HomeMy WebLinkAbout04462 ORD - 02/08/1956r R AC :2/8/56 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI TO EXECUTE A CONTRACT WITH SHILSTONE TESTING LABORATORY WHEREBY SHILSTONE TESTING-EABORA IORY AGREE5 TO CONDUCT AN AIR CONTAMINATION INVESTIGATION IN THE AREA OF THE OSO SEWAGE DISPOSAL PLANT; PROVIDING FOR THE PAYMENT OF THE SUM OF $2,000.00 FOR SAID REPORT OUT OF THE EMERGENCY AND NON - RECURRING EXPENDITURE ACCOUNT OF THE 102 CURRENT FUND; MAKING SAID CONTRACT A PART HEREOF; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER,FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, BE, AND HE IS HEREBY AUTHORIZED AND DIRECTED TO EXECUTE A CONTRACT WITH SHILSTONE TESTING LABORATORY WHEREBY SHILSTONE TESTING LABORATORY AGREES TO CONDUCT AN AIR CONTAMINATION INVESTIGATION IN THE AREA OF THE OSO SEWAGE DISPOSAL PLANT, IN ACCORDANCE WITH THE TERMS OF SAID CONTRACT, A COPY OF WHICH 15 MADE A PART HEREOF. SECTION 2. THAT THE PAYMENT OF $21000.00 FOR SAID REPORT IS TO BE PAID OUT OF THE EMERGENCY AND NON- REfICURRING EXPENDITURE ACCOUNT OF THE 102 CURRENT FUND. SECTION 3. THE NECESSITY FOR CONDUCTING THE SURVEY DESCRIBED IN SECTION 1 HEREOF TO DETERMINE THE CAUSE OF DISCOLORATION OF PAINTED BUILDINGS AND OBJECTIONABLE ODORS IN THE GENERAL AREA OF THE OSO SEWAGE PLANT, CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ ATTHREE REGULAR MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO E):IST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRO- DUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORD INGEWA55ED AND APPROVED, THIS THE (/ DAY OF FEBRUARY, 1956. Singer, Letch and Jones representing the City of Corpus Christi, we Were requested to present this proposal for furnishing such technical services an are necessary to determine the exact source and nature of any atmospheric contamination which may have resulted in or be the cause of discoloration of painted buildings and objectionable odors in the general area of th* Oso Sewage Disposal Plant, more particularly described as that area bounded by Corpus Christi Bay Palmetto Street and the northeastern extension thereof t ands 8. Alameda Street. Should the atmosphere be found to be tree of significant amounts of contaminants, We would be obligated to determine other owase(s) of paint discoloration. We offer our services in this connection on the basis of more than fifty years experience as consulting and analytical chemists. Our technical staff consisting of some seventy sealsnsucue sfulsinveestigationssof this type. Ifcrefer references are desired, we would be glad to put you in touch with mayor clients We have served in this respect. The personnel used will be persons qualified to testify, in any judicial pro- ceeding, as expert witnesses. Our standard fee is based upon a per diem rate of one hundred dollars inclusive of travel time but exclusive of Sundays and/ or holi�ays not worked, plus costs of transportation and sub- sistence. Should the services of an assistant be dictated to reduce the working time of the senior chemistp, such aid would be rendered by us at the rate of twenty five dollars per day on an Ras required" basis from our local staff. Should it be necessary to conduct tests upon samples at one of our main City of Corpus Christi February 6, 1956 Pape 2 laboratories, such tests would be billed at standard rates for those types of tests or at one hundred dollars per day, basing the charges upon the lesser figure. Without extra cost we would furnish all equipment, apparatus, chemicals, macro- photographs, etc., as well as a complete written report upon the conclusion of the work, such report to be of 15 duplicate copies. We estimate the cost of these services to be not less than one thousand dollars unless the cause of the trouble is readily apparent. The probable cost may be in the fifteen hundred dollar range. However, we guarantee to conduct the investi- gation to successful conclusion for a total cost not exceeding two thousand dollars provided our efforts are not prevented by local reasons beyond our control. We will commence work on the project promptly on receipt of your order to do so and prosecute to a conclusion with the furnishing of the report within 60 days. We will, if requested, make available as a witness, in any court proceedings involving the problem, the person who conducts the survey at our standard charge of $100.00 per day and expenses. Christi;_Texas Gent 1 eaten: For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shell he passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; 1, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
