HomeMy WebLinkAbout04677 ORD - 11/21/1956IMS :MEM:11 /21/56 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI A CON- TRACT WITH LEIGH FISHER 6 ASSOCIATES FOR ADVISORY SER- VICES REGARDING THE USE AND FINANCIAL OPERATIONS OF THE PROPOSED NEW MUNICIPAL AIRPORT, IN ACCORDANCE WITH THE TERMS AND CONDITIONS OF SAID CONTRACT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF; APPROPRIATING THE SUM OF $8,500.00 OUT OF 245 AIRPORT IMPROVEMENT BOND FUND FOR SUCH SERVICES; AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED TO EXECUTE FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI A CONTRACT WITH LEIGH FISHER & ASSOCIATES FOR ADVISORY SERVICES REGARDING THE USE AND FINANCIAL OPERATIONS OF THE PROPOSED NEW MUNICIPAL AIRPORT, IN ACCORDANCE WITH THE TERMS AND CONDITIONS OF SAID CONTRACT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF. SECTION 2. THAT THERE IS HEREBY APPROPRIATED THE SUM OF $6,500.00 OUT OF 245 AIRPORT BOND IMPROVEMENT FUND FOR SUCH SERVICES. SECTION 3. THE NECESSITY FOR ENTERING INTO THE CONTRACT DESCRIBED IN SECTION 1 HEREOF IN CONNECTION WITH THE NEW MUNICIPAL AIRPORT SITE TO BE NAMED BY THE CITY CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED, AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED. NOM VEER 22, >as6: r CITY TT RNEY 1r \!n CONTRACT THIS AGREEMENT made and entered into this day of , 1956` by and between the City of Corpus Christi, Texas and through its hereinafter sometimes referred to as Client, and LEIGH FISHER, doing business as LEIGH FISHER & ASSOCIATES, an airport research and financial counselling organization of South Bend, Indiana, herein sometimes referred to as LFA, WITNESSETH: WHEREAS, The Client is desirous of obtaining airport advisory services with regard to the development, use, and financial operations of a new Corpus Christi Municipal Airport and, WHEREAS, the Client by action of authorized its to enter into a contract with LFA to render airport advisory services as set forth below: NOW, THERE=FORE, the parties hereto mutually agree, promise, and covenant as follows: SAID LFA shall promptly undertake the following services: Item I - Economic and Air Trade Studies A. Investigate the economic and business conditions of the air trade area to determine effect on present and future air traffic volume and type. B. Prepare aninventory of existing air trade including: 1. Existing civil aviation services 2. Business aircraft 3. Airline traffic 4. Origination and destination studies 5. Gross ticket sales, station costs and other airline financial data 6. Comparisons with other similar U. S. cities 7. Flight training schools 8. Personal aircraft 9. Other C. Forecast air traffic potentials for next decade and following trend including: 1. Volume of air passengers. 2; Volume of airmail 3. Volume of air cargo (express and freight) 4. Peak air carrier movements S. Business and personal aircraft 6. Composite air traffic analysis, including military potential D. Based on the above air trade studies, prepare a forecast of expected building area and airport facility use for the airport to include: 1. Terminal building 2. Hangars, shops and other buildings 3. Parking lots and roadways 4. Airfield, taxiways and aprons 5. Other related facility needs Item II - Review of Master Plan Review the Master Plan for the new airport to insure that the landing area, building areas, and runway and taxiway planning are related to the traffic forecasts made in Item I above. A. In relating the physical facilities of the airport to the traffic demand, LFA shall consider the following factors: 1. Approaches 2. Air use pattern 3. Airport building area (s) 4, Land area use(s) 5. Other related factors B. Based on the above set forth studies and analyses, LFA will prepare an overall schedmatic Master Plan of the airport. Such master plan shall consider the effect on the adjoining land area and culture. In addition to standardized airport master planning criteria, the following additional elements shall be considered: 1. Approach procedures and expected noise levels and effect 2. Culture in approach areas 3. Airspace zoning and /or easements 4. Protection of adjoining culture areas from unnecessary airspace use. 5. General conditions developed by the President's Airport Commission C. In reviewing the Master Plan of the airport, including air approaches and surrounding cultural area determinations, LFA will confer in the community, with such city planning and other officials as may be designated by the City of Corpus Christi. Special study will be given to the integration of urban development with the airport to assure compatibility of contiguous land uses and the proper relation with the overall area. Item III - Terminal Building Analyses After determination of the overall traffic requirements forthe new Corpus Christi Municipal Airport, and upon completion of the Master Plan review undertaken in Item II, LFA will undertake the development of terminal building requirements, design criteria, and schematic plans and prepare a recommended construction program considering interrelationships of functions and areas. LFA will: A. Ascertain probable volumes of terminal building and area user including, 3 but not restricted to, air passengers, air mail, air cargo,, visitors, employees, parking lot use, and related activities, outlining the effect and specialized needs for each activity and /or use as it might relate to terminal building and area layout, function, design,, and operation. B. Direct inquiries to users (actual and potential) of the proposed terminal building to determine the approximate space requirements (present and future) of such users. Analyze space requirements as determined by the foregoing inquiries and study the allocation and relative positioning of the several space uses to achieve the maximum functional efficiency, of the terminal building. C. Prepare a terminal building requirements programwhich will include: 1. Detailed space programs giving square foot space allocations for each function to be carried on in the terminal building. 2. Requirements and detailed square foot space allocations for concessions, services and facilities. 3. Requirementsand detailed square foot space allocations for airlines, general tenants, governmental and managerial functions. D. Make recommendations on type of design and outline the design considera- tions most important to the development of a functional terminal building. E. Prepare an overall master plan schematic layout of the apron and ramp orientation, terminal building area, access roads, parkinglots, terminal building, and other related facilities. F. Prepare a schematic plan of the terminal building, recognizing necessary interrelationship of functions based on projected trade volumes for scheduled, and non - aviation activities. Item IV = Pinancial Studies LFA shall analyze and report onthe operations and financial policy to be used in developing, operating, and maintaining the airport facility. The preferred type of airport financial and administrative policy will be specifically set forth. Recommenda- tions and policies to obtain maximum self- sufficiency will be made. LFA shall consider the effect and interrelationship of the proposed development of a new air- port, building area program, and terminal area on the overall financial operation of the airport. Specificially the following services will be �erformed: A. Review cost analyses of present airport operations. Appraise accounting system, and recommend changes therein to be utilized on the new airport. B. Review and evaluate all airport financial matters including, but not restricted to: 1. Investment 2. Depreciable assets 3. Leases and contracts 4. Concession operations 5. Rates and charges 6. Accounting system and procedures 7. Costs of operation 8. Personnel use and control 9. Equipment use and need 10. Basic financial policy 11 . Other related subjects C. Recommend changes in present airport financial and administrative policy necessary to achieve the most sound financial airport operations on the new airport. D. Prepare analysis of the new airport and terminal building's use and revenues to be derivedfrom sudiuse. E. Outline expected expenses of operation of the new airport. P. Prepare a schedule of rates and charges for airport and terminal building operation to include rates and charges for all users such as: 1. Government agencies 2. Airlines 3. General tenants 4. Concessionaires 5. .Other Item V - Coordination with Architects and/or Engineers In developing the airport and terminal building schematic plans, LFA shall work and confer with architect(s), and/or engineers designated by the City of Corpus Christi as directed. Such architect(s) and %or engineers shall furnish, among other things generally furnished in the undertaking of such projects, the following specific data: A. Foundation and footing suggestions. B. Locpl code and cost data. C. General advice to assure the feasibility under local conditions of proposed construction, types and/or methods. LFA will coordinate all work with the architects and/or engineers providing them with preliminary space and design requirements so that the preparation of final drawings may be expedited. Item VI - Production Time Fee General Conditions & Following Services A. The production schedule for undertaking the work outlined in Items I through III above shall be at the discretion of LFA, provided, however, that LFA shall keep the City of Corpus Christi informed as to the progress and schedule of the work, and shall attempt to coordinate all visits to Corpus Christi to include any special conferences or meetings desired by the City. If, however, during the production of the work, attendance ofan LFA representative at special meetings or conferences is desired by the City, such attendance and participation will be rendered on the basis of the daily fees outlined in the attached schedule of fees. B. Within one hundred eighty (180) days after the date of authorization to proceed, twenty (20) copies of a report setting forth the results, findings, and recommendations of the undertakings outlined in Items I through III above will be submitted. C. The fee for the complete services set forth herein, including all costs incident to the conduct of, preparation, and completion of the analyses, investigations programming, planning, and studies,, shall be the total sum, of Eight Thousand Five Hundred Dollars ($,8500.00), Said, sum shall be payable as follows: in six monthly installments of $1,000.00 on the first day of the month, and the balance of $2,500.00 within 30 days after submission of the final report. D. Without additional cost, after completion of the services set forth herein an UA representative will meet with representatives of the City of Corpus Christi to review and discuss the results of the work and to formulate future procedure. During the production of the work LFA will coordinate all proposed modifications with the proper officials to assure harmony with overall administrative policies and procedures. At the option of the City of Corpus Christi, during the 2 -year period after completion of the services set forth herein, and beginning the first day of the month next following the conference referred to in paragraph D above, LFA will provide continuing counsel, analytical and advisory services covering the necessary plan changes, preparation of final lease and contract forms, coordination with architect and engineers and generally furnishing assistance with respect to the financial and operational problems which will be encountered during the immediately after construction of the new airport, terminal building, and related facilities. 'This continuing service will be provided for a fixed fee of One Hundred Dollars ($100.00) per month as a retainer against the cost of services requested by the City and so rendered. by LFA, all on the basis of the daily, hourly and sub- contract schedule of fees attached hereto. F. To expedite the undertaking of the work outlined herein, and to permit the correlation of data, materials, plans, commitments, and. correspondence, the City agrees to designate a specific staff member of the City as its representative to whom all correspondence, materials, plans, requests for conferences, and other similar data will be directed; and LFA agrees to keep said staff member fully informed regarding the progress of the work and to cooperate with the staff member in coordinating the work and in resolving all matters relating to conclusions, procedures, undertakings, work schedule and other actions prior to the final submission of the reports set forth above. G. General - LFA agrees to save and keep the City of Corpus. Christi harmless from any and all claims for workmen's compensation, public liability, and employment insurance in any manner arising out of the performance of this contract or any part thereof by said LFA, its employees, agents, or associates. Daily Services of Leigh Fisher - $135.00 per man day Daily Services of H. C. Timberlake, Associated CAB Economist - on an hourly basis (see below�t ) Daily Services of Staff Associates - $100.00 per man day Note: On CAE Hearings and Projects where specialized clerical assistance is required, necessitating travel by an LFA em- ployee, the hourly rate of $3.50 plus travel and subsistence will be charged. In determining the number of man day's service, travel time shall be included. Hourly Fees This fee schedule pertains to preparation of specific studies, documents, contracts or leases, specifications or plans as re- quested by the client and related research work which may be neces- sary. The rates do not include special materials, supplies, tele- phone charges, and other direct job expenses for which a separate billing is made. Leigh Fisher - $15.00 per hour *H. C. Timberlake, Associate CAB Economist - .$12.00 per hour (when traveling, hours plus travel & subsistence) Staff Associates - $10,00 per hour Typing and Clerical - $3.50 per hour Materials, Supplies, Telephone Charges - Cost Billing,- In the absence of specific directions otherwise, we will furnish an itemized invoice of days, hours, work performed, and total cost on the first day of the month following the rendering of any services.
