AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER FOR AND ON
BEHALF OF THE CITY OF CORPUS CHRISTI TO EXECUTE A TERMI-
NATION AGREEMENT WITH THE SOUTHWESTERN BELL TELEPHONE
COMPANY CONCERNING A PBX SYSTEM LOCATED AT 1616 BUFFALO
STREET, CORPUS CHRISTI, TEXAS, A COPY OF WHICH AGREEMENT
IS ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING
AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:

SECTION 1. THAT THE CITY MANAGER BE, AND HE 15 HEREBY AUTHORIZED
AND DIRECTED TO EXECUTE FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI A TERMI -
NATION AGREEMENT WITH THE SOUTHWESTERN BELL TELEPHONE COMPANY CONCERNING A PBX
SYSTEM LOCATED AT 1616 BUFFALO STREET, CORPUS CHRISTI, TEXAS, A COPY OF WHICH
AGREEMENT 15 ATTACHED HERETO AND MADE A PART HEREOF.
SECTION 2. THE NECESSITY FOP EXECUTING THE AGREEMENT DESCRIBED IN
SECTION 1 HEREOF CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY
REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE OF ITS INTRODUCT I 01 AND THAT SUCH ORDINANCE OR RESO-
LUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR
HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED
THAT SUCH CHARTER RULE BE SUSPENDED, AND THAT THIS ORDINANCE BE PASSED FINALLY ON
THE DATE OF ITS INTRODUCTION AND TARE EFFECT AND BE IN FULL FORCE AND EFFECT FROM
AND AFTER ITS PASSAGE, IT 1S ACCORDINGLY SO ORDAINED.

TERMINATION AGREEMENT

As provided by the General Exchange Tariffs of the Southwestern Bell Telephone Company, this agree-
ment is supplemental to the regular contract for telephone service between the undersigned parties and
is effective for 410 months starting from the date of installation of the following equipment,
facilities or service:
74° -I Dial MX System equipped for 10 trn*aI 40 dial stations,
40 manual stations, and 5 tie lines.

In the event that the contract for the use of the equipment, facilities or service described above is termi-
nated by the customer within the minimum service period of- --O:. months, the undersigned customer, or
its assigns, agrees to pay to the telephone company termination charges equal to $faQO reduced
by. 100 .for each month service is retained, with proportionate reductions for fractional portions
of a month.
Where the use of a portion of the equipment, facilities or service subject to termination charges under
this agreement is terminated within the minimum service period, termination charges apply, equal to the
original net cost of that portion of the equipment or facilities the use of which is terminated, reduced by
1140 .for each month service is retained, with proportionate reductions for fractional portions of
a month.
If, at the customer's request, engineering, manufacturing or installation work once begun is stopped and
the installation is not completed, the customer agrees to pay the net costs incurred in lieu of the above
termination charge.
The destruction or partial destruction of the customer's premises by fire, flood, storm, or other acts of
God shall not be considered as a termination under this agreement, if following such destruction or partial
destruction of the customer's premises, the service covered by this agreement is re- established within
thirty (30) days either at the same or another location. Such interruption of continuous service shall
not be considered as a break in the effective period of this contract. Any such interruption of more than
thirty (30) days but not more than one (1) year shall cause an extension of this agreement equal to the
duration of the interruption. Any such interruption beyond one (1) year shall terminate this agreement
but the payment of termination charges as above mentioned shall be paid by the customer as of the date
of interruption.

OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED
FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL
BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE, HEREBY REQUEST THAT
YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON
THE DATE IT 15 INTRODUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
