ADJACENT AND CONNECTING PORTIONS OF EVERBART ROAD;
DEFINING ITS LIMITS AND DECLARING THE SAME A PART
OF THE CITY OF CORPUS CHRISTI, TEXAS, SUBJECT TO
THE CONDITIONS, RULES, REGULATIONS, ORDINANCES
AND THE CHARTER OF THE CITY OF CORPUS CHRISTI, TEXAS;

WHEREAS, The City of Corpus Christi, Texas, did on the 23rd day
of November, 1956, enter into an agreement with Del Starr Realty Co., Inc., a
corporation of Nmeces County, State of Texas, and the Corpus Christi Independ-
ent School District, the owners in fee simple of the property described in said
contract, to admit the said property into the City of Corpus Christi, Texas; and
WHEREAS, The Zoning and Planning Commission has recommended the
annexation of the connecting portion of Everhart Road from the carrent City
limits line to and adjacent with bat outside of Schanen Estates Unit 2, such
portion of Everhart Read more particularly described in Section 1; and
WHEREAS, The express covenants contained in said agreement have
been complied with and it has been recommended by the Zoning and'Planning
Commission of the City of Corpus Christi that suck property be annexed in
accordance with the terms of said agreement; and
WHEREAS, There are no resident voters within said territory; and
W AS, Said property is adjacent to and adjoins the City of
Corpus Christi, Texas,; and
WHEREAS, Thh,'0±ty Council of the City of Corpus Christi deems it
advisable and to $e best interest of said City that the hereinafter described
property be admitted to the City of Corpus Christi, Texas:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the territory herewith annexed into the City of
Corpus Christi, Texas, is described as follows, towit:
Being a tract of land out of Lot five (5) of the Byron
Willis Subdivision and Lot six (6) of the Oso Farm Tracts,
according to the maps or plats thereof filed of Record
in the Map Records of Naeces County, Texas, and being
more particularly described by metes and bounds as follows,
to-wit:
Beginning at a point in the Northeast line of Lot five
(5) of the Byron Willis Subdivision same lying in the
southeast right -of -way of Weber Road, whence the Nosh
corner of said Lot five (5) bears N. 61° 02' W. 40',
for the most Northerly corner of this tract and the place
of beginning;
THENCE with the Northeast line of said lot five (5),
S. 61° 02' E. 2478.03' to a point in the Northwest line
of a tract of land owned by Central Power & }9ght Co.
for a corner;
THENCE with the common boundary of said Central Power &
light Co. Tract S. 29° W. 150.92' for a corner;
THENCE S. 61° E. 313.52' for a corner;
Thy' N. 290 E. 2..73' to a point in the Southwest
right -of -way line of a40' railroad easement for a corner;
THENCE with said railroad right- of-way line S. 61° 01' 40e
E. 2412.48 to a point in the Northwest right -of -way of Ever-
kart Road for the most Easterly corner of this tract;
THENCE with the Northwest right -of -way parallel with and 30'
normal to the center line of said Everhart Road S. 28° 58'
W. 1295.30' to a point in the Southwest line of said Lot Six
(6), Oso Farm Tracts for the most Southerly Corner of this tract;
THENCE with the Southwest line of said Lot six (6), Oso
Farm tracts N. 61° 04' 20" W. 2621.95' to a point in the
Southeast line of said Lot five (5), Byron Willis Sub-
division same point being the West corner of said Lot
six (6), Oso Farm Tracts for a corner of this tract;
THENCE with the Southeast line of said Lot five (5),
Byron Willis Subdivision S. 29° W. 88.27' to the South
cornerof said Lot five (5), for a corner of this tract;
THENCE with the Southwest line of said Lot five (5)
N. 610 02' W. 2582.06' to a point in the Southeast right -
of -way of Weber Road for the most Westerly corner of this
Tract;
THENCE parallel with and 40' normal to the center line
of said Weber Road N. 28° 58' E. 1327.90' to the point
of beginning containing 156.27 acres, more or less;
and also the adjacent area herewith annexed, described as follows:
BEGINNING at the intersection of the present City I3mits
Line and the Southeast boundary line of Everhart Road;
THENCE S 28° - 58' W along and with the Southeast boundary
line of Everhart Road a distance of 1335.30 feet to its
intersection with the South Easterly extension of the South -
West Boundary line of lot 6, Oso Farm Tracts, as shown by
map or plat of said Oso Farm Tracts recorded in
Volume A, Page 49, of the Map Records of Nieces
County, Texas;
THENCE N. 61° - 04' - 20" W a distance of 60 feet to a
point, said point being in the southwest boundary line of
said It 6, Oso Farm Tracts, and the Northwest Boundary
line of Everhart Road;
THENCE N 280 - 58* E along and with. the Northwest Boundary
line of Everhart Road, a distance of 1335.30 feet to its
intersection with the present City Tialits Lane;
THENCE S 61° - 01* 40"E with the present City Limits Lane,
a distance of 60 feet to the PIACE OF BEGINNING,
be, and the same is hereby admitted into the City of Corpas Christi, Texas, as
an integral part thereof, said territory shall hereafter be a part of the City
of Corpus Christi, subject to the GENERAL laws of the State of Texas, the City
Charter and the ordinances, resolutions, motions, and regulations of the City
of Corpus Christi, Texas. Suck territory shall bear its proportionate share
of all taxes levied by the City and its inhabitants shall have all the privi-
leges and be subject to all the duties of other inhabitants of the City of
Corpus Christi, Texas.
SECTION 2. That the fact that the owners of suck territory desire
that same be immediately incorporated within the limits of the City of Corpus
Christi,and the fact that is is imperative for the Well -being of the inhabitants
of the City of Corpus Christi that sack territory be immediately incorporated
within said limits, and the terms of said annexation agreement having been
complied with, creates an emergency and an imperative public necessity re-
quiring the suspension of the Charter Rule that no ordinance or resolution
shall be passed finally on the date of its introduction and that such ordinance
or resolution shall be read at three several meetings of the City Council, and
the Mayor, having declared suck emergency and necessity to exist, having re-
quested the suspension of tie said Charter role and that this ordinance be
passed finally on the date of its introduction and take effect and be in full
force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING
ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN-
SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT 15 INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE,
HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS
THIS ORDINANCE FINALLY ON THE DATE IT 1S INTRODUCED, OR AT THE PRESENT MEETING
OF THE CITY COUNCIL.

Annexation Ordinance for Schanen Estates
December 10, 1996
In scanning a copy of Ordinance 44635 furnished us
through the City Secretary 1 noticed that contrary to our
established pratice Everhart ;load had not been included along
the length abutting Schanen Estates Subdivision. A detailed
check of the iaetes and bounds description showed that the
annexation of Schanen Estates had been effected not by tying
it to the neareat corner of the existing city limits paral-
leling Everhart at Gardendale but by an extension of almost
4,000 feet down Weber Road. While this would do the Job, I
believe it is contrary to the charter which authorizes the
City to annex by ordinance public right's —of —way abutting the
City limit not over 200 feet in length.
There appears to be a typographical error in sub —para-
graph 8 of Section 1 of the ordinance. This paragraph should
read "Thence with the West right —of —way parallel with and
30 few normal to the center line ", instead of the
40 feet as shown.
Attached is a small map showing the conditions described
above.
