BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: r SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY AUTHORIZED AND 'DIRECTED FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO ENTER INTO AN AGREEMENT WITH U. S. NAVAL AIR STATION OF- CORPUS CHRISTI AND U. S. NAVAL AUXILIARY AIR STATION, CA13AN155 FIELD, CORPUS CHRISTI, TEXAS, WHEREBY EACH OF THE PARTIES AGREE TO FURNISH TO THE OTHER ASSISTANCE IN THE EVENT A MAJOR FIRE OCCURS ON THE PREMISES OF EITHER PARTY, IN ACCORDANCE WITH THE TERMS AND CONDITIONS OF SAID AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF. SECTION C. THE FACT THAT IT IS NECESSARY TO ENTER INTO THE AGREEMENT DESCRIBED III SECTION 1 HEREOF IN ORDER TO BETTER PROTECT THE CITY,OF CORPUS CHRISTI IN CASE OF A MAJOR FIRE CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE REGULAR MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, DECLARING SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE DE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER THE DATE OF ITS PASSAGE, IT IS ACCORDINGLY PASSED AND APPROVED THIS THE DAY of 1956. S. NAVAL AIR STATION, CORPUS CHRISTI, TEXAS: OR THE U. S. NAVAL AUXILIARY AIR STATION, CABANISS FIELD, CORPUS CHRISTI, TEXAS. Pursuant to Public Law 46, 84th Congress, Chapter 10$, 1st Session, the City of Corpus Christi, Texas, the Commanding Officer, U. S. Naval Air Sta- tion, Corpus Christi, Texas, and the Commanding Officer, U. S. Naval Auxili- ary Air Station, Cabaniss Field, Corpus Christi, Texas, agree that it is to the best interest of the United States to provide for a plan of mutual aid, each to the other, in the event of a major fire occurring within the jurisdic- tion of the parties hereto. Accordingly, the parties hereto agree as follows: 1. In the event assistance is required by the City of Corpus Christi, Texas, the other two parties hereto will respond with sufficient equipment to combat a major fire, retaining on7,y the men and equipment necessary for the protection of their own premises. 2. In the event assistance is required by the U. S. Naval Air Station, Corpus Christi, Texas, or the U. S. Naval Auxiliary Air Station, Cabaniss Field, Corpus Christi, Texas, the City of Corpus Christi, Texas, will respond with sufficient equipment to combat a major fire, retaining only the man and equipment necessary for the protection of their own premises. (a) Should assistance be required by the U. S. Naval Air Station, Corpus Christi, Texas, one pumper from U. S. Naval Auxiliary Air Station, Cabaniss Field, Corpus Christi, Texas, will respond. Should assistance be required by the U. S. Naval Auxiliary Air Station, Cabaniss Field, Corpus Christi, Texas, the U. 9. Naval Air Station, Corpus Christi, Texas, will re- spond with one pumper. 3. To insure effective and coordinated effort hereunder, representatives of the Fire Departmerts of the parties hereto will, on a monthly basis, or at other -tim9s as deemed necessary, exchange information on fire fighting methods and techniques. Periodic meetings between representatives are en- couraged. 4. The U. S. Naval Air Station, Corpus Christi, Texas, will, in the event of a major fire, dispatch the Fire Chief or Assistant Fire Chief who shall immediately on arrival establish radio communications with the U. S. Naval Air Station on 96.14 megacycles utilizing if necessary the Shore Patrol base station for relay radio. 5. The party requesting fire fighting assistance hereunder shall indicate the magnitude of the fire and specify what additional equipment is required. 6. Each party hereto, as a part of the consideration for this agree- ment, specifically agrees as follows: (a) All claims or demands against the other party or parties hereto for compensation for any loss, damage, personal injury or death occurring in consequence of the performance or non - performance of this agreement are here- by waived. (b) The furnishing of fire fighting service hereunder rests solely in the discretionary determination of the parties hereto as to availability of such service at the time of a fire. (c) Services performed hereunder shall be rendered without the reim- bursement of either party therefor. (d) Services performed hereunder by officers or employees of the United States or any member of the armed forces of the United States shall con- stitute service rendered in line of duty in such office, employment or force. The performance of such service by any other individual shall not constituis such individual an officer or employee of the United States for the purpose of the Federal Employee's Compensation Act, as amended. The above mutual aid agreement is hereby approved by the parties here- unto to become effective on the date of the execution of this agreement and shall continue to be effective until such time as any party hereunto desir- ing to withdraw shall serve notice upon the other two signatories of its intention to so withdraw. This agreement cancels and supersedes existing mutual aid fire fighting agreements between the parties hereto. IN 141TNESS WHEREOF, We have hereunto set our hands this 18th day of April, 1956.
