi, Texas, hereinafter called
"said City", determined the public necessity for, and ordered the improve-

Brothers, a partnership of Nueces County, Texas, for and in consideration
of the sum of Twenty Thousand Eive Hundred Thirty -Three and 34/100 (920,533.34)
Dollars to us in hand paid by said City, have granted, transferred and assigned,
and do by these presents grant, transfer and assign unto the said City.the
certificates of special assessment evidencing the assessments for said
street improvements levied against the above described properties together
with all rights, titles, interests, liens and powers securing payment of
same.
It is expressly understood that the assignment of said certificates
of special assessment is made without recourse on the undersigned.
