Mayor Gabe Lozano, Sr. called the Special Council Meeting to order in
the Corpus Christi Museum.
City Secretary Bill G. Read stated that the necessary quorum of required
Charter Officers was present to conduct a legally constituted meeting.
City Manager R. Marvin Townsend announced the public hearing on Applica-
tion No. 578-4, David S. Jellison, for a change of zoning from "R -1B" One -family
Dwelling District to "B-3" Business District on Lot 23, Block 4; Lexington Estates,
located on the west side of Cosner Drive, approximately 105 feet north of South
Padre Island Drive.
Mr. Townsend stated that both the Planning Commission and the Planning
Staff recommend approval. He informed the Council that in response to the notices
of the public hearing, two in favor and one in opposition had been returned.'
Chief Planner Larry Wenger located the area on the zoning and land use
map, described the land use in the surrounding area, and showed slides of the
area. Mr. Wenger stated that the owner plans to expand the size of the existing
business which adjoins this property.
Mayor Lozano noted that Mr. Ben Donnell of the Planning Commission was
present.
No one spoke in regard to this application.
Motion by Sample that the hearing be closed, seconded by Holt, and passed
unanimously.
Motion by Sample that the Council concur with the recommendation of the
Planning Commission and approve the zoning of "B-3" for Application No. 578-4,
seconded by Juarez, and passed unanimously.

City Manager Townsend announced the public hearing on Application No.
578-5, Woodland Creek Developers, for a change of zoning from "R -1B" One -family
Dwelling District to "B-1" Neighborhood Business District on Tract A, and from
"R -1B" One -Family Dwelling District to "R-2" Multiple Dwelling District on Tract
B, Tract A consisting of 3.218± acres and Tract B consisting of 3.193* acres,
both being out of Tract I and II of the C. C. Hart Partition, located on the
south side of Leopard Street, approximately 650 feet east of Caplin Drive.
City Manager Townsend informed the Council that both the Planning Commis-
sion and the Planning Staff recommend approval. He further stated that in response
to the notices of the public hearing, three in opposition and none in favor had
been returned.
Chief Planner Wenger located the area on the zoning and land use map,
described the land use in the surrounding area, and showed slides of the area.
Mr. Wenger stated that the owners plan a shopping center strip on Tract A.
City Manager Townsend informed the Council that'the 20% rule is not in
effect.
Council Member Sample noted that one of the statements in opposition to
the change of zoning expressed the opinion that this kind of development would
devalue their home and asked for staff reaction to this opinion.
Mr. Wenger pointed out that the subject tract is located on a four -lane
divided highway; he felt that the commercial sites across the street should not
affect the value of the residences; most of the residences, with the exception
of two homes, side on Leopard Street; and the staff feels that there is a need
for neighborhood service type uses to accommodate residents in the area.
City Manager Townsend stated that the staff cannot contend that the bus-
iness zoning will have no effect on the value of residences, indicating that
this is a difficult question to answer. He pointed out that there is a reason
for businesses to be located in this area because of the rapid residential growth
in the area.
Mayor Lozano called on Mr. Donnell to comment on this application.

Mr. Donnell stated that the Planning Commission is confronted with the
problem of property value at every hearing, and they are concerned about this
problem. He continued by stating that at the time this case was heard, the
Commission was aware that Leopard Street has been a major arterial street for
many years; this was not created in a residential area; and they also considered
the fact that "B-1" zoning was already in existence in the area. Mr. Donnell
expressed the opinion that the residential property values would not be seriously
affected.
Council Member Holt referred to other zoning cases presented to the
Council in which some of the people speaking have indicated that they felt that
business zoning in their area would increase the value of their property.
City Manager Townsend agreed that this would be true if the other pro-
perty in the area was vacant.
No one spoke in regard to this application.
Motion by Sample that the hearing be closed, seconded by Diaz, and passed
unanimously.
Motion by Diaz that the Council concur with the recommendation of the
Planning Commission and approve the change of zoning on Application No. 578-5
from "R -1B" to "B-1" on Tract A and from "R -1B" to "R-2" on Tract B; seconded by
Sample; and passed unanimously.
City Manager Townsend presented the ordinances effectuating the zoning
changes approved on the two applications; City Secretary Read polled the Council
for their votes; and the following ordinances were approved:
ORDINANCE NO. 14351:
AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH
DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE
ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY
AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF DAVID S. JELLISON
BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON LOT 23, BLOCK 4, LEXINGTON
ESTATES, SITUATED IN TRE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -1B"
ONE -FAMILY DWELLING DISTRICT TO "B-3" BUSINESS DISTRICT; KEEPING IN EFFECT ALL OTHER
PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CON-
FLICT HEREWITH; AND DECLARING AN EMERGENCY.
The Charter Rule was suspended and the foregoing ordinance was approved by the fol-
lowing vote: Lozano, Diaz, Gill, Holt, Juarez and Sample voting "Aye"; Gulley,
absent.

AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH
DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565 ET SEQ, OF THE
ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY
AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF WOODLAND CREEK
DEVELOPERS BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON TRACT A (3.218
ACRES) AND TRACT B (3.193 ACRES) OUT OF TRACT I AND II OF THE C.C. HART PARTITION,
SITUTATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -1B" ONE -

The Charter Rule was suspended and the foregoing ordinance was approved by the
following vote: Lozano, Diaz, Gill, Holt, Juarez and Sample voting "Aye"; Gulley,
absent.
There being no further business to come before the Council during the
Special Council Meeting, Mayor Lozano declared the meeting adjourned at 4:10 p.m.,
June 7, 1978.
