ORDINANCE N0. 4582 WHEREAS, Notice of hearing on the matter of fixing the right of way width of Ocean Drive between a point thirty feet (30') north of the south line of Lot 4, Block 5, Alta Vista Addition, and Rossiter Street, has been given by publication and by registered mail to the last known address of all owners abutting said street and within four hundred and fifty feet (450') thereof; and WHEREAS, Pursuant to said notice, a public hearing was held by the City Council of the City of Corpus Christi in accordance with the provisions of Section 6, Article DC of the City Charter, and in accordance with the provisions of Article 1105 (a) of the Revised Civil Statutes of Texas, said hearing being held on the 20th day June, 1956; and WHEREAS, It has been determined by the City Council, after such public hearing, that the said street should have an established right of way width so as to lessen the sharpness of the curve now existing in the street right of way of Ocean Drive; and WHEREAS, The City Manager of the City of Corpus Christi has prepared and submitted to the City Council a map showing the proposed improvement of said street, which has been approved by the City Zoning and Planni3ig Commission and which is attached hereto and marked "Exhibit A ". NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the building line on Ocean Drive between a point thirty feet (30') north of the south line of Lot 4, Block 5, Alta Vista Addition, and Rossiter Street, shown on the map attached hereto and marked "Exhibit A" fixing the width of the street right of way at a width so as to lessen the sharpness of the curve now existing in the street right of way of Ocean Drive, be and is hereby approved and adopted as the building line of said street at the location shown on said map, and from and after the date of this ordinance, building encroachment upon said line is forbidden. r SECTION 2. Said Ocean Drive within the limits above set forth, is hereby ordered opened so as to lessen the sharpness of the curve now existing in the street right of way of Ocean Drive, as shown on said map attached hereto. SECTION 3. The fact that the public convenience and safety of the public required the immediate establishment of the building line fixing the width of Ocean Drive within the limits herein defined creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date of its introduction, and that said ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and public imperative necessity exist, and having requested that said Charter rule be suspended and that this ordinance be passed finally on the date of its introduction and take effect and be iniull force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.
