AN ORDINANCE
AUTHORIZING CONDEMNATION PROCEEDINGS BY THE CITY OF CORPUS
CHRISTI TO CONDEMN CERTAIN REAL ESTATE IN NUECES COUNTY,
TEXAS, DESCRIBED AS A PORTION OF LOT 1, BLOCK 6, HOME
PLACE ADDITION OWNED B RNO D ALES ND IRGINIA
GALVAN GONZAL S, FOR U5L IN IHL PROJECT M R V F
AGNES -L REDO STREETS AS A PART OF ME INCREASE
AND SIDEWALK AREA, WHICH LAND IS MORE PARTICULARLY DESCRIBED
HEREIN; DIRECTING THE CITY ATTORNEY TO INSTITUTE PROCEEDINGS
TO CARRY OUT THE INTENTIONS OF THIS ORDINANCE; AND DECLARING
AN EMERGENCY.
WHEREAS, THE CITY OF CORPUS CHRISTI INTENDS TO PROCEED WITH THE PROJECT
HERETOFORE DESIGNATED AS AGNES - LAREDO PROJECT #1- 53 -18, WHICH INCLUDES THE IMPROVE-
MENT OF AGNES AND LAREDO STREETS AND THE WIDENING OF LAREDO STREET, AND IT IS
NECESSARY TO ACQUIRE THE HEREINAFTER DESCRIBED REAL ESTATE IN ORDER FOR THE CITY
TO COMPLETE SAID PROJECT, SAID PROPERTY NEEDED TO BE ACQUIRED BEING MORE SPECI-
FICALLY DESCRIBED AS FOLLOWS:

A TRACT OF LAND OUT OF THE NORTH PORTION OF LOT 1, BLOCK 6,
OF THE HOME PLACE ADDITION TO THE CITY OF CORPUS CHRISTI AS
SHOWN By MAP OR PLAT OF SAID ADDITION RECORDED IN VOL. 3,
PAGE 48, OF THE MAP RECORDS OF NUECES COUNTY, TEXAS, SAID
TRACT OF LAND BEING MORE PARTICULARLY DESCRIBED BY METES AND
BOUNDS AS FOLLOWS:
BEGINNING THE NORTH EAST CORNER OF SAID LOT 1, BLOCK 6,
HOME PLACE ADDITION, FOR A CORNER OF THIS TRACT;
THENCE, S 840 -031 W, A DISTANCE OF 72.j2 FEET TO A POINT;
THENCE N 88' -D01 W. PARALLEL TO AND 10 FEET SOUTH OF THE
NORTH BOUNDARY LINE OF SAID LOT 1, A DISTANCE OF 48.37 FEET TO
A POINT IN THE WEST BOUNDARY LINE OF SAID LOT 1;
THENCE N 21' -001 W ALONG AND WITH THE WEST BOUNDARY LINE
OF SAID LOT 1, A DISTANCE OF 10 FEET TO THE NORTHWEST CORNER
OF SAID LOT 1, FOR A CORNER OF THIS TRACT;
THENCE S 88° -DOI E ALONG AND WITH THE NORTH BOUNDARY
LINE OF SAID LOT 1, A DISTANCE OF 120 FEET TO THE PLACE OF
BEGINNING. CONTAINING 842 SQUARE FEET OF LAND.
WHEREAS, THE RECORD TITLE OF SAID PROPERTY APPEARS TO BE IN ARNOLD
GONZALES AND WIFE, VIRGINIA GALVAN GONZALES, BOTH OF WHOM RESIDE IN NUECES
COUNTY, TEXAS; AND
WHEREAS, THE CITY OF CORPUS CHRISTI IS UNABLE TO ARRIVE AT AN AGREE-
MENT WITH SAID OWNERS AS TO THE PRICE AND VALUE OF SAID LAND AND IT BECOMES
EXPEDIENT THAT SAID PROPERTY BE ACQUIRED BY THE CITY BY THE EXERCISE OF ITS
POWER OF EMINENT DOMAIN FOR SAID PUBLIC PURPOSE; -

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. IN CONFORMITY WITH THE PREMISES, AND IN ACCORDANCE WITH
PROVISIONS OF THE CITY CHARTER AND THE LAWS OF THE STATE OF TEXAS, THE CITY OF
CORPUS CHRISTI, TEXAS, DOES HEREBY ORDER THE CONDEMNATION OF CERTAIN REAL
ESTATE IN NUECES COUNTY, TEXAS, AND THE ACQUISITION THEREOF BY THE CITY OF
CORPUS CHRISTI BY THE EXERCISE OF THE POWER OF EMINENT DOMAIN OF SAID CITY,
SAID LAND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
A TRACT OF LAND OUT OF THE NORTH PORTION OF LOT 1, BLOCK 6,
OF THE HOME PLACE ADDITION TO THE CITY OF CORPUS CHRISTI AS
SHOWN BY MAP OR PLAT OF SAID ADDITION RECORDED IN VOL. 3,
PAGE 48, OF THE MAP RECORDS OF NUECES COUNTY, TEXAS, SAID
TRACT OF LAND BEING MORE PARTICULARLY DESCRIBED BY METES AND
BOUNDS AS FOLLOWS:

HOME PLACE ADDITION, FOR A CORNER OF THIS TRACT,
THENCE, S 84^ -031 W, A DISTANCE OF 72.32 FEET TO A POINT,
THENCE N 882 -001 W. PARALLEL TO AND 10 FEET SOUTH OF THE
NORTH BOUNDARY LINE OF SAID LOT 1, A DISTANCE OF 48.37 FEET TO
A POINT IN THE WEST BOUNDARY LINE OF SAID LOT 1,
THENCE N 2A -001 W ALONG AND WITH THE WEST BOUNDARY LINE
OF SAID LOT 1, A DISTANCE OF 10 FEET TO THE NORTHWEST CORNER
OF SAID LOT 1, FOR A CORNER OF THIS TRACT,
THENCE S 88° -001 E ALONG AND WITH THE NORTH BOUNDARY
LINE OF SAID LOT 1, A DISTANCE OF 120 FEET TO THE PLACE OF
BEGINNING. CONTAINING 842 SQUARE FEET OF LAND.
SECTION 2. THE CITY ATTORNEY IS HEREBY AUTHORIZED AND DIRECTED 70
INSTITUTE CONDEMNATION PROCEEDINGS AGAINST SAID PROPERTY AND ALL THE PERSONS
WHO MIGHT HAVE AN INTEREST THEREIN AND 70 PROCEED WITH SAID CONDEMNATION SUIT
TO ITS CONCLUSION, WITH THE INTENTION IN MIND OF OBTAINING POSSESSION AND TITLE
TO SAID PROPERTY 50 THAT SAID CONSTRUCTION AND IMPROVEMENT PROJECT MAY BE COM-
MENCED AND COMPLETED.
SECTION 3. THE PUBLIC IMPORTANCE OF THIS ORDINANCE AND THE NECESSITY
FOR THE CITY TO GAIN POSSESSION AND TITLE OF AND TO THE REAL PROPERTY HEREIN -
BEFORE SET OUT SO THAT SAID CONSTRUCTION AND IMPROVEMENT PROJECT,MAY BE COMMENCED
AND _COMPLETED CREATES A PUBLIC EMERGENCY AND PUBLIC IMPERATIVE NECESSITY REQUIR-
ING THE SUSPENSION OF THE CHARTER RULE PROVIDING NO ORDINANCE OR RESOLUTION
SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE
OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND

THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING RE-
QUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED
FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE TAKE EFFECT
AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY
SO ORDAINED.

GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE
SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLU-
TION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH
ORDINANCE OR RESOLUTION SHALL BE 'READ AT THREE MEETINGS OF THE CITY
CODNC IL; 1, THEREFORE, HEREBY REq UE ST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO-
DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
