A RESOLUTION
ACCEPTING STATE HIGHWAY DEPARTMENT MINUTE ORDER
NO. 42600; AND DECLARING AN EMERGENCY.
WHEREAS, THE STATE HIGHWAY DEPARTMENT HAS SUBMITTED A COPY OF MINUTE
ORDER N0. 42600, PASSED BY THE STATE HIGHWAY COMMISSION ON SEPTEMBER 27, 1957,
AS FOLLOWS:
WHEREAS, IN NUECES COUNTY AND THE CITY OF CORPUS CHRISTI PREVIOUS ACTIONS
OF THE HIGHWAY COMMISSION HAVE AUTHORIZED CONSTRUCTION, THE PURCHASE OF
RIGHT OF WAY OR ADVANCE PLANNING ON VARIOUS SECTIONS OF THE HIGHWAY AND
FARM -TO- MARKET ROAD SYSTEM IN NUECES COUNTY AND THE CITY OF CORPUS
CHRISTI; AND
WHEREAS, AFTER CAREFUL REVIEW AND STUDY BY THE APPROPRIATE OFFICIALS OF
NUECES COUNTY, THE CITY OF CORPUS CHRISTI AND THE TEXAS HIGHWAY DEPARTMENT
OF THE CHANGING CONDITIONS IN THE METROPOLITAN AREA, IT APPEARS DESIRABLE
TO MODIFY AND EXTEND PRESENTLY APPROVED ITEMS FOR CONSTRUCTION, THE
PURCHASE OF RIGHT OF WAY OR ADVANCE PLANNING;
NOW; THEREFORE, IT IS ORDERED THAT PREVIOUS APPROVALS OF THE COMMISSION
FOR THIS TYPE OF WORK, EITHER BY PROGRAM APPROVAL OR MINUTE ORDER, AND
PARTICULARLY MINUTE ORDERS 36687 AND 37511, ARE HEREBY SUPERSEDED BY
THIS ACTION AND IN LIEU THEREOF THE STATE HIGHWAY ENGINEER IS DIRECTED
TO PROCEED WITH CONSTRUCTION, THE PURCHASE OF RIGHT OF WAY OR ADVANCE
PLANNING IN NUECES COUNTY AND THE CITY OF CORPUS CHRISTI AS FOLLOWS:

THIS ORDER IS CONDITIONED UPON THE FOLLOWING AGREEMENTS CONCERNING SPECIFIC
ITEMS HERETOFORE LISTED:
THE HIGHWAY DEPARTMENT PARTICIPATION IN THE PROJECT ON STATE HIGHWAY 44 ON
AGRES AND LAREDO STREETS WITHIN THE CITY OF CORPUS CHRISTI CONTEMPLATES
THAT THE STATE PARTICIPATION WILL BE IN THE CONSTRUCTION OF THE SURFACING
ONLY FROM PORT AVENUE TO STAPLES STREET, AND THENCE TO A TERMINATION AT
TANCAHUA AND CARANCAHUA STREETS, TO PROVIDE TWO ONE -WAY STREETS, 44 FEET
IN WIDTH WITHOUT PARKING, UNDER THE CUSTOMARY MUNICIPAL POLICY OPERATION
OF THE TEXAS HIGHWAY DEPARTMENT. AT SUCH TIME AS THIS CONSTRUCTION IS
COMPLETED THE ROUTING OF STATE HIGHWAY 44 INTO THE CITY OF CORPUS CHRISTI
WILL BE CHANGED TO FIT THIS NEW PATTERN.
THE PROJECT ON STATE HIGHWAY 9 CONTEMPLATES THAT THE HIGHWAY DEPARTMENT
WILL PERFORM THE WORK AND BEAR THE COST OF SEPARATING THE GRADES WHERE THE
PROPOSED NEW INTERCHANGE RAILWAY TRACKS ARE EXPECTED TO CROSS STATE HIGHWAY
9 BETWEEN SAVAGE LANE AND MCBRIDE LANE, IT BEING UNDERSTOOD THAT STATE
HIGHWAY 9 WILL BE DEPRESSED AT THIS POINT TO PERMIT THE RAILROAD AND STREET
TO GO OVER STATE HIGHWAY 9. IT IS FURTHER UNDERSTOOD THAT IT WILL BE THE
RESPONSIBILITY OF SOME AGENCY OTHER THAN THE STATE TO PROVIDE THE NECESSARY
STRUCTURE TO SUPPORT THE RAILROAD AND STREET A$ IT CROSSES THE DEPRESSED
SECTION OF STATE HIGHWAY 9. IT IS FURTHER UNDERSTOOD THAT THIS PARTICIPA-
TION-ON THE PART OF THE STATE SHALL NOT BE EFFECTIVE UNTIL SUCH TIME AS THE
INTERCHANGE TRACK ON ALAMEDA STREET AT THE STATE HIGHWAY 9 EXPRESSWAY SHALL
BE REMOVED.
THIS ORDER IS SUBJECT TO THE CONCURRENCE OF NUECES COUNTY AND THE CITY OF
CORPUS CHRISTI IN ORDER THAT ALL AGENCIES OF GOVERNMENT MAY BE IN ACCORD
ON THE PLANNED DEVELOPMENT AND, IF NOT CONCURRED IN WITHIN 60 DAYS HEREOF,
SHALL BE AUTOMATICALLY CANCELED.

NOW, THEREFORE, BE IT ORDERED BY THE CITY OF CORPUS CHRISTI ACTING BY ITS
GOVERNING BODY: THAT THE PROVISIONS OF THE ABOVE MINUTE ORDER NUMBER
42600 BE ACCEPTED.
THE NECESSITY FOR IMMEDIATE ACCEPTANCE OF SAID MINUTE ORDER
NUMBER 42600 CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY
REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION
SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDI-
NANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY
COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY
EXIST, AND HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED, AND THAT
THIS RESOLUTION BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE
EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS
ACCORDINGLY SO RESOLVED.

closed is a copy of State Highway Conmission Minute Order No.
42600, dated September 27, 1957.
As you will note, this minute requires acceptance by both Nueces
County and the City of Corpus Christi to become effective. This
acceptance must be made within a period of sixty days of the date
of the minute.
For your convenience we are enclosing three copies of a suggested
resolution which you may use to indicate acceptance of the minute.
Please return two oopies of this resolution, or a similar resolution
to this office at your convenience.
Since execution of Contractual Agreements for acquisition of right
of ways cannot be undertaken until this minute is accepted, we
request that action in regard to this matter be taken as soon as
possible.

Order go. 426Oor passed by the State Highway Commission on September 27, 1957,
as followsl

the Highway Commission have authorised Construction, the purchase of Right of
Way or Advance Planning on various sections'of the Highway and Farm -to- Market
Read System in Ruse" County and the City of Corpus rp Christi; and
WHIMS, after careful review aAd study by the appropriate officials of Nusees
County, the City of Corpus Christi and the Texas Aighway Department of the
changing conditions in the metropolitan area, it appears desirable to modify
and extend prspently approved items for Construction, the purchase of Righ+
of Way or Advance Planning;
AM, THERZFME, IT IS ORDERED that previous approvals of tree (;•:amisa ion for this
type of work, either by program approval or Minute Order, and particularly
Minute Orders 36687 and 37511, are hereby superseded by this action and in lieu
thereof the State Highway Engineer is directed to proceed with construction,
the purchase of Right of Way or Advance Planning in Nseces County and the City
of Corpus Christi as follows,

The project on State Highway 9 contemplates that the Highway Department will pert
form the work and bear the cost of separating the grades where the proposed new
Interchange railway tracks are expected to cross State Highway 9 between Savage
lane and McBride Lane, it being understood that State Highway 9 will be depressed
at thia point to permit the railroad and street to go over State Highway 9. It is
further understood that it will be the responsibility of some agency other than the
State to provide the necessary structure to support the railroad and street as it
crosses the depressed section of State Highway 9. It is further understood that
this participation on the part of the State shall not be effective until such time
as the interchange track on Alameda Street at the State Highway 9 Expressway shall
be removed.
This Order is subject to the concurrence of Nusces County and the City of Corpus
Christi is order that all agencies of government may be in accord on the planned
development and, if not concurred in within 60 days hereof, shall be automatically
canceled.
