Sample MINUTES CITY OF CORPUS CHRISTI, TEXAS SPECIAL COUNCIL MEETING JULY 12, 1978 3:30 P.M. City Manager R. Marvin Townsend City Attorney J. Bruce Aycock City Secretary Bill G. Read Mayor Gabe Lozano, Sr. called the meeting to order in the Council Chambers of City Hall. City Secretary Bill G. Read stated that the necessary quorum of required Charter Officers was present to conduct a legally constituted meeting. Mayor Lozano stated that the purpose of the meeting was to conduct public •hearings on four zoning applications and requested that City Manager R. Marvin ,:Townsend present thebzoning cases. City Manager Townsend announced the public hearing on Application No. C678-1, • City of Corpus Christi, Texas, for a change of zoning from "F -R" Farm -Rural to "R -1B" One -family Dwelling District on Lots H, K, L, M, N and P, Block D, Hart Addition, located on both sides of High Ridge Drive between Leopard Street and Interstate Highway 37. City Manager Townsend noted that both the Planning Commission and the Planning Staff recommend approval, and in response to the notices of the public hearing, none were returned. He stated that this is a corrective type of change to zone the property of several owners to reflect the type of use. Chief Planner Larry Wenger located the area on the zoning and land use map, described the zoning in the surrounding area and showed slides of the area. City Manager Townsend pointed out that Mr. Ernest Wranosky of the Planning Commission was present. No one spoke in regard to this zoning application. Motion by Gulley that the hearing be closed, seconded by Sample, and passed unanimously. Motion by Gulley that Application No. C678-1 be approved and the zoning be changed from "F -R" to "R -1B", as recommended by the Planning Commission; seconded by Sample; and passed unanimously. MICRON -0 SEP 0 31980 Minutes Special Council Meeting July 12, 1978 Page 2 City Manager Townsend announced the public hearing on Application No. 678-3, Gibralter Savings, for a change of zoning from "R -1B" One -family Dwelling District to "A-2" Apartment House District on a 7.29± acre tract of land out of the A. M. French Tract, located on the west side of McKinzie Road, approximately 700 feet south of Leopard Street. Mr. Townsend stated that both the Planning Commission and the Planning Staff recommend denial of "A-2" and in lieu thereof grant "A-1" on the basis that it would permit 21 units per acre as opposed to 34 in "A-2", thereby creating less density. He informed the Council that in response to the notices of the public hearing, two in opposition and none in favor had been returned. Chief Planner Wenger located the area on the zoning and land use map, described the land use in the surrounding area, and showed slides of the area. He stated that it is in the area of a new subdivision containing single-family residences. Mr. Wenger explained that the reason the staff recommended "A-1" in lieu of "A-2" is because "A-2" allows for the construction of high-rise apartment units, and "A-1" is designed for garden -type apartments, which would be more com- patible with the single-family dwellings in the subdivision. He also stated that the applicant had agreed to the "A-1" zoning. No one spoke in regard to this zoning application. Motion by Holt that the hearing be closed, seconded by Gulley and passed unanimously. Motion by Holt that the zoning request of "A-2" be denied on Application No. 678-3, but in lieu thereof, that "A-1" be approved, as recommended by the Planning Commission; seconded by Diaz; and passed unanimously. City Manager Townsend announced the public hearing on Application No. 678-6, Oscar and Guadalupe Gonzales, for h change of zoning from "AB" Professional Office District to "B-1" Neighborhood Business District on Lots 14B and 15, Sunnyside Strip, located on the northeast corner of Everhart Road and Jacquelyn Drive. Mr. Townsend stated that both the Planning Commission and the Planning Staff recommend denial but in lieu thereof that a special permit be granted on the basis that it would be the same use and site plan approved in 1976. Minutes Special Council Meeting July 12, 1978 Page 3 City Manager Townsend informed the Council that in response to the notices of the public hearing, one in favor and two in opposition had been returned; how- ever, the two in opposition have no objection to the special permit. Chief Planner Wenger located the area on the zoning and land use map, described the land use in the surrounding area, and showed slides of the area. He stated that one lot is presently vacant; the other is occupied by a beauty shop; and the applicants desire to construct a boutique shop. Mr. Wenger also stated that the applicants have agreed to the special permit. No one spoke in regard to this application. Motion by Sample that the hearing be closed, seconded by Diaz, and passed unanimously. Motion by Gill that "B-1" be denied on Application No. 678-6, but in lieu thereof, that a special permit be approved; seconded by Juarez; and passed unani- mously. * * * * * * * * City Manager Townsend announced the public hearing on proposed Text Amend- ment to Zoning Ordinance No. 6106, as follows: (1) Amend Article 3, Subsection 3-1.26, Definitions, by deleting the word "land" and substituting the word "lot" therefor to hereafter read as follows: 3-1.26 Floor Area Factor. The floor area factor is multiplied by lot area to determine the permitted floor area. (2) Amend Article 24, Height, Area and Bulk Requirements, by amending the chart as follows: Add the phrase "of lot area" heading to hereafter read as Floor Area Per Acre of Lot s Add the phrase "of lot area" heading to hereafter read as Per Acre of Lot Area". to the heading of Column 6, said follows: "Maximum Square Foot of Area". to the heading of Column 8, said follows: "Maximum Number of Units Amend the heading of Column 9 by deleting the words "Total Land" and substituting the words "Lot Area" therefor, said heading to hereafter read as follows: "Yard, Open Space (in % of Lot Area)" Change the maximum number of units per acre of lot area for the "R -1B" One -family Dwelling District from 7 to 7.26. Change the maximum number of units per acre of lot area for the "R-2" Multiple Dwelling District from 14 to 14.52. Change the maximum number of units per acre of lot area for the "A-1" Apartment House District from 21 to 21.78. Minutes Special Council Meeting July 12, 1978 Page 4 (g) (h) (1) Change the maximum number of units per acre of lot area for the "A-2" Apartment House District from 34 to 29.04. Change the maximum number of units per acre of lot area for the "AT" Apartment -Tourist District from 43 to 43.56. Change the maximum number of units per acre of lot area for the "AB" Professional Office District from 34 to 29.04. (j) 'Change the maximum number of units per acre of lot area for the "B -1A" Tourist Court District from 43 to 38.72. (k) Change the maximum number of units per acre of lot area for the "B-1" Neighborhood Business District from 34 to 29.04. (1) (m) Change the maximum number of units per acre of lot area for the "B-2" Bayfront Business District from 43 to 43.56. Change the maximum number of units per acre of lot area for the "B-4" General Business District from 34 to 29.04. (n) Amend the two -asterisk notation below the chart by deleting the second sentence in its entirety. City Manager Townsend stated that the Planning Commission recommends the text amendments to Articles 3 and 24 of the Zoning Ordinance be approved, as recommended by the Planning Staff. Mr. Townsend explained that these amendments are designed to change techni- cal sections of the zoning ordinance to eliminate the dual interpretation of the terms of the ordinance to clarify the size of lots in accordance with the number of units allowed under certain zoning. He presented to the Council copies of a memoran- dum in regard to the recommended amendments. Chief Planner Wenger explained the problems that have been presented before the Board of Adjustment because of the dual interpretation associated with the ordi- nance as it presently exists; therefore, the staff recommends these changes to avoid confusion and inconsistencies. City Manager Townsend stated that he would like to make the following minor modifications changing the figure "29.04" to "36.3" in the following sections of Article 24: (g) Change the maximum number of units per acre of lot area for the "A-2" Apartment House District from 34 to 36.3. (i) Change the maximum number of units per acre of lot area for the "AB" Professional Office District from 34 to 36.3. M. :s Special Council Meeting July 12, 1978 Page 5 (k) Change the maximum number of units per acre of lot area for the "B-1" Neighborhood Business District from 34 to 36.3. (m) Change the maximum number of units per acre of lot area for the "B-4" General Business District from 34 to 36.3. Mayor Lozano requested Mr. Wranosky of the Planning Commission to comment on these modifications from the original recommended amendments. Mr. Wranosky stated that he did not know whether or not the Planning Com- mission would agree to the changed figures as recommended by the City Manager, but he felt that they would agree to these changes since they had approved the amend- ments. City Manager Townsend stated that the purpose of the amendments was to clarify the zoning ordinance, but if the Council has any question about the intent of the Commission, the recommended modifications could be presented to them, but the Commission did not consider the density. No one spoke in opposition to this application. Motion by Sample that the hearing be closed, seconded by Diaz, and passed unanimously. Motion by Sample that the proposed text amendments to Zoning Ordinance No. 6106, including the modifications recommended by the City Manager, be approved; seconded by Diaz; and passed unanimously. City Manager Townsend briefly explained the ordinances effectuating the approved changes of zoning on the preceding zoning applications and stated that the ordinance pertaining to the text amendments will be considered next week, since the approved modifications must be included. City Secretary Read polled the Council for their votes, and the following ordinances were approved: ORDINANCE NO. 14384: AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF CITY OF CORPUS CHRISTI, TEXAS BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON LOTS H, K, L, M, N, AND P, BLOCK D, HART ADDITION, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "F -R" FARM -RURAL TO "R -1B" ONE -FAMILY DWELLING DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. ORDINANCE NO. 14385: AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF GIBRALTER SAVINGS, BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON A 7.29+ ACRE TRACT OF LAND OUT OF THE A.M. FRENCH TRACT SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -1B" ONE -FAMILY DWELLING DISTRICT TO "A-1" APARTMENT HOUSE DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING AIL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. The Charter Rule was suspended and the foregoing ordinance was approved by the following vote: Lozano, Diaz, Gill, Holt, Juarez, and Sample voting "Aye"; Gulley, absent. ORDINANCE NO. 14386: AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF OSCAR AND GUADALUPE GONZALEZ, BY GRANTING A SPECIAL PERMIT TO ADD A BOUTIQUE SHOP TO THE BEAUTY SALON, ACCORDING TO THE SITE PLAN APPROVED BY THE PLANNING COMMISSION, SUBJECT TO THE CONDITIONS HEREINAFTER SET FORTH ON LOTS 14-B AND 15, SUNNYSIDE STRIP, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; KEEPING IN EFFECT ALL OTHER PROVISION§ OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY.
